SO I KNOW THAT ITEM IS ABOUT FUNDING FOR THE CITY.

BUT LIKE I SAID AND PREVIOUSLY, THERE'S A CHANCE THE FEDS MAY COME BACK ON YOU AND SAY THAT THERE'S A POSSIBILITY THAT YOU WILL NOT GET FUNDING, UNLESS YOU DO THE SHOTS.

SINCE A JUDGE HAS RULED IT, I KNOW SEVERAL COMMENTS HAVE SAID IT IN THE 14TH AMENDMENT. IT WOULD PROBABLY BE UNCONSTITUTIONAL. AS FAR AS PUBLIC COMMENTS, THIS TUESDAY THE 7TH OF DECEMBER WILL BE THE 80TH ANNIVERSARY OF THE ATTACK ON PEARL HARBOR. A LOT OF YOUNG PEOPLE DON'T REMEMBER THIS OR DON'T EVEN THINK ABOUT IT.

IT'S VERY IMPORTANT PART OF OUR HISTORY.

THAT DAY THERE WAS 2,403 PEOPLE KILLED, CIVILIAN AND MILITARY.

OF THAT 1,177 ARE ON THE ARIZONA BATTLESHIP ALONE.

A LOT OF PEOPLE TAKE THINGS FOR GRANTED NOWADAYS.

ONE IS THE LIST OF THE CITIES THAT HAVE PASSED AN ORDINANCE ALLOWING ABORTION IN THE UNITED STATES, EFFECTIVE TUESDAY, NOVEMBER 30TH, 2021. AS YOU KNOW, YESTERDAY THERE WAS A HISTORICAL ARGUMENT REGARDING THE CASE OF DOBB VERSUS JACKSON'S W WOMEN'S HEALTH ORGANIZATION.

BUT TODAY I'D LIKE TO SHARE WITH YOU SOME FREQUENTLY ASKED QUESTIONS ABOUT THE ORDINANCE. SO YOU HAVE THOSE IN FRONT OF YOU. BUT I WANT TO READ THEM AND SHARE JUST A FEW OF THEM. THE FIRST ONE SAYS WE DON'T NEED

THE SANCTUARY CITY ORDINANCE FOR THE UNBORN, WHEN TEXAS JUST PASSED THE HEARTBEAT BILL. NOW WE KNOW THAT'S FALSE.

THE HEARTBEAT BILL ONLY COVERS AND PROTECTS THE CHILD AT THE POINT THE HEARTBEAT IS DETECTED, WHICH IS ABOUT SIX WEEKS.

SO THIS BILL DOESN'T PROTECT THE CHILD FROM CONCEPTION TO SIX WEEKS. AS YOU MAY OR MAY NOT KNOW, THE HEARTBEAT BILL IS IN A COURT BATTLE AND STILL NOT OFFICIALLY IN THE BOOKS. SO IT'S EVEN ALL THE MORE REASON THAT WE PASS THE ORDINANCE AS SOON AS POSSIBLE.

ANOTHER CONCERN IS THE ORDINANCE WILL COST THE CITY TAXPAYERS' DOLLARS. THAT ANSWER IS FALSE.

JONATHAN F. MITCHELL, THE FORMER SOLICITOR GENERAL OF TEXAS, HAS AGREED TO REPRESENT THE CITY OF ABILENE FOR THE F.C.U.

ORDINANCE, WHICH WILL BE PROVIDED BY MARK LEE DIXSON.

FURTHER NORTH, HE'S AGREED TO DO THAT AT NO COST TO THE CITY AND TAXPAYERS. HOWEVER, CITY LEADERSHIP HAS THE AUTHORITY TO REJECT THIS OFFER. ANOTHER ISSUE IS A WOMAN'S LIFE WILL NOT BE PROTECTED BY THIS ORDINANCE, WHICH IS FALSE.

THE LANGUAGE IS CLEAR IN THE ORDINANCE, THAT IF THE MOTHER IS IN DANGER OF LOSING HER LIFE, SHE WILL BE PROTECTED.

FURTHERMORE, NO LAWSUIT ACCORDING TO THE ORDINANCE CAN BE FILED AGAINST THE MOTHER, EVEN AFTER ABORTION.

IT'S IMPORTANT TO NOTE THAT THERE WILL BE EXTREME SENSITIVITY SHOWN ESPECIALLY TO THOSE WHO HAVE ALREADY HAVE HAD AN ABORTION. ANOTHER ISSUE WITH THIS IS ABOUT A WOMAN'S HEALTH CARE. FALSE.

