>> NUMBER EIGHT. >> NUMBER EIGHT.

IS THERE A CITIZEN THAT WISHES TO CONSIDER ANY ITEM TO BE

CONSIDERED SEPARATELY. >> ITEMS 7, 8, 10 AND A 11.

>> THAT REQUEST IS TO SPEAK SEPARATELY ON MANY OF THE CONSENT ITEMS. I WILL TAKE A MOTION ON THE CONSENT AGENDA EXCLUDING ITEMS 7, 8, 10 AND 11.

>> COUNCILMEMBER HURT. >> YES.

>> MAY MAYOR PRO-TESTIMONY PRICE.

>> YES. >> WILLIAMS?

>> YES. >> MOTION CARRIES.

>> WE WILL NOW MOVE TO NUMBER 7 TO INQUIRE OF HIS QUESTIONS

[7. Resolution: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on Authorizing the City Manager to Execute a Contract with The Architectural Office and Interior Design Office of Tim Rice McClarty for the Design and Project Management Services for the Abilene Convention Center North Plaza Renovation (Molly Moser)]

ON ITEM NUMBER 7. >> GOOD MORNING, COUNCIL.

DAVID SCHWART. I GUESS IT WOULD BE THE DESIGN PREPARATION FOR THE NORTH PLAZA CIVIC CENTER, OR CONVENTION CENTER. PREVIOUSLY WHEN IT CAME UP A COUPLE OF YEARS AGO THERE WAS A CITIZEN MENTIONING ABOUT LIGHTING. I KNOW THEY MENTIONED SEVERAL PEOPLE WHEN THEY CAME OUT OF THE ACTIVITY THERE IT WAS QUITE DARK. I WANT TO GET MY NICKEL'S WORTH IN HERE. THAT LITTLE PLAZA PART WHEN YOU STEP DOWN IN THAT AREA, IT'S REAL NICE AND EVERYTHING, BUT I WOULD SAY MAYBE THREE OR FOUR BASKETBALL GOAL-FOOT HIGH OR LED LIGHT POLES WOULD BE IN ORDER.

I KNOW THEY PROBABLY HAVE SOMETHING IN THEIR DESIGN, BUT I JUST WANT TO MENTION THAT. YOU'D BE SURPRISED HOW WONDERFUL LED LIGHTING IS. AT THAT SHORT HEIGHT, 10 FEET OR SO, LIKE A BASKETBALL GOAL, I THINK FOUR OF THEM WOULD COVER THAT LITTLE PLAZA QUITE READILY.

AND LIKE THEY MENTIONED SOME OF THE LIGHTING AROUND THE STEPS AND STUFF WHEN THE PERSON THAT TESTIFIED BEFORE A COUPLE YEARS AGO WHEN THIS CAME UP FOR CONSIDERATION, I'M SURE THEY HAVE THAT IN MIND AS WELL.

[00:05:02]

THAT'S THE MAIN THING. I WANT TO MAKE SURE TO GET THAT IN. THERE IS NO REASON THAT LIGHTING IS OUR FRIEND AND FOR THE PRICE OF THREE OR FOUR 10-FOOT POLES IN THE PLAZA AREA, WHEN WE DO GET BACK TO NORMAL AND START HAVING ACTIVITY THERE'S, IT WILL BE WONDERFUL. I REMEMBER PICKING UP A FRIEND'S SON FROM AN ALL NIGHT SENIOR LOCK IN THERE SEVERAL YEARS AGO, AND IT IS QUITE DARK IN THE AREA I DON'T KNOW. IT WAS PROBABLY BECAUSE THAT ORIGINAL PART WAS BUILT IN 1970.

AND THEN WHEN THEY ADDED ON A WING IN 1990 THAT WAS FURTHER DOWN IN -- AND THAT LITTLE PLAZA WAS NOT CONSIDERED FOR ADDITIONAL LIGHTING AT THE TIME.

THAT'S THE ONLY THING I HAD CONCERN ABOUT THIS.

I WANTED TO MAKE SURE THE DESIGNERS ARE HEARING US AND LED LIGHTING IS JUST SO WONDERFUL.

THANK YOU VERY MUCH THIS MORNING, COUNCIL.

AND DAVID SCHWART FOR THE RECORD.

I FORGOT. I WOKE UP IN THE MIDDLE OF THE NIGHT AND REMEMBERED THAT I FORGOT TO PUT MY NAME IN FOR THE RECORD. THANK YOU VERY MUCH.

>> WE ARE STILL IN THE OPEN HEARING IF ANYONE ELSE WANTS TO SPEAK FOR ORGANS ITEM NUMBER 7.

I WILL CLOSE THE VOTE HEARINGS.

DOES COUNCIL HAVE ANY QUESTIONS OR COMMENTS ON NUMBER 7? I I WILL TAKE THE MOTION IN A SECOND. A MOTION BY PRICE.

>> SECOND BY RENTZ. FOR DISCUSSION?

READY TO VOW. >> MAYOR PRO-TEM PRICE.

>> YES. >> COUNCIL RENTZ.

>> YES. >> COUNCIL ALICE.

>> YES. >> COUNCIL HURT.

>> YES. >> COUNCIL MCCRAVER.

>> YES. >> MAYOR WILLIAMS.

>> YES. >> I WILL GO TO NUMBER 8 AND I

[8. Resolution: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on Modifying and Extending the Declaration of Local Disaster Issued January 14, 2021 (Robert Hanna)]

DON'T RECALL IF THAT WAS A CITIZEN OR A COUNCIL.

>> IT IS BOTH, BUT SCHWARTZ ALSO CALLED IT.

>> ARE THESE YOUR MOTION? >> AND MICROPHONES.

>> THANK YOU, COUNCIL. AND ONCE AGAIN DAVID SCHWART.

HERE WE ARE A MONTH LATER IT IS MOSTLY FOR FUNDING.

IF YOU HAVE BEEN FOLLOWING THE NEW ADMINISTRATION, THEY ARE NOT EXACTLY QUICK TO DO ANYTHING.

THEY SAID THEY WILL DO A PROCEDURAL THING WHERE THEY CAN BYPASS THE OTHER PARTY AND MAYBE IN MARCH THEY WILL DO SOME COVID RELIEF OR SOMETHING THEN.

SO IF WE ALL REMEMBER THIS IS THE 11TH MONTH OF IT.

I WATCHED RELIGIOUSLY THESE BRIEFINGS.

DR. DEBORAH BIRX SAYS IT IS FOUR WEEKS TO FLATTEN THE LINE. AND HERE WE ARE FEBRUARY OF 2021 AND WE ARE STILL TALKING ABOUT THIS.

YOU KNOW, SINCE THE LAST MEETING TO RENEW THIS TWO MOM AND POP RESTAURANTS WENT UNDER.

THEY SAID WE CAN'T MAKE IT AT 50%.

THEY SAID WE ARE THOUSANDS OF DOLLARS BEHIND IN OUR LEASE, OUR RENTAL. THEY SAID THIS IS OUR LAST NIGHT. WE JUST DON'T HAVE THE MEANS TO KEEP GOING AT 50%. IT IS A SHAME THAT THESE BIG CHAINS CAN GO AT 50%. WHEN I WAS OUT AT THE BIG CHAIN ON SATURDAY THERE WAS A LOT MORE TABLES OPEN.

I SAID ARE YOU AT 75% NOW? I DON'T KNOW.

YOU USED TO HAVE A SIGN THAT SAID THAT.

I ASKED THE MANAGER AND THEY SAID WE ARE STILL AT 50.

WE HAVE TO GET A CLEARANCE FROM OUR REGIONAL OFFICE BEFORE GOING TO 75. WE ARE GETTING THE INNOCULATIONS OUT, BUT MY FRIEND'S DAUGHTER WORKS AT SCOTT AND WYATT. SHE GOT THE THE THAN ONE AND THEN AFTER THE SECOND ONE IT LOOKED LIKE SHE ADD TUMOR.

IT WAS HUGE AND RED AND HOT. IT SCARED HER.

