COUNCIL MEMBER ALBUS HAS A GOOD REMINDER.

WE APPRECIATE THAT.

26 WE HAVE WITH US -- AND HE IS A -- GOES TO MARTICE LEMENTRY.

HE IS A -- ELEMENTARY.

HE IS A KINDERGARTNER AND THEN WE HAVE A MORE SEASONED PLEDGER WITH US, A 29 FOURTH GRADER.

AND HIS MOTHER, ERIKA, IS HERE.

I THINK SHE IS PRETTY PROUD.

AND DEBORAH STUART IS HERE.

THIS IS YOUR SECOND YEAR, DEBORAH? 34 FROM ODESA?

>> YES.

>> THIRD.

OH, SHE IS SEASONED ALSO.

THEY'LL DO THE PLEDGE FOR US THIS MORNING.

TURN AROUND, GENTLEMEN.

AND DO THE PLEDGES FOR US.

WE DO HAVE A COUPLE SERVICE AWARDS.

I'M GOING TO GO AHEAD IF YOU'LL JOIN ME WITH THOSE TWO SERVICE AWARDS.

>> MAYOR, THANK YOU FOR LETTING ME JOIN YOU FOR THIS.

LET'S GET BRIAN TRAIL UP HERE.

ALL RIGHT.

MR. TRAIL, FOR 25 YEARS OF SERVICE.

BRIAN JOINED THE CITY OF ABILENE IN FEBRUARY OF 1994 AS A PUBLIC SAFETY 54 DISPATCHER.

OCTOBER OF 1998 HE BEGAN THE POLICE ACADEMY WITH CLASS 39.

AND UPON THE COMPLETION OF THE ACADEMY, HE WAS ASSIGNED TO THE PATROL 57 DIVISION FOR HIS FIRST TWO YEARS.

IN 2001, HE TRANSFERRED TO CRIMINAL INVESTIGATIONS.

HE WAS ASSIGNED TO CRIMES AGAINST PERSONS AND WORKING AGAINST CHILDREN'S CASES.

IN JUNE 2009 -- 2008, BRIAN TRANSFERRED TO TRAFFIC DIVISION AND WAS ASSIGNED 61 TO THE MOTOR UNITS IN SEPTEMBER 2010.

AND TODAY WE CONGRATULATE BRIAN FOR 25 YEARS OF SERVICE TO THE CITY OF 63 ABILENE.

I HAVE ONE QUESTION FOR BRIAN.

WHICH IS MORE DIFFICULT? 66 BEING A POLICE OFFICER OR DISPATCHER? 67 68 WE THANK YOU FOR YOUR SERVICE.

>> WE WANT TO JOIN IN WITH OUR CITY MANAGER AND SAY THANK YOU FOR YOUR SERVICE

[00:05:12]

TO THIS COMMUNITY.

I APPRECIATE ALL THAT YOU HAVE DONE AND IF YOU CHOOSE TO RECOGNIZE ANYONE.

>> (OFF MIC).

>> LET'S GIVE HER A ROUND OF APPLAUSE.

76 AN ENVELOPE THAT JUST COMMUNICATES IN A SMALL WAY OUR APPRECIATION FOR YOU.

>>> ALL RIGHT.

TWYLIA WALDON.

THERE SHE IS.

HOW ARE YOU?

>> I'M FINE, THANKS.

>> TWYLIA WALDON'S 30 YEARS OF SERVICE.

TWYLIA WALDON WAS HIRED FEBRUARY 14 OF 1989 AS A DATA ENTRY OPERATOR.

SINCE MOST PAYMENTS CAME THROUGH THE MAIL, THIS WAS A BUSY POSITION.

IN 1994, HE WAS GIVEN -- SHE WAS PROMOTED TO CUSTOMER SERVICE REP 1 WHERE SHE 87 MANAGED WORK ORDERS.

THEN SHE WAS PROMOTED TO SERVICE REP 2 AND 3.

TWYLIA WALDON IS AN INCREDIBLE RESOURCE WORKER AND HAS AN IMPRESSIVE 90 ABILITY TO ASSIST CUSTOMERS ABOUT WATER USAGE.

SHE RECEIVED THE CITY MANAGER'S COIN FOR EXEMPLARY SERVICE.

HER PASSION IS EVIDENT EVERY DAY AND THE CITIZENS OF THE COMMUNITY ARE WELL SERVED 93 BY HER PRESENCE IN THE ORGANIZATION.

TODAY WE CONGRATULATE TWYLIA WALDON TO 30 YEARS OF SERVICE FOR THE CITY OF 95 ABILENE.

I CAN ATTEST.

I REGULAR RECEIVE PHONE CALLS ABOUT YOU AND THEY'RE NOT NEGATIVE.

THEY'RE ALL POSITIVE.

THANK YOU FOR YOUR SERVICE.

>> ALSO, I'M GOING TO ASK -- ON BEHALF OF THE CITY COUNCIL AND OUR 101 CITIZENS, THANK YOU.

A COUPLE THINGS, WE GO WAY BACK AND WORKED TOGETHER AT A FORMER EMPLOYER OVER 30 103 YEARS AGO.