TO BE CLEAR, ABORTION IS NOT HEALTH CARE.

WOMEN WHO HAVE HAD AN ABORTION ARE 30% TO 40% MORE LIKELY TO HAVE BREAST CANCER. THEY HAVE A 36% GREATER CHANCE OF PRE-BIRTHS AND 81% CHANCE OF HAVING MENTAL HEALTH PROBLEMS. THANK YOU FOR THIS OPPORTUNITY. HAVE A GREAT DAY.

IT'S WITH A GREAT PLEASURE, DON'T GET TO SAY THAT VERY OFTEN, THAT I GET TO COME BEFORE THE COUNCIL AND TALK ABOUT A PROJECT THAT IS SUCCESSFULLY COMPLETED.

I'LL SPARE A LOT OF THE DETAILS ABOUT -- I'M GOING THE WRONG

>> ANYWAY. I'LL SPARE YOU A LOT OF THE DETAILS ABOUT TWO YEARS WORTH OF PROJECT INFORMATION AND A LOT OF SUCCESSES AND A FEW PROBLEMS. AND JUST MOVE TO REALLY THE THINGS THAT I BELIEVE ARE THE MOST IMPORTANT ABOUT THIS PROJECT. FINANCIALLY THIS PROJECT HAD A BUDGET OF $16.89 MILLION, THAT WAS ALLOCATED THROUGH THE TEXAS WATER DEVELOPMENT BOARD FOR ALL OF THE COSTS ASSOCIATED WITH THE A.M.I. METER REPLACEMENT PROJECT.

WE HAVE NOW SUCCESSFULLY COMPLETED THAT PROJECT.

AND RIGHT NOW THE COST OF THE PROJECT IS $15.74 MILLION.

IT IS $1.15 MILLION LESS THAN THE BUDGET FOR THE PROJECT.

AND THAT'S ALWAYS GOOD TO COME IN UNDER BUDGET.

YOU'LL ALSO RECALL THAT WE DID BORROW FROM THE TEXAS WATER DEVELOPMENT BOARD, THE WATER FUND.

$18.37 MILLION. THAT'S WHAT WE ORIGINALLY THOUGHT IT WOULD TAKE TO DO A PROJECT OF THIS SIZE.

THE RESIDUAL OF THAT, WHEN YOU TAKE THE PROJECT OUT OF THAT, IT MEANS THAT WE HAVE $2.63 MILLION OF BALANCE LEFT, OUT OF THAT ORIGINAL LOAN THAT WE CAN FIND SOME OTHER WORTHWHILE PROJECT TO ALLOCATE THOSE FUNDS TO. AND, YOU KNOW THAT WE HAVE A LONG LIST OF NEEDS OUT THERE. THAT MONEY WILL HAVE TO BE SPENT SPECIFICALLY ON PROJECTS THAT FIT WITHIN THE CLEAN WATER PARAMETERS. FROM A SCHEDULING PERSPECTIVE, YOU RECALL WE REALLY STARTED TALKING ABOUT THE CONCEPT OF A SMART METER PROJECT AND AN AMISYSTEM WHERE WE COULD READ REMOTELILY OUR WATER METERS AND HAVE A GOOD HISTORICAL RECORD OF CONSUMPTION. THAT WAS A BIG ISSUE BACK IN 2016 WITH OUR CITIZENS SO JUST DEMONSTRATING THAT THIS PROJECT WAS EXPECTED TO TAKE ABOUT TWO YEARS.

WE HAD AN ORIGINAL SCHEDULE THAT WOULD HAVE COMPLETED IT BACK IN JUNE. THERE WERE SOME ISSUES THAT CAME UP ALONG THE WAY. WE DID A CHANGE ORDER TO MOVE THAT PROJECT TO FINAL COMPLETION IN NOVEMBER 30TH OF THIS YEAR.

AND SO WE STILL FINISHED WITHIN THAT TWO YEARS.

WE JUST STARTED A LITTLE BIT LATER.

AND THAT PUSHED US A LITTLE BIT LATER ON COMPLETING IT ON TIME.

BUT WE ARE SUCCESSFULLY COMPLETE.