SHE WAS REAL SCARED. SHE GOT THE SECOND INNOCULATION FOR THE VIRUS, YOU KNOW.

I THINK IT WAS SOMETIME LAST WEEK.

THAT IS SCARY TO THINK THAT YOU HAVE BEEN FIGHTING CANCER FOR OVER A HUNDRED YEARS AND NOT MUCH PROGRESS.

AIDS RESEARCH, NOT MUCH PROGRESS.

YOU HAVE THE COMMON COLD AND THEY NEVER -- BUT YET THEY CAN COME UP WITH A VACCINE FOR THIS IN SIX OR 9 MONTHS? IT IS A LITTLE SCARY TO THINK ABOUT THIS.

I KNOW THIS IS ABOUT FUNDING AND EVERYTHING AND I KNOW YOU ARE THE MESSENGER, BUT DONL PENL -- DON'T PENALIZE THE

[00:10:03]

LOCAL BUSINESSES. I KNOW YOU MAY NOT HAVE A LOT

OF CONTROL OVER IT. >> DAVID SCHART.

>> WE ARE STILL IN PUBLIC HEARINGS AND I WILL ASK OUR CEO TO BRIEFLY EXPLAIN BEFORE US TODAY FOR CLARITY PURPOSES

AGAIN. >> THANK YOU, MAYOR.

THIS IS A CONTINUING DISASTER DECLARATION THAT IS REQUIRED IN ORDER TO RECEIVE FEDERAL REIMBURSEMENT.

AS I SAID A NUMBER OF DIFFERENT TIMES I THINK THE CITY OF ABILENE HAS MORE THAN DEMONSTRATED A TRYING TO EXECUTE A LIGHT HAND ON THE BUSINESS COMMUNITY SO PEOPLE CAN GO TO WORK AND THEY CAN GET PAID AND THEY CAN HAVE THEIR JOBS AND PROVIDE FOR THEIR FAMILY.

THAT WILL BE SOMETHING WE CONTINUE TO DO.

THE ONLY THING THAT IS BEING ENFORCED IS THE GOVERNOR'S ORDER. IT IS THE GOVERNOR EXECUTIVE ORDERS. THOSE ARE CHANGED OVER TIME.

THOSE GUIDE -- GUIDELINES CHANGE.

IT WILL CHANGE AND PIVOT ACCORDINGLY.

THERE IS NOTHING HERE THAT IS MORE RESTRICTIVE THAN WHAT THE STATE OF TEXAS HAS ASKED EVERY CITIZEN TO DO IN THIS PROS --

PROCESS. >> AND WHILE YOU ARE THERE, CITY MANAGER IF YOU CAN CONVEY OUR SENTIMENTS TO ANNETTE LERMA AND HER STAFF. ALMOST 1800 INNOCULATIONS WERE PERFORMED. AND MY UNDERSTANDING THE AVERAGE WAIT TIME WAS LESS THAN 20 MINUTES.

JUST WANTED TO BE SURE THAT -- AND BY THE WAY, TEXAS IS DOWN -- OUR CASES IN THE LAST WEEK IS DOWN 37%.

NATIONWIDE IT IS 24%. THERE IS A LIGHT AT THE END OF THE TUNNEL. I WANT TO PUBLICLY THANK YOU AND YOUR STAFF FOR THE WORK THAT HAS BEEN DONE AND IS BEING DONE OVER THE LAST SEVERAL WEEKS AND REALLY THE LAST 11 MONTHS. THANK YOU, MAYOR.

>> ALL OF THE VOLUNTEERSS IN THE OTHER DEPARTMENTS OF THE CITY WHO HAVE COME TO HELP WITH THE VACCINATION CLINIC AND THE VACCINE HUBS HAVE DONE A TREMENDOUS JOB.

IT IS ONE OF THE BRIGHT SPOTS IN THE COVID PANDEMIC IS THIS COMMUNITY'S RESPONSE TO THE VACCINE HUBS.

WE ARE TRYING TO GET AS MANY AS WE CAN.

IF THE STATE WOULD GIVE US MORE VACCINES WE CAN PUT MORE

IN ARMS. >> MY UNDERSTANDING IS THE SCHOOL NURSING AT TEXAS TECH AND THE PHARMACY STUDENTS AT TEXAS TECH AND THE SCHOOL OF NURSING HAVE BEEN WORKING WITH OUR FIREMEN -- OUR EMT AND OUR FIRE STAFF AND THE HEALTH DEPARTMENT TRYING TO PUT SHOTS IN ARMS FOR THE LAST SEVERAL

WEEKS. >> CORRECT, MAYOR.

IT IS ALL HANDS ON DECK. >> WE ARE STILL ON THE PUBLIC HEARING ON NUMBER 8. ANYBODY WANT TO SPEAK FOR ORGANS THIS ITEM? I WILL -- OR AGAINST THE ITEM. ANYONE ON THE COUNCIL WANT TO

SPEAK ON NUMBER 8? >> AGAIN, I THINK WE SHOULD PROTECT THE VULNERABLE. I HAVE A PROBLEM WITH THE GOVERNOR. I THINK IT IS UNCONSTITUTIONAL WHEN YOU SHUTDOWN A LEGAL OR LICENSED BUSINESS AND NOT ALLOW THEM TO MAKE A LIVING. I AM NEVER FOR THAT.

I AM NOT FOR A GOVERNOR SHUTTING ANY KIND OF BUSINESS DOWN. WE HAVE A DUTY AMONG OURSELVES TO PROTECT OURSELVES. WE ALSO HAVE A RIGHT AT

CITIZENS TO EARN A LIVING. >> WELL SAID.

JUST FOR CLARITY IT IS AN EXTENSION OF A DECLARATION THAT COULD POSSIBLY ALLOW US TO BE REIMBURSED.

THE CITY HAS INVESTED A LOT OF MONEY RESPONDING TO COVID-19.

THE HOPE IS THAT WE WILL HAVE AN OPPORTUNITY FOR A PORTION OF THE MONEY ALLOTTED TO BE REIMBURSED.

ANYMORE COMMENTS FROM THE COUNCIL? I WILL TAKE A MOTION AND A SECOND.

WE HAVE A MOTION BY COUNCILMAN MCALISTER.

A SECOND BY ALBUS. ANY DISCUSSION?

WE ARE READY TO VOTE. >> MCALISTER.

>> YES. >> REI -- CRAVER.

>> YES. >> PRICE.

>> YES. >> ALBUS.

>> YES. >> HURT.

>> NO. >> WILLIAMS.

[10. Resolution: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on Awarding Bid No. 2123 to Bontke Brothers, Inc. on Southwest Drive Resurfacing Project (Greg McCaffery)]

>> YES. >> WE WILL MOVE ON NUMBER 10.

AND MR. SCHWARTZ YOU HAD A QUESTION ON 10.

WE INVITE YOU BACK TO THE PODIUM.

>> AGAIN DAVID SCHWART. SOUTHWEST DRIVE IS UNDER THE STREET MAINTENANCE COMMISSION AND I THINK THAT IS THE FUNDING THROUGH DCOA. YOU KNOW, YOU WATCH A VIDEO REPORT TWO DAYS AGO ON THE LOCAL STATIONS.

THEY SAY THE REASON SOUTHWEST DRIVE IS OPEN IS BECAUSE OF THE TREE. THAT'S BECAUSE OF THE RESTAURANT ON THE CORNER. IT IS CLOSER DOWN TOWARD THE WALMART TURN IN AND THE WENDY'S WHERE THE ROAD IS

[00:15:03]

SCOURING UP. THE ONLY THING I HAD TO ASK IS HE IS JUST A GREAT JOB AS AN ADVISORY COMMITTEE, THIS ROAD ARE THEY GOING TO RESURFACE IT FROM CLARK TO BELIEVE KOHL'S DEPARTMENT STORE? I BELIEVE THAT'S WHAT IT SAYS ON THE MAP. THAT'S REALLY THE ONLY CLARIFICATION I HAD. THE MEDIA IS NOT HERE TODAY, OF COURSE, BUT I WANTED TO CORRECT THEM SAYING OH THE ROAD IS AN ISSUE AND ONE OF THE TRAFFIC CONGESTIONS ON SOUTHWEST DRIVE. THAT'S NOT EXACTLY RIGHT.