SOME OF YOU MAY NOT KNOW, SHE IS ALSO A LOTTO WINNER.

>> MY HUSBAND AND MY MOM AND MY DAD.

HE IS NOT HERE BUT THEY HELPED ME WITH EVERYTHING.

AND ALSO MY BOSSES PRISCILLA AND RODNEY.

I LOVE WORKING FOR THE CITY.

>> THANK YOU FOR YOUR SERVICE.

AND AGAIN, A COIN, ANOTHER COIN FOR CITY MANAGER.

AND AN ENVELOPE OF OUR APPRECIATION.

>>> MAYOR, WITH YOUR PERMISSION I'D LIKE TO INVITE JAMES, OUR TRAFFICER 115 MANAGER TO TALK ABOUT THE AWARD THE CITY RECEIVED.

>> THANK YOU.

MR. MAYOR, IT'S MY PLEASURE TO REPRESENT THE CITY OF ABILENE WITH THE ITS TEXAS 118 AWARD.

WE WERE SUBMITTED BY OUR CONSULTANT FOR OUR TRAFFIC SERVICES PROJECT FOR 120 IMPROVING OUR TRAFFIC SIGNAL SYSTEM SIGNIFICANTLY OVER WHAT IT WAS 121 PREVIOUSLY.

IF YOU WOULD, I'D READ IT TO YOU.

THE INTELLIGENT TRANSPORTATION SOCIETY OF TEXAS HONORS THE CITY OF 124 ABILENE FOR THE ADVANCEMENT OF THE ITS PROGRAM AND UPGRADE PROJECT WHEREBY 125 THEY'RE IMPLEMENTING NEW EQUIPMENT AT 73 TRAFFIC SIGNALS THROUGHOUT MULTIPLE 126 DESIGN AND CONSTRUCTION CONTRACTS INCLUDING THE REPLACEMENT OF 26 LOCATIONS 127 DOWNTOWN CURRENTLY RUNNING LEGACY ELECTROMECHANICAL TIMERS.

WE'RE PRESENTED BY THE BOARD OF DIRECTORS AND MEMBERSHIP AT THE NOVEMBER 9, 2018 129 MEETING.

WE ARE ACTIVELY WORKING TOWARDS REMOVING TECHNOLOGY THAT WAS DESIGNED IN THE 131 1960S AND IMPLEMENT IT WITH MODERN 21ST CENTURY TECHNOLOGY.

SEVERAL OF MY CREW HAVE BEEN VERY ACTIVE IN THIS IN THE LAST 20 YEARS.

MIKE MATTHEWS IS KEY IN TRYING TO POINT OUT TO SPECIFIC THINGZ TO ME 134 THAT -- THINGS TO ME THAT NEED TO BE ADDRESSED SUCH AS THE ELECTROMECHANICAL

[CONSENT AGENDA]

CONTROLLERS DOWNTOWN.

THE MIDDLE GROUND BOXES PEOPLE WALK ACROSS THAT COULD POTENTIALLY BE

[00:10:04]

ELECTRIFIED CONSIDERING THEY'RE CARRYING THE WIRES THAT RUN THE TRAFFIC SIGNAL 138 SYSTEM.

IT'S VERY IMPORTANT FOR US TO BE MOVING FORWARD AND BEING ABLE TO BE PRO-ACTIVE 140 AND REACTIVE AND THIS SYSTEM ALLOWS US TO MONITO IT REMOTELY SO IF SOMETHING 141 HAPPENS, WE'RE ABLE TO PROACTIVELY WORK TOWARDS GETTING IT REPAIRED INSTEAD 142 OF WAITING FOR THE PUBLIC OR OUR POLICE FORCE TO IDENTIFY IT AND NOTIFY US.

>> ON BEHALF OF THE COUNSEL AND YOUR STAFF, AND THAT'S A GREAT SHIRT YOU HAVE ON 144 BY THE WAY.

>> THANK YOU, SIR.

[5.  Resolution: Receive a Report, Hold a Discussion and Take Action on the purchase of three Police Patrol Vehicles from Caldwell Country Chevrolet through Buyboard Cooperative (Chris Taylor)]

WE WILL PULL AGENDA ITEM NUMBER 15.

ALL ITEMS ARE LISTED ON TO THE AGENDA AND WILL BE CONSIDERED WITH ONE MOTION.

AND THERE WILL BE NO SEPARATE DISCUSSION UNLESS A COUNSEL MEMBER OR CITIZEN 150 REQUESTS SEVERATE DISCUSSION.

ANY COUNCIL MEMBER WANT TO PULL AN ITEM OUT FOR SPECIFIC CONSIDERATION?

>> .

>> 11, 12, 13.

>> DOES ANY CITIZEN WANT TO PULL AN AGENDA ITEM OUT?

>> 11 AND 12, MAYOR.

>> MAYOR WILLIAMS: MR. SWARTZ.

I'LL SUBMIT A CARD FOR 11 AND 12.

I'LL ACCEPT A MOTION FOR CONSENT AGENDA EXCEPT FOR ITEMS 11, 12, 13, AND THE 159 PULLED ITEM 15.

MOTION BY COUNCIL MEMBER HURT AND A SECOND BY COUNCIL MEMBER ALBUS.