PART OF THE DISCUSSIONS THAT WE HAD, PREVIOUSLY ABOUT THIS PROJECT ESPECIALLY IN CONCEPT OF THE IDEA THAT THIS PROJECT COULD, IN FACT, PAY FOR ITSELF. THE COLUMN LISTED UNDER "PLANNED" IS THE INFORMATION THAT WE PRESENTED TO YOU ORIGINALLY ABOUT WHAT WE BELIEVED WE COULD GET THROUGH A PROJECTED ACTUAL ANNUAL SAVINGS AND COST AVOIDANCE, THAT WOULD PAY FOR THE DEBT SERVICES ASSOCIATED WITH BORROWING THE $18.37 MILLION. THAT WAS ESTIMATED AT $985,000 ANNUALLY, THAT THE PROJECT WOULD SAVE US.

AS PART OF THIS PROJECT AND WE'LL TALK ABOUT THIS ON THE NEXT SLIDE, WE DETERMINED THAT THE 3%, THAT WAS A VERY CONSERVATIVE NUMBER MOVING IN, HAS BEEN VERIFIED TO BE AT LEAST 4.5%. SO THAT IS -- IT'S A SIGNIFICANT IMPROVEMENT. SO WHAT WE THOUGHT WOULD BE A TOTAL OF 1 POINT -- OR $985,000 IS GOING TO BE AT LEAST $1.28 MILLION. AND THAT COVERS THE 1.1 APPROXIMATELY MILLION DOLLARS OF THE DEBT SERVICE.

AND AGAIN IN MY OPINION, THAT $1.28 MILLION IS STILL A VERY CONSERVATIVE NUMBER. SO WE BELIEVE THAT WE HAVE ACCOMPLISHED WHAT WE SOLD YOU AT THE FRONT END OF THIS PROJECT, AS FAR AS IT PAYING FOR ITSELF. SO WHAT WAS THE BENEFIT OF THIS PROJECT WAS WE GOT MORE ACCURATE METER READS.

WE'VE GOT INFORMATION INTO OUR CUSTOMERS' HANDS THROUGH OUR CUSTOMER PORTAL. WE HAVE THE ABILITY TO IDENTIFY LEAKS EARLIER AND ADDRESS THOSE. SO EACH ONE OF THOSE THINGS HAVE A SIGNIFICANT BENEFIT TO THE UTILITY AND TO THE CUSTOMER EXPERIENCE. PART OF THIS PROJECT WAS, AT LEAST IN THE CONCEPT, WAS TRYING TO IDENTIFY WHAT THAT POTENTIAL

SAVINGS WAS. AND WHAT WE FOUND OUT IS LOTS OF PEOPLE HAD A LOT OF STORIES OF SUCCESS WITH THIS.

BUT WHEN YOU CHALLENGED THEM, HOW DO YOU KNOW OR PROVIDE US THE DATA. EVERYBODY BACK PEDALED.

WELL, WE'RE ASSUMING. WELL, WE CHOSE NOT TO ASSUME THE SUCCESS OF OUR PROJECT. AND WE ENGAGED A PROFESSOR, MR. COUNCILMAN -- TIM KENNEDY. HE DEVELOPED A PROJECT THAT WENT ALONG WITH THIS, WHERE WE VERIFIED THE ACCURACY OF THE OLD METERS THAT WE PULLED OUT. WE TESTED THE ACCURACY OF THE NEW METERS THAT WE PUT IN, EVEN THOUGH THEY TESTED THEM AT THE FACTORY. WE RETESTED THEM.

AND THEN COMPARED THE DIFFERENCE BETWEEN THE TWO.

AND THAT'S WHERE WE CAME UP WITH THAT 4.5%, WAS VERIFIABLE STATISTICALLY SAVINGS FOR THE CITY OF ABILENE.

THAT NUMBER REALISTICALLY, THE NUMBER WE SHOWED WAS 94.6% IS A VERY CONSERVATIVE NUMBER. THERE WERE SOME VALUES THAT WERE OUTSIDE OF WHAT WE WANT TO SAY IS STATISTICALLY USEABLE INFORMATION, THAT SKEWED THE INFORMATION.

SO THAT 94.6% IS A VERY FIRM AND STRONG NUMBER, WE BELIEVE IT'S CONSERVATIVE BUT COULD BE CLOSER TO 90%.

WE EXPECT TO SEE REAL SAVINGS MOVING FORWARD ON THIS PROJECT.

WE BELIEVE IN TIME THAT WE WILL BE ABLE TO DEMONSTRATE THAT.

IT'S VERY EARLY IN THE PROJECT RIGHT NOW.

THE CITY OF ABILENE IS CONTINUING TO WORK ON INFILL DEVELOPMENT THROUGH A NUMBER OF PROGRAMS AND OPPORTUNITIES.