IT IS NOT TO DO WITH THE ROADWAY.

IT IS BECAUSE IT IS SCOURING OR ANYTHING.

IT IS TO DO WITH THE BUSINESS THERE ON THE CORNER.

THEY ROUTINELY HOLDUP TRAFFIC THERE WHEN YOU ARE TURNING THERE. YOU KNOW, I NEARLY GOT IN A WRECK SEVERAL TIMES. IT IS NOT NECESSARILY TO DO WITH THE ROADWAYS. I JUST WANTED TO LET YOU KNOW THAT IT IS NOT THE ROADWAY ISSUE THEY RECORDED A COUPLE OF DAYS AGO. THE ONLY THING I WANT TO KNOW IS THE LENGTH OF THE ROADWAY THEY ARE GOING TO REPAIR, AND THEN THEY MENTIONED ANOTHER ROADWAY.

I BELIEVE IT IS THE ROADWAY BEHIND KOHL'S.

THASES -- THAT'S ALL I NEED ON THAT ITEM.

DAVID SCHWART FOR THE RECORD AGAIN.

>> MR. HANNAH? >> IT IS CLEARLY STATED IN THE BACK UP. THANK YOU.

>> WE ARE STILL IN THE PUBLIC HEARING.

WOULD ANYONE ELSE LIKE TO SPEAK FOR ORGANS THIS -- FOR OR AGAINST THIS ITEM. DOES COUNCIL HAVE ANY

QUESTIONS TO THIS ITEM. >> MOVE FOR APPROVAL.

>> A MOTION BY COUNCILMAN PRICE.

>> SECOND. >> AND SECOND BY COUNCIL

CRAVER. >> MAYOR PRO THEM PRICE.

>> YES. >> RENTS.

>> YES. >> ALBUS.

>> YES. >> HURT.

>> YES. >> MCALISTER.

>> YES. >> CRAVER.

>> YES. >> WILLIAMS.

>> YES. >> I MOVE TO ITEM NUMBER 11

[11. Resolution: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on the Purchase of Accessories to Complete Six (6) Standard Patrol Police Pursuit Vehicle Tahoes from Cap Fleet Upfitters for Abilene Police Department (Tim Cass)]

AND WE WILL ASK MR. SCH HWART -- SCHWART TO COME AGAIN TO THE PODIUM AND WE ARE IN A PUBLIC HEARING.

>> THANK YOU. DAVID SCHWART AGAIN.

PREVIOUSLY LAST MONTH YOU PUT INTO PURCHASE SEVEN TOWELS.

IT IS LATE JUNE OR JULY. ACCORDING TO THE PACKET YOU ARE BUYING FOR SIX. THE MAIN THING THAT CAUGHT MY EYE IN THIS PACKET WAS, AND I AM GOING TO USE ROUND NUMBERS. THERE IS A GUN RACK AND GUN LOCK. I DON'T SEE ANY REASON WHY YOU CANNOT STRIP THOSE OUT OF THE RETIRED TAHOES, A GUN RACK AND A GUN LOCK AND MOVE THEM OVER TO THE NEW ONE.

I DID NOT LOOK AT THE SHEET TO SEE IF IT SAID ABOUT THE LIGHT BAR. YOU KNOW, THIS IS, AS WE SAY, TYPICAL GOVERNMENT WASTE. THERE IS NO REASON YOU CAN'T RECYCLE THAT GUN WRACK AND STUFF OUT OF THE RETIRING TAHOES. IT SOUNDS LIKE WHAT YOU WANT TO DO IS YOU WANT TO PUT ALL THIS NEW STUFF IN IT, AND THEN OH SOMETIME IN THE FUTURE WE WILL STRIP OUT THE OLD TAHOES. $3,000 AND I AM USING ROUND NUMBERS. THAT'S ABOUT $500 A TAHOE AND I DIDN'T LOOK AT ANY OTHER THING.

THERE WERE NO ELECTRONICS OR COMPUTER MOUNTS OR RADIO MOUNTS OR ANYTHING. IT DID MENTION THE RADIO CONTROL HEAD, BUT IT SAYS ZERO COST SO I GUESS THAT IS JUST A CONSOLE THAT IT FITS IN OR SOMETHING.

YOU KNOW, YOU HAVE TO CUT CORNERS A LITTLE BIT TOO.

IT IS THEIR MONEY TOO WHEN THEY DO THESE BUDGETS.

IT IS THEIR MONEY TOO THEY ARE SPENDING.

YOU COULD SAVE $3,000 RECYCLING SOME OF THAT.

I DON'T KNOW IF THE LIGHT BARS -- I'M SURE THE DIMENSIONS OF THE 2013 TAHOE ARE THE SAME AS THE 2021.

IF IT DOESN'T WORK, THE NEW ONES ARE LED AND THEY ARE REALLY BRIGHT. THEY ARE BLINDING BRIGHT ALMOST. I'M JUST POINTING OUT TO THE CITIZENS OUT HERE WATCHING THIS THAT THAT SOUNDS LIKE GOVERNMENT WASTE. WE HEARD THE OLD STORIES ABOUT THE 80S AND THE 90S ABOUT OH THE GOVERNMENT SPENT SO MUCH ON A HAMMER OR SO MUCH ON TOILET SEATS.

RECENTLY WE HAD THE AIR TANKER AND THEY SPENT 300 GRAND ON

[00:20:04]

COFFEE CUPS BECAUSE IT TAKES ON HOT CUP OF COFFEE TO FLY A TANKER AND YOU HAVE TO REFUEL EVERY 8 TO 10 HOURS.

JUST BRINGING THAT UP. THE CITIZENS SHOULD KNOW THAT THAT CAN BE RECYCLED FROM THE PREVIOUS RETIRING PATROL UNITS. THANK YOU VERY MUCH, COUNCIL.

>> I WILL INVITE TIM CASS TO ADDRESS SOME OF THIS STUFF.

THE CITY OF ABILENE DOES A GOOD JOB OF PULLING COMPONENTS FROM VEHICLES WHEN WE CAN TO USE THEM.

TIM, CAN YOU ADDRESS SOME OF THE CONCERNS THAT WERE

DISCUSSED? >> GOOD MORNING, COUNCIL, MR. MAYOR. YOUR QUESTION THIS MORNING REGARDING THE QUANTITY, SIX VERSUS SEVEN.

THE SEVENTH IS THE INEQUITY AND IS UP FOR BID SEPARATELY AND NOT INVOLVED FOR THIS PURCHASE.

IT IS FOR 2021 ACCESSORIES. WE HAD A MODEL CHANGE.

GENERAL MOTORS HAD A SHORT RUN YEAR AND GAVE LITTLE TIME FOR THE AGO -- ACCESSORY COMPANIES TO GET DIMENSIONS.

PART OF OUR NOT NECESSARILY RUSH TO DO THIS, BUT PART OF OUR DESIRE TO DO THIS NOW IS SO THAT WE ARE PREPARED SO WE CAN HONOR THE COMMITMENT WE MADE LAST TIME.

THE DIMENSIONS OF THE VEHICLE ARE DIFFERENT.

WE HAVE LOOKED AND CONTINUE TO RECYCLE WHEN WE ARE ABLE TO.

BUT THINGS LIKE CAGES, WHEN THEY FIT IN THE VEHICLE THEY ARE DESIGNED FOR A SPECIFIC VEHICLE.

THAT IS ONE OF THE EXPLANATIONS.

>> SO THERE HAS BEEN A -- IN THE 2021 THERE HAVE BEEN A MODIFICATION TO THE INTERIOR THAT NECESSITATES THE INABILITY TO RECYCLE AND REUSE THE EXISTING PIECE, IS THAT

CORRECT? >> YES, SIR.

>> TO PUT IT MORE DIRECTLY, THE OLD PARTS DON'T FIT.