ANY DISCUSSION? 162 WE'RE READY TO VOTE.

>> MAYOR PRO-TEM MCALISTER.

>> MR. MCALISTER: YES SHAP YES.

>> MS. ALBUS: YES.

>> MAYOR WILLIAMS: YES.

>> MOTION CARRIES.

>> ON 11 AND 12, THE COMBINED UNITS, I WANT TO CLARIFY -- I SENT IN A 169 QUESTION AND I'VE SEEN A FEW PEOPLE PONDERING THIS QUESTION ON FACEBOOK AS 170 WELL.

ON SOCIAL MEDIA.

THE HEIGHT OF THE TOWER, WILL THAT TRIGGER A REQUIREMENT FOR A 173 CONDITIONAL USE PERMIT IN ORDER FOR US TO INSTALL THE TOWER? 174 I WAS READING THE LAND DEVELOPMENT CODE AND IT SAYS THAT THE CONDITIONAL USE 175 PERMIT IS NOT REQUIRED IF IT DOESN'T EXCEED THE MAXIMUM HEIGHT FOR A ZONING 176 DISTRICT.

I WAS HAVING DIFFICULTY FINDING WHAT THE MAXIMUM HEIGHT IS IN GENERAL 178 COMMERCIAL.

>> WE ARE GOING THROUGH THE PNZ PROCESS WITH THIS.

I'D HAVE TO ASK ZACK OR MIKE ABOUT THE DETAILS OF THAT.

WE'RE TAKING IT THROUGH THAT, YES, SIR.

IT WILL GO THROUGH AS WELL AS THE AIRPORT ZONING AND REVIEW.

>> THE INTENT OF HAVING COUNSEL ORDER THIS NOW AND CONSTRUCTION WON'T TAKE 184 PLACE UNTIL PROPER PERMITS.

>> OKAY.

LIKE I SAID, I HAD THE QUESTION AND I SAW THERE WERE OTHERS IN THE PUBLIC 187 ASKING SIMILAR QUESTIONS.

>>> ITEM NUMBER 11.

THE DISCUSSION? 190 I'LL ASK FOR A MOTION.

I THINK YOU SAID 12.

>> 11 AND 12.

>> MAYOR WILLIAMS: SORRY.

GIVE YOUR NAME FOR THE RECORD.

[9.  Resolution: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on approving the Application/Permit to Drill and/or Operate an Oil and/or Gas well – Lakewood Operating, Ltd.: “Denson #1” Permit No. 845811, located at 3617 E. Industrial Blvd. (Greg McCaffery)]

>> GOOD MORNING, COUNCIL MEMBERS.

THE REASON I'M INTERESTED IN 11 AND 12, THE (INAUDIBLE) IS IN CHARGE OF THE 197 TRANSPORTATION DIVISION, I DON'T KNOW IF HE IS UNDER THE COMMUNICATION SYSTEM OR

[00:15:06]

WHAT AND I WAS JUST WANTING TO KNOW A BACKGROUND.

THE CONCERN ABOUT THE TOWER IS I JUST REVIEWED SOME OF THE SPECIFICATIONS AND 200 THERE IS NO SPECIFICATIONS ABOUT ANY ELECTRICAL.

AND THAT -- IT IS GOING TO BE 150 FEET AND THAT WOULD PROBABLY BE SIMILAR TO THE 202 WATER TOWERS AROUND TOWN.

SO I WAS WONDERING IF THERE WILL BE LIGHTING ON THAT.

IF YOU CAN COMPARE THE OLD CITY POLICE TOWER OUT BACK, IT'S THE OLD STYLE.

IT'S RED AND WHITE.

BUT I'M GUESSING IT'S ABOUT 100 BECAUSE THAT'S THE ONLY THING IN RADIO 207 COMMUNICATIONS I'M NOT GOOD AT, IS TOWER HEIGHT JUDGING.

I DID GO OUT TO KIRBY AND LOOK AT THE LINK TOWER AND I'M THINKING IT'S 180 BUT 209 IT IS RED AND WHITE AND THAT'S PROBABLY BECAUSE OF ABILENE REGIONAL AIRPORT 210 AND ALSO ABILENE REGIONAL HOSPITAL.

BUT IT'S ALSO -- ALSO SAYS IT DOESN'T SAY ANYTHING IN THERE ABOUT ADDITIONAL 212 ANTENNA WORK AND OF COURSE WHEN YOU'RE PUTTING UP A TOWER, THAT WOULD BE THE 213 BEST TIME TO PUT ANY ADDITIONAL ANTENNAS UP FOR THE 800 SYSTEM OR SUCH.

IT DOES SAY A WAVE GUIDE LADDER BUT IT DOESN'T SAY ANYTHING ABOUT ANY 215 ELECTRICAL.

MODERN DAY TOWERS, MOST HAVE STROBES ON THEM AND THEY STROBE 24 HOURS OR 217 SOMETIMES ON CELL TOWERS THEY GO TO A RED AT NIGHT AND THEY TURN TO RED AND 218 TURN OFF THE SCROLLS.