INFILL DEVELOPMENT OR REDEVELOPMENT WAS IDENTIFIED AS A KEY COMPONENT IN THE 2014 COMPREHENSIVE PLAN AND A KEY COMPONENT IN THE 2021 PLAN AS WELL.

WE ATTACHED A WHITE PAPER TO UNDERSTANDING WHAT THE PLANNING STAFF HAVE DONE IN RELATION TO THE TRIP TO THE CITY OF DENNISON TO LOOK AT THE OPPORTUNITIES THEY DID FOR INFILL DEVELOPMENT.

WHAT'S BEFORE YOU TODAY IS THE CREATION OF ANOTHER EMPOWERMENT ZONE OVER THE SEARS NEIGHBORHOOD AND THE CARVER NEIGHBORHOOD.

TO LEVERAGE THE EMPOWERMENT ZONE CONCEPT, THAT'S ALLOWED UNDER STATE STATUTE. EXPANDED A LITTLE BIT ABOUT THE LEVERAGE OF THE CHAPTER 3 ECONOMIC DEVELOPMENT OPPORTUNITIES, TO ASSIST THE PRIVATE SECTOR IN REINVESTING IN OUR HISTORIC NEIGHBORHOODS. IT WILL REQUIRE PEOPLE TO MAINTAIN THINGS WE'VE NOT NECESSARILY LOOKED AT IN THE PAST.

I WOULD ANTICIPATE THE NEXT FISCAL YEAR IDENTIFYING MONEYS TO HELP FUND THIS PROGRAM TO HELP FUND PERS -- INCENTIVES.

SO WE CAN USE FOR ADVERTISING AND MARKETING PURPOSES.

DURING THAT TIME, BETWEEN NOW THE ADOPTION OF THIS AND THE NEXT BUDGET HEARINGS FOR FISCAL YEAR '23, I WOULD RECOMMEND THAT WE ENGAGE THE BUSINESS COMMUNITY, THE HOME BUILDERS' COMMUNITY TO MARKET THIS COMMUNITY TO GENERATE INTEREST IN 2. MAYOR, YOU AND I HAVE TALKED ABOUT VISITING LOCAL BANKS TO CREATE FAVORABLE LOAN CONDITIONS IN DEPRESSED MARKETS. EXPLORE THOSE OPPORTUNITIES.

SO IN DETAIL, THE EMPOWERMENT ZONE WOULD CREATE RESIDENTIAL AND COMMERCIAL INCENTIVES THAT ARE FAMILIAR WITH WHAT WE'RE DOING RIGHT NOW WITH THE EMPOWERMENT ZONE NUMBER 1.

THE ADDITION TO THIS WOULD BE A RESIDENTIAL INCENTIVE STRUCTURE.

AND THE INTENT OF THIS WOULD BE TO -- IF YOU HAD A PROPERTY THAT WAS VALUED AT $50,000 IN ONE OF THESE EXISTING NEIGHBORHOODS AND, EITHER THE EXISTING HOME OR YOU'RE A PRIVATE INVESTOR WANTING TO REMODEL, REHAB THIS HOME, YOU PUT ANOTHER $100,000 IN IT. AND IT CREATED -- LET'S SAY IT CREATED ANOTHER $100,000 IN TAXABLE VALUE.

YOU WOULD TAKE THE END OF THE YEAR, WHEN THE APPRAISED VALUE HITS THE TAX ROLLS. WE LOOK AT THAT, OKAY, YOU'RE NOW ELIGIBLE FOR AN INCENTIVE PAYMENT FOR THE INCREASED TAXABLE VALUE YOU HAVE CREATED, UP TO A MAXIMUM SEPTEMBER OF $5,000. -- INCENTIVE OF $5,000.

MLTIPLIED BY A FACTOR OF TEN, CAPPED AT $5,000.