>> THANK YOU FOR THE WEST TEXAS VERNACULAR.

>> WE ARE STILL IN A PUBLIC HEARING.

DOES ANYONE ELSE LIKE TO SPEAK TO ITEM NUMBER 11, FOR OR AGAINST? I'LL CLOSE THE PUBLIC HEARING. DOES COUNCIL HAVE ANY ADDITIONAL QUESTIONS OR COMMENTS OVER NUMBER 11?

>> I WOULD LIKE TO SAY THAT I MEAN THINGS DO WEAR OUT TOO.

A GUN RACK AND A LOCK IS SOMETHING IMPORTANT FOR A POLICE OFFICER TO HAVE THAT WORKS.

I DON'T HAVE AN ISSUE WITH THAT.

>> I WILL SAY THAT THIS FORUM IS DESIGNED TO ALLOW OUR CITIZENS TO ASK QUESTIONS, AND WE SHOULD ALWAYS RESPOND TO THOSE QUESTIONS. I THINK IT IS AN EXERCISE THAT HOPEFULLY ELEVATES TRUST IN THE LOCAL GOVERNMENT AND IT PROVIDES AND ENCOURAGES CITIZENS TO BE ENGAGED.

WE APPRECIATE THE QUESTION, MR. SCHART AND WE APPRECIATE THE RESPONSE FROM THE CITY. WE ARE ALL A TEAM.

ANY OTHER COMMENTS FROM COUNCIL? I WILL ACCEPT A MOTION AND A SECOND.

>> SO MOVED. >> MOTION BY COUNCIL

MCALISTER. >> SECOND.

>> A SECOND BY COUNCILMAN PRICE.

ANY FURTHER DISCUSSION? WE ARE READY TO VOTE.

>> MCALISTER. >> YES.

>> COUNCIL CRAVER. >> YES.

>> PRICE. >> YES.

>> RENTS. >> YES.

>> ALBUS. >> YES.

>> HURT. >> YES.

>> AND MAYOR WILLIAMS. >> YES.

>> MOTION CARRIES. >> WELL NOW I MOVE TO ITEM

[14. Ordinance (Final Reading) Z-2021-01: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on a request from Lane Miller to rezone property from a Planned Development (PD) District primarily limited to residences, to a Neighborhood Office (NO) District and located at 3702 Antilley Road, approximately 0.2 mile east from Buffalo Gap Road (Zack Rainbow) (Part 1 of 2)]

NUMBER 14. I WILL ASK ZACK RAINBOW TO

PRESENT THIS ITEM. >> GOOD MORNING MAYOR AND CITY COUNCIL. BEFORE YOU TODAY IS ZONING REQUEST Z-2021-01 AND THE REQUEST FROM LANE MILLER TO REZONE DEVELOPMENT NUMBER FOUR WHICH IS A FAIRWAY AT 3702 ANTILLEY ROAD. WE RECEIVED ONE IN FAVOR AND FOUR IN OPPOSITION. IT IS A LENGTHY RESPONSE IN OPPOSITION THAT IS INCLUDED IN YOUR PACKET IF YOU WANTED TO READ THAT. PLANNING AND ZONING DID MAKE A RECOMMENDATION OF APPROVAL. HERE IS THE AERIAL.

YOU CAN SEE THE EXISTING HOUSE CLEARED.

THE DESIRE IS TO USE IT FOR A FINANCIAL ADVISING BUSINESS.

THEY LIMIT HOURS AND THE SIZE OF THE BUILDING, ET CETERA.

WHAT IT WAS MEANT FOR IS A MAJOR ROADWAY AND TO BE COMPATIBLE WITH THE NEIGHBORHOODS.

AGAIN THE ZONING YOU CAN SEE IT IS ALL IN THE MIDDLE THERE

[00:25:04]

TO THE EAST. PICTURES OF THE PROPERTY.

HERE IS THE NOTIFICATION WE HAVE FOUR IN OPPOSITION AND ONE IN FAVOR. IT REQUIRES A SUPER MAJORITY VOTE. 20% TRIGGERS THE SUPER MAJORITY. WE REVIEWED THIS CONSISTENT WITH THE PLAN USE AND THE DEVELOPMENT PLAN MAP.

IT WAS REVIEWED PURSUANT TO SECTION 1414, THE LAND DEVELOPMENT CODE. STAFF DOES RECOMMEND APPROVAL AS WELL AND PLANNING AND ZONING AGAIN DID MAKE A RECOMMENDATION OF APPROVAL. I WOULD BE HAPPY TO ANSWER ANY

QUESTIONS. >> THANK YOU, MR. RAINBOW.

COUNCIL? >> SOME OF THE CONCERNS THAT WERE RAISED WERE SPECIFIC TO SOME OF THE OTHER USES THE NEIGHBORHOOD OFFICE WOULD ALLOW FOR.

CAN YOU GO THROUGH SOME OF THOSE?

>> I WASN'T INVOLVED IN THAT CHAIN OF E-MAILS OR

CONVERSATION. >> SO WHAT ELSE IS ALLOWED IN NEIGHBORHOOD OFFICE? IS IT LIKE A RESTAURANT-TYPE

USE? >> IT IS PRIMARILY FOR OFFICES, DENTAL OFFICES AND FINANCIAL SERVICES, STUFF LIKE THAT THAT PEOPLE IN THE NEIGHBORHOOD WOULD GENERALLY USE AS A PRODUCT. FOR INSTANCE, THIS ONE AT EDWARD JONES, NOT MANY DIFFERENT USES.

PRIMARILY OFFICE USES. >> I AM JUST LOOKING AT THE CHART AND I THOUGHT IT HAD A P NEXT TO THE RESTAURANT.

>> IT WOULD BE PERMITTED WITH A CONDITIONAL USE PERMIT AND IT WOULD BE ESSENTIALLY A REZONING.

>> WHAT IS THE DIFFERENCE ON THAT? OTHERS HAVE A C AND THIS HAS A P/C.

>> I WOULD HAVE TO READ INTO IT HONESTLY.

I DON'T WANT TO GIVE YOU THE WRONG ANSWER.

WE NEED TO KNOW WHAT WE ARE VOTING ON.

THAT IS PART OF WHAT WE ARE APPROVING.

>> WHAT I MIGHT SUGGEST IS WE TABLE THIS ITEM AND THE PLANNING STAFF CAN GET THAT ANSWER AND WE CAN MOVE FORWARD WITH THE OTHER ITEMS AND PICK IT UP AFTER THE LAST TWO

ITEMS. >> IT REQUIRES A MAJORITY SO THAT IS THE WISEST THING TO DO IN THAT REGARD.

>> JUST TO MAKE SURE. WE ARE APPROVING NOT THE OFFICE, BUT A ZONING THAT WILL ALLOW ALL THE THINGS THE ZONING ALLOWS. WE WANT TO BE CLEAR ON WHAT WOULD BE ALLOWED WITH THE APPROVAL OF THE ZONING.

>> CORRECT. CHERYL IS LOOKING THAT UP.

>> WE WILL TABLE, THIS BUT PRIOR TO THAT FROM THE COUNCIL, ANY OTHER QUESTIONS YOU MAY HAVE SO IN THE MIDST OF OBTAINING ANSWERS THAT COUNCILMAN PRICE PRESENTS -- PRESENTED MORE RESEARCH CAN BE ALLOCATED.

>> ZACK, IN THE NEIGHBORHOOD OFFICE, WHAT ARE THE HOUR

RESTRICTIONS? >> I BELIEVE IT IS 10 P.M.

IT IS GOING TO BE 7 TO 10 P.M. OR 11.

I MAY BE WRONG ON AN HOUR OR TWO ON THE END TIME.

>> CHECK THE HOURS ALSO. ANY OTHER QUESTIONS FOR ZACK AND STAFF? SO REALLY WE HAVE SOME QUESTIONS POSED BY COUNCILMAN PRICE, HOURS OF OPERATION AND MCALISTER AND WE CAN REVISIT THIS ONCE STAFF QUICKLY HAS A

CHANCE TO RESEARCH. >> WE'LL GET YOU THE ANSWERS

QUICKLY. >> IN THAT REGARD I WILL MAKE A MOTION TO TABLE -- DO WE WANT TO TABLE?