THAT'S MY MAIN CONCERN, IT'S 150 FOOT AND THERE IS NO PROVISION FOR ANY 220 ADDITIONAL ANTENNA WORK IF YOU'RE PUTTING UP A TOWER THAT WOULD BE THE GOOD TIME 221 TO PUT UP YOUR ANTENNAS OR ANY OTHER SYSTEMS OTHER THAN -- THE TWO MICROWAVE 222 LINK ANTENNAS ON THE NEXT ITEM.

THAT'S MY MAIN CONCERN.

LIKE I SAID, IT WOULD BE SIMILAR TO THE OLD POLICE RADIO TOWER OUT BACK EXCEPT 225 IT WON'T BE PAINTED OBVIOUSLY.

THAT'S THE ONLY CONCERNS I HAVE ON THAT.

THANK YOU VERY MUCH, COUNCIL.

>> MAYOR WILLIAMS: IS THERE CONVERSATION AND DISCUSSION ON THE ITEM?

>> YES, SIR.

IF I RECALL CORRECTLY, JERRY, THIS DOES HAVE OBSTRUCTION LIGHTS ON IT 231 ABOUT 40 FEET BELOW THE TOP OF THE TOWER.

IS THAT CORRECT? 233 ON THE NEW TOWER.

THIS IS JERRY WITH COMMUNICATIONS SERVICES.

>> MAYOR WILLIAMS: MORNING, JERRY.

>> MORNING.

FA A'S LIMIT IS 200 FOOT.

[10.  Resolution: Receive a Report, Hold a Discussion and Take Action on amending Street Maintenance Fee Trip Factor Indexes (Greg McCaffery)]

ANYTHING BELOW IS NOT NEEDED TO BE LIGHTED UNLESS IT MEETS CERTAIN STANDARDS 239 JUST TO THE AIRPORTS AND THINGS LIKE THAT.

THAT'S PART OF THE -- BEFORE THE TOWER GETS BUILT, ALL THAT WILL GET LOOKED AT.

ALL THE PRELIMINARY DEALS IS IT'S NOT GOING TO REQUIRE ANY LIGHTING SO THERE WON'T 242 BE ELECTRICITY GOING TO THE TOWER.

AND IT'S GALVANIZED SO IT DOESN'T NEED TO BE PAINTED.

>> IT'S FAIR TO SAY WE'LL COMPLY WITH THE LOCAL, STATE AND FEDERAL LAW.

>> MAYOR WILLIAMS: ANY QUESTIONS ON 11 OR 12?

>> MOVE TO APPROVE.

>> MAYOR WILLIAMS: ANY QUESTION ON 12?

>> ONCE AGAIN, WE'RE OKAY ON 12.

WE'RE TALKING ABOUT THE MICROWAVE LINK SYSTEM GOING FROM THE NEW POLICE STATION 250 WHICH WILL BE ATTACHED TO THIS TOWER.

THE ONLY THING I HAVE IS IT LISTED ON THE QUOTE, THERE IS TWO ANTENNAS.

SO IN THE OLD DAYS, WE WOULD USE AN AIR MAP AND WE WOULD DRAW A LINE FROM LAKE KIRBY 253 UP TO ABOUT THIRD AND OAK WHERE THE CURRENT SYSTEM IS.

THEN YOU'D DRAW ANOTHER LINE OVER FROM LAKE KIRBY OVER TO THE -- ABOUT FIRST AND 255 FINEAR.

THEN YOU'D SOMETHING SIMPLE AS A PROTRACTER AND GET THE ANGLE BECAUSE YOU'LL HAVE 257 TO PUT NEW ADDITIONAL ANTENNAS OUT AT THE TOWER SIDE AT LAKE KIRBY OR 258 YOU'LL HAVE TO MOVE THOSE OVER SO MANY DEGREES OVER TO CAPTURE THIS NEW 259 MICROWAVE SIGNAL.

OF COURSE IN THE OLD DAYS, WE DEALT WITH AIR MAPS AND STUFF NOW.

I'M SURE NOW THERE IS PHONE APPS AND GPS AND STUFF TO DO IT THAT WAY.

ON THAT TOWER -- ON THE MICROWAVE SYSTEM QUOTE IT DOESN'T SAY IF THERE IS 263 GOING TO BE ADDITIONAL ANTENNA WORK NEEDED OR USE ONE OF THOSE RECEIVER 264 ANTENNAS OR BOTH OF THEM AT THE NEW POLICE STATION.

AND THAT'S ONLY -- WHEN I WORKED AT MOBILE PHONE OF TEXAS, WE HAD A PIECE OF 266 ICE FALL FROM THE TOWER AND TOOK OUT OUR MICROWAVE DISH AND KNOCKED IT DOWN AND WE 267 LOST FOUR RADIO CHANNELS INSTANTLY ON THE MOBILE SYSTEM BACK IN THE LATE 268 1970S.

SO LIKE I SAY, I WENT OUT AND LOOKED AT THE TOWER AT LAKE KIRBY AND IT LOOKS

[00:20:03]

LIKE IT HAS FOUR DISHES ON IT.