IT'S BASED UPON THE TAXABLE VALUE CREATED BY THAT INDIVIDUAL. THE INTENT OF THIS AGAIN IS TO INCENTIVIZE THE PRIVATE SECTOR TO MAKE INVESTMENTS IN OUR COMMUNITY THAT HAVEN'T EVEN REHABILITATION ON HOMES, THAT NEED A LITTLE TLC. 24 CREATES A MARKET INCENTIVE FOR THE PRIVATE SECTOR AND ALSO FOR THE TAXPAYER, WHO IS FOOTING THE BILL. IF WE CAN INCREASE OUR APHRASED VALUES ACROSS THE -- ACROSS THE WHOLE COMMUNITY, RIGHT, THAT INCREASES OUR TAXABLE VALUE. IT DRIVES OUR TAX RATE DOWN, ESPECIALLY UNDER THE NEW TAX RATE CALCULATIONS ESTABLISHED BY THE LEGISLATURE. THAT INCREASED VALUE IS GOING TO FORCE THE RATE DOWN. IT'S GOING TO BE GOOD FOR THE COMMUNITY IN THAT FUNCTION. THIS WOULD TAKE EFFECT IMMEDIATELY, BUT I WOULD WANT TO MAKE SURE THAT WE SPEND TIME EDUCATING THE BUSINESS COMMUNITY, INFORMING THE CITIZENS OF THIS TOOL NOW AVAILABLE TO THEM FOR THE FISCAL YEAR -- BEFORE THE NEXT BUDGET DISCUSSION, SO WE CAN ADEQUATELY PREPARE FOR THIS AND HAVE AN UNDERSTANDING OF HOW MUCH SEED FUNDING MIGHT BE NEEDED. THE "A" STUDY LOOKED AT WAYS TO INCENTIVIZE THE PRIVATE SECTOR TO INVEST IN OUR COMMUNITY. THE COUNCIL HAS SIX OBJECTIVES ANNUALLY. NUMBER ONE IS INFILL OR REDEVELOPMENT. AND, BY THE WAY, IN RECENT YEARS HAVE BEEN VERY, VERY SUCCESSFUL. IF YOU LOOK AROUND THE DOWNTOWN AREA AND THEN THE PERIMETER OF THE DOWNTOWN, AND SO WHAT THIS DOES IS ANOTHER OPPORTUNITY FOR US TO DOUBLE DOWN AND WORK WITH THE PRIVATE SECTOR, IN THE VARIOUS DIFFERENT WAYS, HAVING VARIOUS TOOLS TO INCENTIVIZE THE PRIVATE SECTOR.

ACKNOWLEDGING THIS WHOLE CONVERSATION HAS ALL KINDS OF MINEFIELDS. WE WENT THROUGH NEIGHBORHOODS THAT HAD HISTORICALLY BEEN PRETTY RUN DOWN AND HAD BEEN COMPLETELY TRANSFORMED WITH NEW CONSTRUCTION, WHICH INCENTIVIZED THE NEIGHBORS TO START RAISING THE LEVEL OF CARE OF THEIR HOMES AND COMPLETELY CHANGED THE FACE OF THE NEIGHBORHOODS. I CAN TELL YOU THAT IN MY CONVERSATIONS WITH SOME LOCAL REALTORS, THAT ONE OF THE AREAS OF TOWN, YOU KNOW, EVERYBODY KNOWS WHAT'S HAPPENING TO THE HOUSING MARKET RIGHT NOW. BUT ONE OF THE THINGS THAT IS HAPPENING, AS A RESULT OF THE HOUSING BOOM, IS WE HAVE A -- I BELIEVE WE HAVE A SIGNIFICANT SEGMENT OF OUR POPULATION THAT IS IN DANGER OF BEING LEFT BEHIND.

WE NEED TO FOCUS ON IT. I'VE HAD SEVERAL REALTORS TELL ME WE DON'T -- WE DON'T NEED ANY, YOU KNOW, THE CONSTRUCTION IS TAKING PLACE IN THE LARGER HOMES IT'S GREAT.

BUT THERE'S AN ENTIRE MARKET SEGMENT THAT COULD -- INSTEAD OF BUYING A $300,000 HOME, COULD BUY A $100,000 FOR BRAND-NEW CONSTRUCTION. BUT THEY'RE NOT THERE.

NOBODY IS BUILDING THEM. SO THESE KIND OF INCENTIVE PROGRAMS IS WHAT INCENTIVIZES THOSE BUILDERS TO GO AFTER LOWER-MARGIN BUILDS AND STILL MAKE A FAIR PROFIT.

AND ALLOW PEOPLE TO ENGAGE IN THE NUMBER ONE PREDICTER OF WEALTH, WHICH IS HOME OWNERSHIP. AND THAT'S THE PURPOSE OF THIS.

WE HAVE TO BE INCREDIBLY CAREFUL AS WE'RE DOING IT, TO TRY NOT TO LEAVE BEHIND OUR MOST VULNERABLE NEIGHBORS.

HAVING SAID THAT I CAN'T TELL YOU HOW EXCITED I AM ABOUT THIS PLAN. THIS IS AN INCREDIBLE PLAN.