>> YOU CAN GO TO THE NEXT ITEM. TABLE MAY BE THE NEXT

PARLIAMENTARY PROCEDURE. >> YES.

>> SO I MAKE A MOTION TO TABLE ITEM NUMBER 14.

I HAVE A MOTION AND A SECOND BY COUNCILMAN PRICE.

ANY FURTHER DISCUSSION? WE ARE READY TO VOTE.

>> PRICE. >> YES.

>> RENTS. >> YES.

>> ALBUS. >> YES.

>> HURT. >> YES.

>> MCALISTER. >> YES.

>> CRAVER. >> YES.

>> AND MAYOR WILLIAMS. >> YES.

>> MOTION CARRIES. >> AND NOW WE MOVE TO ITEM

[15. Ordinance (Final Reading) Z-2021-02: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on a request from Pattie Hollingsworth and Matthew Gjerstad to rezone property from an Agricultural Open Space (AO) to a Residential Single-Family (RS-6) District and located on approximately 0.79 acre at 5526 and 5534 Highway 277, approximately 0.62 mile southwest from Texas Avenue’s intersection with Highway 277 (Zack Rainbow)]

NUMBER 15 AND WE WILL INVITE ZACK RAINBOW AGAIN, PLANNING DIRECTOR AND OPERATION SERVICES.

>> THANK YOU, MAYOR AND CITY COUNCIL.

BEFORE YOU IS Z-2021-02 AND IT IS A REQUEST FROM PATTIE HOLING -- HOLLINGSWORTH AND MATTHEW GJERSTAD TO REZONE PROPERTY FROM AGRICULTURE OPEN SPACE TO RESIDENTIAL SINGLE-FAMILY DISTRICT. 3 IN FAVOR AND NONE IN OPPOSITION. THE PLANNING COMMISSION RECOMMENDED APPROVAL AT THEIR LAST MEETING.

[00:30:03]

HERE IS AN AERIAL. IT IS THE TWO LOTS THERE WITH THE HOUSE AS WELL AS THE MIDDLE LOT.

THERE WAS A HOUSE THAT BURNED DOWN THERE MANY, MANY YEARS AGO. AS YOU CAN SEE HERE AS WE HAVE BEEN WORKING WITH HERSHEY SUBMITTED -- HER SHE SUBMITTED A PLAT AND PRIOR TO VIEWING THIS IT WAS PART OF THE PLAT REVIEW. SO SHE HAS DONE EVERYTHING WE HAVE ASKED HER TO ADDRESS AND CORRECTED THE SITUATION.

HER INTENT IS TO REBUILD THE HOME THAT WAS THERE.

AS YOU CAN SEE HERE IT IS ZONED AO PRIMARILY.

THE REASON SHE HAD TO REZONE WAS AO.

MINIMUM ACREAGE IS FIVE ACRES.

THE TOTAL IS FIVE ACRES. SHE HAS TO REZONE TO GET A BUILDING PERMIT. THAT'S WHAT SHE IS IN THE PROCESS OF DOING. PICTURES OF SUBJECT PROPERTY.

HERE IS THE NOTIFICATION MAP. THREE IN FAVOR AND NONE IN OPPOSITION. THE FUTURE LAKE IS PLANNED AND THE DEVELOPMENT MAP AND PURSUANT TO SECTION 1414 OF THE LAND DEVELOPMENT CODE. STAFF IS RECOMMENDING APPROVAL. PLANNING AND ZONING IS RECOMMENDING APPROVAL AS WELL.

I WOULD BE HAPPY TO ANSWER ANY QUESTIONS.

>> ANY QUESTIONS PRIOR TO THE PUBLIC HEARING?

>> THANK YOU. >> AT THIS TIME I WILL OPEN UP THE PUBLIC HEARING. IS THERE ANYONE THAT WOULD LIKE TO SPEAK EITHER FOR ORGANS -- OR AGAINST THIS ITEM. IF SO PLEASE GIVE YOUR NAME FOR THE RECORD. SEEING NO ONE I WILL CLOSE THE PUBLIC HEARING COUNCIL, ANY QUESTIONS OR COMMENTS? IF NOT I WILL ACCEPT A MOTION AND SECOND.

>> SO MOVED. >> A MOTION BY COUNCILMAN

MCALISTER. >> SECOND.

>> AND A SECOND BY COUNCILMAN CRAVER.

ANY FURTHER DISCUSSION? READY TO VOTE.

>> MCALISTER. >> YES.

>> CRAVER. >> YES.

>> PRICE. >> YES.

>> RENTS. >> YES.

>> ALBUS. >> YES.

>> HURT. >> YES.

>> AND MAYOR WILLIAMS. >> YES.

>> MOTION CARRIES. >> WE WILL NOW MOVE TO ITEM

[16. Ordinance (Final Reading) TC-2021-01: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on a request from Leonor Rivera, agents Anton and Francesca Barnett, to abandon the public right-of-way (40-feet) of Sunrise Avenue extending between Minda Street (on the south) and Hailey Street (on the north) and located approximately 650 feet east from T&P Lane in east central Abilene (Zack Rainbow)]

NUMBER 16. WE WILL ASK ZACK RAIN --

RAINBOW TO PRESENT THIS ITEM. >> THANK YOU, MAYOR.

THIS REQUEST BEFORE YOU IS 2 R-2021-01.

THE REQUEST IS TO ABANDON 650 FEET OF -- I'M SORRY.

SUNRISE AVENUE 40-FOOT UNAPPROVED AVENUE BETWEEN HAILEY STREET AND MINDA STREET.

IT IS NEAR THE CHURCH OF CHRIST.

IT IS NEAR THE T AND P LANE. IT IS RIGHT NEAR THE NEW CREDIT DARR -- CEDAR CREEK WATERWAY.

WE RECEIVED NOTIFICATION, TWO IN FAVOR AND NONE IN OPPOSITION. PLANNING AND ZONING RECOMMENDED APPROVAL. HERE IS AN AERIAL THAT YOU CAN SEE HERE. IT IS BASICALLY ESSENTIAL.

AND THEN THIS IS THE SOUTHERN TWO LOTS IN BETWEEN SUNRISE AVENUE AND THEY WILL BUILD A NEW HOUSE AND THE PROPERTIES -- THE PROPERTY OWNERS TO THE NORTH HAVE AGREED TO PARTICIPATE IN THAT AS WELL TO CLEAN THE AREA UP.

A PICTURE OF THE ZONING MAP. HEAVY INDUSTRIAL TO THE NORTH. SOME PICTURES HERE AND YOU CAN SEE IT IS FAIRLY IMPROVED. AND HAS BEEN SO SINCE I BELIEVE 1937. JUST SOME PICTURES OF THE SURROUNDING PROPERTIES. TWO IN FAVOR AND NONE IN OPPOSITION AS YOU CAN SEE HERE.

THIS WAS REVIEWED CONSISTENT WITH THE COMPREHENSIVE PLAN AND LAND DEVELOPMENT CODE AND THE DEVELOPMENT MAP WAS REVIEWED BY THE DRC. YOU HAD VERY FEW COMMENTS.

THOSE WERE INCLUDED IN YOUR PACKET.

I BELIEVE EASE -- EASE MEANTS WERE PART OF THE -- PART OF

[00:35:05]

IT. DRC RECOMMENDED SATISFACTORY APPROVAL. PLANNING AND ZONING BOTH RECOMMEND APPROVAL. I WOULD BE HAPPY TO ANSWER ANY

QUESTIONS. >> I AM A CHURCH LEADER, AN ELDER, AT THE MINISTRY CHURCH OF CHRIST IN CLOSE PROXIMITY TO THIS. I DIDN'T THINK OF THIS, BUT IS THERE ANY CONFLICT OF ME PARTICIPATING IN THE

DISCUSSION ON THIS ITEM? >> NO, SIR, I BELIEVE WE TALKED ABOUT A PREVIOUS ITEM AND THERE WAS NO LEGAL

CONFLICT. >> THIS COUNCIL -- DOES COUNCIL HAVE QUESTIONS OR COMMENTS TO MR. RAINBOW OR STAFF PRIOR TO THE PUBLIC HEAR SNG.