BUT I COULDN'T TELL BECAUSE IT'S GETTING DARK, IF THE DECISIONS ARE 272 INSTALL -- DISHES ARE INSTALLED AND POINTED TOWARDS THE NEW LAW 273 ENFORCEMENT CENTER OR NOT.

[13.

Resolution: Receive a Report, Hold a Discussion and Take Action on authorizing a contract with ZENON Environmental Corporation for the Hamby WRF Expansion-Phase 1 (Rodney Taylor)

]

THAT'S ALL I HAVE ON THAT SYSTEM.

THANK YOU.

>> MAYOR WILLIAMS: ANY CONVERSATION OR DISCUSSION ON 12?

>> YES, SIR.

THIS IS A LINE OF SIGHT SYSTEM TO THE -- BETWEEN THE POLICE -- THE NEW 279 POLICE STATION AND THE KIRBY LAKE TOWER.

THAT HAS ALREADY -- ALREADY DONE THE MODELING ON THAT SO WE'RE GOOD WITH THAT.

THAT'S AGAIN ONE OF THE REASONS WHY IT'S JUSTIFYING 150-FOOT HEIGHT TOWER.

IT'S BECAUSE THE EXTRA HEIGHT NEEDED TO GET THE LINE OF SIGHT.

THAT IS TAKEN CARE OF.

WE HAVE -- AND I THINK THAT WAS PRETTY MUCH IT.

THE TOWER IS -- THE WAY THE TOWER IS CONSTRUCTED, WE DON'T HAVE AN ISSUE WITH 286 ICE BREAKING OFF THE TOWER AND HITTING THE MICROWAVE.

NOT EXPECTED ANYWAY ON A NORMAL FREEZING SITUATION.

>> I GUESS WHAT I WAS HEARING IS RIGHT NOW THE SIGNAL AT KIRBY IS POINTING 289 THIS WAY.

AND WHEN WE GO LIVE, IT WILL NEED TO POINT THAT WAY.

>> THAT'S PART OF THE CONTRACT.

TO MAKE THAT ADJUSTMENT.

AND THAT STUDY HAS ALREADY BEEN DONE TO -- TO THAT.

>> MAYOR WILLIAMS: ANY ADDITIONAL QUESTIONS FOR STAFF? 295 TAKE A MOTION FOR ITEM 11 AND 12.

>> SO MOVED.

>> MAYOR WILLIAMS: MOTION BY PRICE.

SECOND BY MAYOR PRO-TEM MCALISTER.

ANY FURTHER DISCUSSION? 300 READY TO VOTE.

>> MR. MCALISTER: YES.

>> MR. PRICE: YES.

>> MR. RENTZ: YES.

>> MS. ALBUS: YES.

>> MR. HURT: YES.

>> MAYOR WILLIAMS: YES.

>> MOTION CARRIES.

>>> ITEM 13.

AND I PULLED THIS -- WHEN YOU LOOK AT THE AGENDA, IT SAYS THE EDWARD BURN 310 MEMORIAL JUSTICE ASSISTANT GRANT AND THE PUBLIC MAY NOT BE AWARE OF WHAT THAT 311 MEANS.

AND I WANTED TO GIVE CHIEF FLORES AND CHIEF STANDARDS AN OPPORTUNITY TO TALK 313 ABOUT THIS NEW PROGRAM BECAUSE THIS ADDRESSES A NEED THAT'S BEEN PART OF A 314 COMMUNITY CONVERSATION FOR SEVERAL YEARS.

AND WE'RE IN A POSITION TO WHERE WE CAN START ADDRESSING THAT NEED IN A 316 BETTER WAY.

SO -- THAT'S WHY I PULLED THAT: THE ARROW TO THE RIGHT SHOULD MOVE IT 318 FORWARD.

THE PROGRAM ITSELF DEALS WITH MENTAL HEALTH.

PATIENTS IN THE COMMUNITY.

OBVIOUSLY WHAT THEY DON'T NEED IS GOING TO JAIL BECAUSE THERE IS NO 322 SERVICES THERE.

WHAT THIS GRANT WILL ALLOW THE BEHAVIORAL HEALTH TEAM TO DO IS TO IMPLEMENT THE 324 CRT TEAMS. 325 COMMUNITY RESPONSE TEAMS. 326 THEY WILL CONSIST OF A FIREFIGHTER, PARAMEDIC, A POLICE OFFICER, AND A 327 HEALTH SPECIALIST.

MENTAL HEALTH SPECIALIST.

AND THE GRANT WILL FUND TWO TEAMS WITH ALSO TWO SHIFTS SO ACTUALLY FOUR FULL 330 TEAMS. 331 THESE PEOPLE WILL BE ABLE TO RESPOND OUT AND HELP PEOPLE WHO ARE HAVING MENTAL 332 HEALTH CRISIS VERSUS JUST TAKING THEM TO JAIL OR THE HOSPITAL WHERE THEY DON'T 333 GET THAT CARE THAT THEY ACTUALLY NEED.

THE LEGAL SYSTEM IS OVERRUN WITH THESE TYPE OF PATIENTS AND THEY'RE NOT GETTING THE 335 RESOURCES THAT THEY NEED IN ABILENE.

SO THIS CONSORTIUM OF GROUPS THAT ARE FOCUSING ON MENTAL HEALTH ALONG WITH THE 337 GRAVES OWEN FOUNDATION, THE MEADOWS MENTAL HEALTH POLICY INSTITUTE, THEY HAVE 338 DONE QUITE A BIT OF WORK AS FAR AS LEADING US INTO THE NEXT STEP.

AND BEING RESOURCE FOR US.

WE'RE DOING A LOT WITH BETTY HARDWICK AND TOGETHER ALONG WITH TAYLOR COUNTY, WE ARE 341 LOOKING TO IMPLEMENT SOME TYPE OF ALTERNATIVE TO GOING TO JAIL.

WHAT IS IN THE GRANT ITSELF ALSO CALLS FOR TELEPSYCH WHICH IS A SERVICE THAT 343 WILL BE HANDLED AT THE JAIL TO WHERE SOMEONE CAN ACTUALLY REMOTE IN AND 344 EVALUATE SOMEONE BEFORE THEY GET PROCESSED SO THEY DON'T HAVE TO ACTUALLY

[00:25:01]

GATHER A RECORD OF GOING TO JAIL.

THEY CAN ACTUALLY BE PROCESSED BEFORE THEY ARE CHARGED AND FIND OUT THEY 347 DON'T NEED TO GO DOWN THE JAIL ROUTE AND ACTUALLY GO TO SOME TYPE OF MENTAL 348 HEALTHCARE ROUTE.

DOES THAT ANSWER?

>> YES.

LIKE I SAID, THIS IS A DISCUSSION IN THE COMMUNITY FOR A WHILE.

I KNOW OUR COUNCIL RETREAT A COUPLE YEARS AGO, THIS CAME UP AS SOMETHING THAT 353 COUNCIL WAS INTERESTED IN PURSUING AND I'M JUST -- EXCITED TO SEE US 354 BEING ABLE TO TAKE THE NEXT STEP AND ACTUALLY PUT THESE TEAMS IN THE FIELD AND HAVE 355 THE EQUIPMENT THEY NEED TO ADDRESS THIS GROWING CRISIS THAT WE HAVE NOT JUST IN 356 ABILENE BUT AROUND THE COUNTRY OF PEOPLE WITH MENTAL HEALTH ISSUES, JAIL 357 BEING THE ONLY RECOURSE THAT THE COMMUNITY HAS AND THAT'S NOT REALLY HELPING 358 THEM AND IT'S NOT HELPING THE COMMUNITY.

THIS WILL BE A BUG STEP -- POSITIVE STEP FORWARD AND I APPRECIATE 360 YOU AND CHIEF SANDERS AND YOUR LEADERSHIP TO HELP BRING THIS ABOUT.

HAVE THE TEAMS AVAILABLE.

>> CHIEF SANDERS IS REALLY THE ONE TO CHAMPION THIS AND HE'D BE UP HERE TALKING 363 FOR AN HOUR IF HE WAS HERE.

365 STEP IN GETTING TO THE TEAMS THAT WE NEED.

[14.

Financial Workshop: Discussion and possible action on the following items:

a. Resolution:  Review and Acceptance of FY 2018 Comprehensive Annual Financial Report - Eide Bailly LLP

b. Resolution: Amendment to Council Policy Statement 2015-001 Revenues Collected in Excess of Revised Budget

c. Resolution:  Approval of expenditure of funds in excess of the three month reserve

d. Resolution:  Approval of the Investment Policy

(Mike Rains)

]

SO.

>> MAYOR WILLIAMS: YOU KNOW, WE SEE -- THE AUDIENCE AND THE FOUNDATIONS REALLY HAVE 368 BEEN A TEAM EFFORT AS A COMMUNITY REALLY BRINGING THIS HOME AND ALLOWING US 369 TO DO A BETTER JOB AND NOT ONLY HERE IN ABILENE BUT THIS IS REALLY A STATEWIDE 370 INITIATIVE BY THE MEADOWS FOUNDATION.

IS THAT RIGHT, ROBERT?

>> WE PARTNER THROUGH THE ABILITY TO PARTNER WITH SOME OF OUR FOUNDATIONS AND OUR 373 HOSPITALS AND WE WORKED REALLY OVER THE LAST TWO YEARS TOWARDS THIS GOAL OF 374 HOW DO YOU DEAL WITH MENTAL HEALTH CONTACTS WITH THE POLICE DEPARTMENT WITHOUT 375 TAKING THEM TO JAIL.

AND IT'S NOT THAT THEY WANT TO GO TO JAIL.

BUT WE KNOW THEY'D GET THE ASSISTANCE THEY NEED BUT IT'S EXPENSIVE FOR THE 378 TAXPAYER.

IF THERE IS AN OPPORTUNITY TO DIVERT THEM FROM THE CRIMINAL JUSTICE SYSTEM AND 380 GET THEM IN TOUCH AND PROPER MENTAL HEALTHCARE, IT SAVES THE TAXPAYERS 381 MONEY AND DOESN'T CRIMINALIZE SOMETHING THAT REALLY SHOULDN'T BE 382 CRIMINALIZED.

IT'S ABOUT TREATING PEOPLE WITH DIGNITY AND RESPECT WHICH I THINK IS IMPORTANT.