>> ALL OF THESE PICTURES I SEE ZACK SHADOW AND I GUESS THAT'S WHY WE ARE HAVING SIX MORE WEEKS OF WINTER.

I CAN SEE YOUR SHADOW IN THE PICTURES.

>> ANY OTHER QUESTIONS PRIOR TO THE PUBLIC HEARING?

>> AT THIS TIME I WILL OPEN UP THE PUBLIC HEARING.

IS THERE ANYONE THAT WOULD LIKE TO SPEAK EITHER FOR OR AGAINST THIS ITEM? IF SO PLEASE COME FORWARD AND GIVE YOUR NAME FOR THE RECORD.

>> GOOD MORNING, EVERYONE. I AM FRANCESCA BARNETTE.

LEONOR RIVERA IS MY GRANDMOTHER.

SHE LIVES AT THE HOUSE AT 866 MY WHOLE LIFE AND WELL BEFORE THAT. WE JUST BASICALLY ARE WANTING TO MAKE SURE THAT WE CAN DEVELOP SOMETHING ON THAT LAND. THAT LAND HAS BEEN VACANT FOR A VERY, VERY LONGTIME. AND SO ME AND MY HUSBAND OUT OF ALL OF HER KIDS AND GRANDKIDS, WE ARE THE ONLY ONE THAT'S ARE ACTUALLY WANTING TO MOVE FORWARD WITH DOING SOMETHING WITH THAT LAND. WE DO INTEND TO PUT A HOME THERE. WE HAVE THREE CHILDREN AND ONE ON THE WAY. AND WE ARE WANTING JUST TO BE ABLE TO HAVE SOMETHING THERE THAT WE CAN PASS ON TO THEM.

THE LAND HAS BEEN IN OUR FAMILY FOR ALMOST A HUNDRED YEARS. IT WAS PASSED DOWN THROUGHOUT THE FAMILY. WE ALSO HAVE DOCUMENTATION GOING BACK TO THE ORIGINAL PLANS FOR THE LAND.

IT IS BACK TO 1881. WE HAVE ALL OF THE DOCUMENTATION. IT WAS SUPPOSED TO BE A SCHOOL FOR THE BLIND AND A LOT OF OTHER THINGS.

IT IS REALLY FUN TO LEARN MORE ABOUT IT.

IT IS NOT SO MUCH AS SOMETHING THAT MEANS TO OUR FAMILY AND TO HAVE SOMETHING TO PASS ON TO OUR CHILDREN.

I JUST WANTED TO LET YOU GUYS KNOW THAT IT IS NOT NECESSARILY A BUSINESS DEAL. IT IS SOMETHING THAT ACTUALLY

MATTERS TO US. >> THANK YOU.

WE ARE STILL IN PUBLIC HEARING.

DOES ANYONE WANT TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NO ONE WE WILL CLOSE THE PUBLIC HEARING.

DOES COUNCIL HAVE ANY ADDITIONAL QUESTIONS AND/OR

COMMENTS? >> MISS BARNETTE, I WANT TO COMMENT YOU ON YOUR BEAUTIFUL HAND WRITING.

THAT REALLY IS A HISTORIC NEIGHBORHOOD.

IT IS EAST OF THE GOOD LITTLE NEIGHBORHOOD, ONE OF THE NEIGHBORHOODS WASHED AWAY BY THE FLOODS IN THE EARLY 80S. AND IT IS JUST SOUTH OF THE AREA THAT WAS ONE OF THE FIRST AREAS FOR LATINOS IN OUR COMMUNITY. IT IS A VERY HISTORIC PIECE OF LAND IN OUR COMMUNITY. I WILL ACCEPT A MOTION AND

SECOND. >> SO MOVED.

>> MOTION BY HURT. MOTION BY ALBUS AND A SECOND BY HURT. ANY OTHER DISCUSSION?

READY TO VOTE. >> ALBUS.

>> YES. >> HURT.

>> YES. >> MCALISTER.

>> YES. >> CRAVER.

>> YES. >> PRICE.

>> YES. >> RENTS.

>> YES. >> AND MAYOR WILLIAMS.

>> YES. >> ARE WE READY TO MAKE A

[14. Ordinance (Final Reading) Z-2021-01: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on a request from Lane Miller to rezone property from a Planned Development (PD) District primarily limited to residences, to a Neighborhood Office (NO) District and located at 3702 Antilley Road, approximately 0.2 mile east from Buffalo Gap Road (Zack Rainbow) (Part 2 of 2)]

MOTION TO ROOF OR TABLE ITEM NUMBER 14?

>> SECOND. >> WE HAVE A SECOND BY COUNCILMAN PRICE. ANY FURTHER DISCUSSION?

WE ARE READY TO VOTE. >> PRICE.

>> YES. >> RENTZ.

>> YES. >> ALBUS.

>> YES. >> HURT.

>> YES. >> MCALISTER.

>> YES. >> CRAVER.

>> YES. >> AND WILLIAMS.

>> YES. >> MOTION CARRIES.

SO WE HAVE 14 BACK BEFORE US. THERE WERE A FEW QUESTIONS AND INQUIRIES FROM COUNCILMAN PRICE AND RETZ AND MCALISTER.

>> WE CAN COME IN AND EXPLAIN THE PNC BECAUSE IT IS A LITTLE CONVOLUTED. HOURS OF OPERATION ARE 6 A.M.

TO 11 P.M. >> GOOD MORNING.

>> INTRODUCE YOURSELF AND YOUR ROLE AT THE CITY.

[00:40:03]

>> OF COURSE. PLANNING SERVICES MANAGER FOR THE CITY OF ABILENE. THE REASON THERE IS A P AND A C ON THAT LAND MATRIX IS IT IS NOT IN THE NEIGHBORHOOD RIGHT TO HAVE A RESTAURANT OR FAST-FOOD.

BUT THERE ARE A COUPLE OF CRITERIA THAT YOU WOULD MEETS IN ORDER TO HAVE SOMETHING LIKE THAT.

ONE, IT MUST BE LOCATED IN THE EXISTING OFFICE.

SO WE ARE TALKING SOMETHING LIKE A COFFEE SHOP ON THE INSIDE AS A RESTAURANT-TYPE BUSINESS.

JUST TO BE ABLE TO SERVICE THE PEOPLE WHO ARE IN THE OFFICE.

AND IT CANNOT BE THE PRINCIPAL USE OF THE PROPERTY.

AND IT CANNOT TAKE MORE THAN 10% ST -- 10% OF THE TOTAL FLOOR STRUCTURE IN THE STRUCTURE.

IN THIS PARTICULAR HOME THEY ARE PLANNING TO KEEP THE STRUCTURE AND THAT MEANS LESS THAN 10% OF THE CURRENT STRUCTURE WOULD BE ALLOWED FOR A COFFEE SHOP, BUT NOT THE PRINCIPAL USE OF THE BUILDING.

>> THANK YOU FOR CLARITY. >> MR. PRICE?

>> SO WHAT CAN BE DONE THERE THAT IS NOT ALLOWED IN A RESIDENTIAL? WHAT ARE SOME OF THE

EXAMPLES? >> SO SOME EXAMPLES THAT YOU CAN HAVE WITHIN THAT -- LET ME GO TO THAT QUICKLY.

I APOLOGIZE FOR THAT INCLUDING THAT SLIDE IN YOUR PACKET.

WE NORMALLY DO INCLUDE THOSE TYPES OF THINGS.

NEIGHBORHOOD OFFICE YOU COULD HAVE LOTS OF RESIDENTIAL USES.

THE ACCESSORY THINGS YOU CAN HAVE ARE DWASH -- LET ME GO

BACK TO THIS PIECE. >> I I HAVE IT HERE.