THE MEADOWS FOUNDATION IS AN EXTREME HELP AND BETTY HARDWICK CENTER HAVE ALL 385 WORKED TOGETHER WITH THE CITY OF ABILENE TO GET THIS DONE.

AND CHIEF, NO JOKE AND NO KNOCK ON CHIEF FLORES BUT HE HAS REALLY HAS BEEN THE 387 CITY OF ABILENE'S PERSON BEHIND THE PUSH ON THIS.

I WANT TO SAY BECAUSE I THINK IT'S IMPORTANT TO RECOGNIZE WHO (INAUDIBLE) 389 IS.

THE PROGRAM IS NAMED -- THIS IS FROM WIKIPEDIA BUT IT'S NAMED FOR EDWARD BURN 391 KILLED IN NEW YORK CITY PROTECTING AN IMMIGRANT WITNESS WHO AGREED TO 392 TESTIFY AGAINST DRUG DEALERS.

SO PROBABLY VERY FITTING THIS IS NAMED AFTER HIM.

>> MAYOR WILLIAMS: QUESTIONS FOR CHIEF FLORES? 395 THANKS, CANDE.

>> MOVE FOR APPROVAL.

>> MAYOR WILLIAMS: MOTION BY PRICE AND A SECOND BY MS. ALBUS.

>> MR. MCALISTER: YES.

>> MR. PRICE: YES.

>> MR. RENTZ: YES.

>> MS. ALBUS: YES.

>> MR. HURT: YES.

>> MAYOR WILLIAMS: YES.

>> MOTION CARRIES.

>>> I SEE THE HOLDER FAMILY THAT IS WITH US.

ITEM -- AGENDA ITEM NUMBER 19 IS A BILL INTRODUCED BY ROSA LAMBERT.

IT RECOGNIZES 322 OUT OF THE LATE RODNEY HOLDER.

WE WANT TO RECOGNIZE YOU AND APPRECIATE RODNEY'S SERVICES TO THE COMMUNITY 409 AND YOUR CONTINUED COMMITMENT TO BE SURE THE LEGACY IS COMMUNICATED.

THANK YOU VERY MUCH.

GIVE THEM A ROUND OF APPLAUSE, EVERYBODY.

413 ITEM NUMBER 22.

I'LL ASK MIKE, DEVELOPMENT OF PLANNING AND SERVICES TO PRESENT THIS ITEM.

>> THANK YOU, MAYOR AND COUNCIL.

WHAT WE HAVE BEFORE YOU THIS MORNING IS A REQUEST TO REMOVE THE HISTORIC OVERLAY 417 ZONING DESIGNATION FOR A PIECE OF PROPERTY LOCATED AT 3434 SOUTH NINTH STREET.

THE APPLICANT IS ANDY ZIMMERMAN.

THE PLANNING COMMISSION HEARD THE REQUEST AT ITS JANUARY 8, 2019, MEETING.

AND THEY RECOMMENDED APPROVAL OF THE REQUEST AS DID THE LANDMARK'S

[00:30:05]

COMMISSION WHO MET BACK IN OCTOBER ON THIS REQUEST.

IN TERMS OF NOTIFICATION, WE DID SEND OUT NOTIFICATIONS TO ADJACENT PROPERTY 423 OWNERS.

OF THOSE NOTIFICATIONS, WE RECEIVED TWO BACK IN FAVOR AND ZERO IN OPPOSITION.

A LITTLE BIT ABOUT THE APPLICATION.

THIS PARTICULAR PIECE OF PROPERTY RECEIVED THE HISTORIC OVERLAY 427 DESIGNATION IN 2011.

THE PROPERTY OWNER AT THE TIME WAS SEEKING THE DESIGNATION TO PROVIDE SOME 429 PROTECTION TO THE PROPERTY IN TERMS OF WHAT CAN BE DONE IN TERMS OF 430 EXTERIOR-TYPE IMPROVEMENTS.

SINCE 2011, THE PROPERTY CHANGED HANDS MULTIPLE TIMES.

SUBSEQUENT OWNERS MADE CHANGES INCONSISTENT WITH THE GUIDELINES OF THE 433 HISTORIC OVERLAY PROGRAM.

AND AS A RESULT, THAT PROPERTY HAS DIMINISHED IN TERMS OF ITS HISTORIC -- IF 435 ANY HISTORIC SIGNIFICANCE THAT IT MAY HAVE HAD BACK IN 2011.

THE LOCATION MAP SHOWING SOUTH NOOUNTH STREET ON THE -- NINTH STREET ON THE 437 CORNER THERE.

HERE IS THE ZONING MAP.

PRIMARILY SINGLE FAMILY RESIDENTIAL.

EXISTING LAND USES.

THOROUGHFARE MAP.

FLOOD PLAIN MAP.

IT IS PARTIALLY IN THE FLOOD PLAIN.

TWO IN FAVOR AND ZERO IN OPPOSITION.

SOME PHOTOS OF THE PROPERTY OVER THE YEARS.

THIS WAS ORIGINALLY KNOWN AS THE JONES YOST HOUSE.

THIS IS CIRCA 1950.