IT IS NEIGHBORHOOD OFFICE, RIGHT?

>> YES. >> YOU CAN HAVE -- I WILL READ THROUGH IT QUICKLY. AN ANTENNA, ATM, DAYCARE OPERATIONS IS THE P/C, FIELD OFFICES FOR CONSTRUCTION WILL BE A TEMPORARY USE FOR THE PURPOSE OF THE CONSTRUCTION, HOME OCCUPATION AND THAT IS RESIDENT SIDE, MOBILE HOME AS CONDITIONAL USE, RECREATION BUILDING, MULTI-PURPOSE IS PERMITTED, RECREATION EQUIPMENT, MOBILE STORAGE AND PARKING IS PERMITTED, SUBDIVISION FOR SALES PERMITTED, SWIMMING POOL PERMITTED, TENNIS COURTS ARE PERMITTED, A WIND ENERGY CONVERSION SYSTEM IS A P/SE.

CULTURE FACILITIES ARE CONDITIONAL, RECREATION OUTDOORS PASSIVE WHICH WOULD BE LIKE A PLAY FIELD, LIKE A FLAT FIELD WOULD BE PERMITTED.

FIRE AND POLICE STATIONS ARE PERMITTED.

MEDICAL LABORATORIES ARE CONDITIONAL USES AND A POST OFFICE IS PERMITTED. MAYBE WE SHOULD MAKE THEM CONDITIONAL. JUST KIDDING.

ART SCHOOLS ARE CONDITIONAL, CHURCHES PERMITTED, DAYCARE OPERATIONS CONDITIONAL. SCHOOL PUBLIC AND PRIVATE ARE PERMITTED. OFFICE PROFESSIONAL GENERAL AND FINANCIAL ARE PERMITTED BY RIGHT, GENERAL SERVICES, PRINTING AND COPYING IS CONDITIONAL.

AGAIN, ATM'S ARE PERMITTED. RESTAURANT FAST FRD SH -- FAST-FOOD ARE P/C. MAYBE IT IS THE CAFE ENTERPRISE BUILDING IT IS INCIDENTAL AND IT IS THERE TO SERVE THE PEOPLE IN THE OFFICE.

BROADCAST STUDIOS CONDITIONAL , AUTOMOBILE PARKING LOT STRUCTURE, A STRUCTURED PARKING GARAGE IS PERMITTED.

PUBLIC UTILITY FACILITY LIKE A SUBSTATION IS PERMITTED.

THAT SUMS IT UP. >> THE RESTAURANT WAS THE ONE THAT WAS KIND OF THE HESITATION FOR ME.

I WASN'T UNDERSTANDING THE P/C.

I APPRECIATE THE CLARIFICATION.

THE QUIZ -- QUIZNO'S WOULD BE AN EXAMPLE.

>> SUBWAY WOULD BE FINANCIAL. >> IT IS HARD TO FOCUS ON THE BUSINESS THAT THEY CAN HAVE SOMETHING THERE, BUT SMALL.

>> AND JUST FOR CLARIFICATION, IN -- WHENEVER THE MATRIX HAS ANYTHING SLASH ANYTHING, UNDER THE MATRIX IF YOU GO IN 2.4 TO 1, THEN JUST UNDERNEATH THAT IT WILL LIST OUT EVERYTHING THAT KIND OF CALLED OUT SOMETHING THAT WAS DIFFERENT OTHER THAN WHAT IS IN THE LEGEND OF P/C.

>> OKAY. I SAW THAT, BUT IT HAD -- IT

HAD O AND NOT N/O AS WELL. >> IT DOES.

AND WE CAN GET THAT CORRECTED ON THE MATRIX SO IT IS LESS CONFUSING BECAUSE N/O IS NOT LISTED AND THAT IS WHAT IT

MEANS. >> THANK YOU.

>> THANK YOU, MA'AM. >> THANK YOU.

ANYMORE QUESTIONS FROM COUNCIL PRIOR TO THE PUBLIC HEARING? HOW ABOUT YOU, -- THANK YOU, STAFF FOR YOUR DUE DILIGENCE AND PROVIDING INFORMATION TO THE COUNCIL AND THE

[00:45:02]

COMMUNITY. AT THIS TIME I WILL OPEN UP THE PUBLIC HEARING. IS THERE ANYONE THAT WOULD LIKE TO SPEAK FOR OR AGAINST THIS ITEM? IF SO, PLEASE COME FORWARD AND GIVE YOUR NAME FOR THE RECORD. SEEING NO ONE I WILL CLOSE THE PUBLIC HEARING. DOES COUNCIL HAVE ANY QUESTIONS AND/OR COMMENTS CONCERNING ITEM NUMBER 14?

>> AGAIN. APPRECIATE THE STAFF FOR ANSWERING THE QUESTIONS AND MOTION FOR APPROVAL.

>> MOTION BY PRICE. >> SECOND.

>> SECOND BY FORMER MAYOR PRO TEM.

ANY FURTHER DISCUSSION AND/OR COMMENTS?

READY TO VOTE. >> PRICE.

>> YES. >> RETZ.

>> YES. >> ALBUS.

>> YES. >> HURT.

>> YES. >> MCALISTER.

>> YES. >> CRAVER.

>> YES. >> AND MAYOR WILLIAMS.

>> YES. >> MOTION CARRIES.

>> WE WILL NOW MOVE TO THE PUBLIC COMMENT PERIOD.

[ PUBLIC COMMENTS]

THERE WILL BE NO VOTES AND NO FORMAL ACTIONS ON SUBJECTS PRESENTED DURING PUBLIC COMMENT.

IT ALLOWS MEMBER OF THE PUBLIC TO GIVE IDEAS TO CITY OFFICIALS AND STAFF. ANYONE THIS MORNING?

>> I GOT A CARD FROM MR. SCHWART.

>> MR. SCW -- SH -- SCHWART. >> YOU WILL HAVE A THREE-MINUTE TIME LIMIT THIS TIME.

>> THANK YOU. DAVID SHAW -- SHWART.

>> THE REASON I BROUGHT UP THE GUN RACK ON ONE OF THE PREVIOUS ITEMS. A LITTLE OVER 20 YEARS AGO ONE OF THE INSTRUCTORS THAT I KNEW HE PURCHASED A LIEUTENANT VEHICLE, A 96CAPRICE. YES, THE GUN RACK WAS IT -- WAS IN IT. YOU CAN SEE THE CROWN VICS WITH THE AN TAN GNAW U.S. AND THINK WHY DID THEY TAKE THOSE OFF? THE MAIN TOPIC I WANTED TO BRING UP IS WE HAVE HAD A LOT OF FIRES LATELY.

AND ESPECIALLY MULTIPLE ALARM FIRES.

WE JUST HAD ONE AT THE BRIAR WOOD APARTMENTS.

THERE IS NOTHING SCARIER THAN A FIRE.

I DON'T KNOW IF YOU HAD YOUR BUDGET SESSION YET FOR THIS YEAR OR NOT, BUT I KNOW THERE IS AN OLDER FIRE STATION THAT WAS IN SEMIRETIREMENT ON SEVENTH AND CHERRY.

I DON'T KNOW WHAT IT WOULD TAKE TO MAKE THAT OPERATIONAL AGAIN WITH EITHER ANOTHER ENGINE COMPANY OR EVEN A LADDER COMPANY OR A MEDIC TRUCK OR ENGINE COMPANY OR SOMETHING. IT IS SCARY WHEN YOU THINK ABOUT IT. YOU HAVE YOUR FIRE DEPARTMENT STRETCHED AND THERE ARE MULTI-ALARM FIRE AND 21 APARTMENTS AND A MULTIPLE-ALARM FIRE.

THE SURPLUS WAS A MULTI-ALARM FIRE.

WE HAVE HAD A LOT OF FIRES. THERE IS NOTHING SCARIER THAT WHEN YOU NEED HELP -- I NEEDED HELP AND I CALLED FOR MEDICAL HELP AND MY MOM'S HOUSE IS 90 SECONDS AWAY FROM STATION 1, BUT THEY WERE ALL AT THE TERRA FIRE.

THEY SENT AN EMS UNIT AND IT TOOK SEVERAL MINUTES TO GET THERE, SEVEN OR 10. THE TWO LADIES THERE COULD NOT HELP HER. THEY EVENTUALLY HAD TO CALL ANOTHER UNIT. IF THERE HAD BEEN AT LEAST ANOTHER ENGINE COMPANY OR A BOOSTER, ANYBODY, SOME FIREFIGHTERS THAT COULD HAVE COME THEY COULD HAVE HELPED HER. IT IS SCARY TO THINK THAT WHEN YOUR RESOURCES GET THAT LOW THAT IF YOU HAVE AN INCIDENT OR ANOTHER HOUSE FIRE OR SOMETHING.

I WANT YOU TO CONSIDER -- I WOULD EVEN BE WILLING TO PAY A LITTLE MORE, 2 CENTS MORE MAYBE ON A PROPERTY TAX RATE IF WE CAN GET EITHER STATION 9, I THINK THAT'S WHAT THEY CALL IT ON SEVENTH AND CHERRY.

IT MAY TO THE BE THAT ANYMORE.

BUT WE COULD HAVE SOMETHING ELSE FOR THE DOWNTOWN AREA.

I RECOMMEND STATION 3 PUT A LADDER COMPANY THERE IF THERE IS ROOM. THANK YOU VERY MUCH, COUNCIL, THIS MORNING. DAVID SCHWART FOR THE RECORD.

>> WE ARE IN THE PUBLIC COMMENT PERIOD.

ONE THING THAT IS FACTUAL IS WE WILL HAVE OUR BUDGET WORKSHOP ON THE 26TH DAY OF FEBRUARY WHICH IS 2 WEEKS FROM TOMORROW. ONE OF THE ITEMS WILL BE A CONVERSATION ABOUT FIRE AND FIRE PROTECTION.

[00:50:02]

THAT WORKSHOP IS REALLY DESIGNED TO HAVE A PUBLIC CONVERSATION ABOUT SETTING THE TABLE FOR POSSIBLE ACTIONS IN OUR WORKSHOP WHICH WILL OCCUR -- OUR BUDGET WORKSHOP

WILL OCCUR IN JULY. >> THAT'S CORRECT, MAYOR.

I DO WANT TO SAY THAT I DO NOT BELIEVE THE FIRE CHIEF IS AFRAID TO BRING UP HIS CONCERNS ABOUT SPENDING MONEY ON PUBLIC SAFETY, AS YOU SHOULD BE DOING.

I DON'T BELIEVE WE HAVE ANY CONCERNS WITH THE DOWNTOWN FIRE PROTECTION AT THIS POINT IN TIME.

ANY STATION DISCUSSION WE WILL HAVE AS PART OF THIS RETREAT

WOULD BE FOR FURTHER. >> THE CITY HAS A HIGH RATING AND WE WILL TALK MORE ABOUT THAT.

AND BY THE WAY, BRIARWOO D IS FEELING GOOD ABOUT THE 2-CENT TAX RATE. WE ARE IN THE PUBLIC COMMENT PERIOD. ANYBODY ELSE WANT TO PARTICIPATE IN THE PUBLIC COMMENT PERIOD?

>> GOOD MORNING. >> GOOD MORNING.

>> I AM JACK RICH, CHAIR OF THE DCOA.

I AM JUST COME PLEAT -- COMPLETING MY FIRST YEAR AND THINKING OF THIS AS A ONE-YEAR UPDATE.

I WANT TO THANK THE MAYOR AND THE CITY COUNCIL FOR YOUR SUPPORT AND FOR THE WORK THAT YOU DO AFTER A YEAR I UNDERSTAND WHAT YOU GO THROUGH AND I APPRECIATE THAT.

THE DCOA HAS HAD A BUSY YEAR IN 2020.

IN THE COLLECTIVE FIVE YEARS PRIOR TO 2020 THERE WERE JUST 20 PROJECTS THAT HAD BEEN APPROVED IN TOTAL.

LAST YEAR WE HAD 24. IT WAS IN THE MIDST OF A PANDEMIC AND AN ECONOMIC RECESSION.

FURTHER I AM PLEASED THAT THE FACT THAT THE DCOA WAS ABLE TO REALIGN ITS STRUCTURE AND PRODUCE MEASURABLE AGREEMENTS WITH ALL DCOA PARTNERS. I WANT TO EMPHASIZE THE WORD "MEASURABLE AGREEMENTS." THAT'S SOMETHING I DIDN'T FEEL LIKE WE HAD BEFORE. WE NOW HAVE A WAY TO SAY, OKAY, IF WE ARE GOING TO INVEST, WHAT CAN WE EXPECT? OTHERS HAVE TAKEN NOTICE. THE STATE OF TEXAS HAS RECOGNIZED THE DCOA AS AN ECONOMIC DEVELOPMENT LEADER.

THEY RECEIVED THE TEXAS ECONOMIC DEVELOPMENT COUNCIL'S 2020 ECONOMIC EXCELLENCE RECOGNITION AWARD.

AND THERE IS A COMMUNITY ECONOMIC DEVELOPMENT AWARD.

AS CHAIR I AM COMMITTED TO ENSURE DCOA'S FISCAL RESPONSIBILITY. IN THIS EFFORT WE ARE REVIEWING OUR EXPENSE POLICY AS PART OF THE CONTINUED COMMITMENT IN THAT ROLE. I FORMED A COMMITTEE WITH FLOYD MILLER AND MYSELF TO REVIEW AND COMMENT ON THE POLICY AND WHERE APPROPRIATE RECOMMEND CHANGES.

WE WERE PLANNING TO REVIEW THE FINISHED POLICY WITH THE FULL BOARD ON FEBRUARY 24TH. BUILDING RELATIONSHIPS ARE CRITICAL AND A KEY COMPONENT OF OUR STRATEGIC PLAN.

OUR MISSION IS TO INCREASE CAPITAL INVESTMENT AND JOBS FOR ABILENE AND INCREASE THE COMMERCIAL TAX BASE BY RECRUITING AND/OR ATTAINING COMPANIES.

IT IS THE RELATIONSHIP BUILDING WE ARE GROWING EXISTING BUSINESSES WHILE ATTRACTING NEW BUSINESSES TO THIS GREAT CITY. AS THE APPEAL OF TEXAS GROWS NATIONWIDE, ECONOMIC DEVELOPMENT HAS BECOME A HIGHLY COMPETITIVE INDUSTRY, AND WE ARE ACTIVELY PURSUING COMPANIES TO PLANT DEEP ROOTS HERE IN ABILENE.

AT THE SAME TIME, WE WANT TO GROW THE BUSINESSES THAT WE HAVE HERE. OUR GOAL IS TO KEEP ABILENE COMPETITIVE. IF WE ARE NOT COMPETITIVE IN BUILDING RELATIONSHIPS, WE LOSE OPPORTUNITIES AND WE WILL BE SUBJECT TO COMPETITORS COMING INTO THIS COMMUNITY.

I THINK IT IS IMPORTANT FOR US TO EXPAND OUR COMMUNICATION TO THE COMMUNITY WITH YOUR HELP THIS COUNCIL OUR HOPE AND GOAL IS THAT THE COMMUNITY CAN RECOGNIZE AND APPRECIATE THE VALUE OF A STRONG AND AGGRESSIVE ECONOMIC DEVELOPMENT EFFORT. THANK YOU.

>> YOU KNOW, ANYONE ELSE WANT TO SPEAK ON THE PUBLIC COMMENT PERIOD? SEEING NONE I WILL CLOSE THE PUBLIC COMMENT PERIOD. WE WILL NOT HAVE AN EXECUTIVE SESSION ON THIS MORNING. SO IT IS NOW 9:25, COUNCILMAN RENTZ. AND THIS MEETING OF YOUR ABILENE CITY COUNCIL IS OFFICIALLY ADJOURNED.