THE PHOTO THERE ON THE LEFT IS PRIOR TO SOME CONSTRUCTION WORK DONE ON 449 THE RIGHT.

>> MAYOR WILLIAMS: THANK YOU.

QUESTIONS OF COUNCIL? 637 THANK YOU, MIKE.

THIS ITEM DOES CALL FOR A PUBLIC HEARING.

SO AT THIS TIME, I OPEN UP THE PUBLIC HEARING.

IS THERE ANYONE WHO WOULD LIKE TO SPEAK EITHER FOR OR AGAINST THIS ITEM? 641 IF SO, PLEASE GIVE YOUR NAME FOR THE RECORD.

>> GOOD MORNING.

MY NAME IS NORM ARCHIBALD.

I THINK I KNOW ALL YOU WELL.

IT'S MY HONOR TO BE IN FRONT OF YOU.

PERHAPS NO ONE IN THE AUDIENCE KNOWS MORE ABOUT THE APPRECIATION THAT I 647 HAVE FOR EACH OF YOU THAN MYSELF.

SO IT'S MY HONOR TO BE HERE TODAY.

THIS ITEM IS -- I'M REALLY TALKING ABOUT THE COMPANION ITEM AS WELL.

THE NEXT ITEM NUMBER 26 ON THE AGENDA.

THESE ARE TOGETHER.

[00:45:02]

IT'S ALL ABOUT THE LOCATION OF AN APARTMENT COMPLEX JUST SOUTH OF THE TEXAS 653 TECH HEALTH SCIENCE CENTER CAMPUS.

ONE OF THE THINGS I WANT TO DRAW YOUR ATTENTION TO BECAUSE I'VE BEEN SITTING 655 AND LISTENING TO ALL OF THESE THINGS OVER MANY YEARS, WHEN YOU SEE THIS 656 LAND WAS ANNEXED IN 1895.

SO WE'RE TALKING ABOUT SOME OF THE OLDEST PART OF OUR CITY THAT GOES WAY BACK.

EVEN TO THE POINT OF HARDIN SIMMONS BEING FOUNDED IN 1891.

THIS WAS NOT LONG AFTER.

THIS IS THE OLDEST PART OF TOWN AND IT'S JUST SOUTH OF THE HENDRICK CAMPUS.

THE THING THAT'S HAPPENED IS THAT ALONG THE WAY, ABILENE WAS ABLE TO BRING A CAMPUS 662 FROM TEXAS TECH AND THE HEALTH SCIENCE CENTER.

THE FIRST ONE WAS THE PHARMACY SCHOOL.

IF YOU REMEMBER, I HOPE YOU REMEMBER, THAT WHERE THE PHARMACY SCHOOL SITS TODAY, 665 THERE WERE 25 ABANDONED CARS RIGHT ON THE STREET.

AND IT WAS AN EYE SORE OF EYE SORES.

I DON'T KNOW IF YOU ALSO KNOW THIS, BUT THERE WERE NINE ABANDONED SERVICE 668 STATIONS BETWEEN THE CONVENTION CENTER AND HENDRICK.

TO THIS DAY, ALL BUT ONE IS REMOVED.

A LOT OF GREAT PROGRESS CAME AND AFTER THE PHARMACY SCHOOL, THEN IT WAS THE 671 NURSING SCHOOL AND NOW THE SCHOOL OF PUBLIC HEALTH.

AND THERE IS A PLAN IN PLACE WITH LAND PROVIDED THAT SOME DAY WE'D ADD THE 673 POTENTIAL FOR TWO MORE BUILDINGS AND PROGRAMS OF THE TEXAS TECH HEALTH 674 SCIENCE CENTER.

TODAY IT'S TRULY A CAMPUS.

AND NOW BECAUSE OF THE NEED FOR HOUSING, WE BEGAN TO LOOK AND SEARCH FOR A SITE 677 THAT IS ADJACENT TO IT.

THAT'S THE SITE THAT IS BEFORE YOU.

AND THE ABANDONMENT OF ALL THE ALLEYS AND STREETS IN THIS ITEM.

SO WHAT YOU'LL HEAR TODAY IS THAT THIS IS A BIG PROJECT.

24 -- THE REZONING OF 24 DIFFERENT PIECES OF PROPERTY.

THOSE TODAY HAVE STRUCTURES.

SOME DON'T.

THE PLAN IS AND THE DEVELOPER IS HERE TODAY AND I'D LIKE GROW TO HEAR FROM 685 HIM -- LIKE FOR ARE YOU TO HEAR FROM HIM.

THIS IS ABOUT BUILDING AN APARTMENT COMPLEX FOR THIS VERY CAMPUS AND I'M EXCITED 687 TO KNOW THAT THIS IS GOING TO NOT ONLY BE A GREAT ADDITION TO THE HEALTH 688 SCIENCE CENTER CAMPUS BUT IT WILL MEAN CONSTRUCTION JOBS AND SAFE HOUSING FOR 689 STUDENTS WHO WILL BE ADJACENT TO THE CAMPUS.

THE PHARMACY STUDENTS COME HERE AND STAY FOR FOUR YEARS.

THE NURSING STUDENTS STAY FOR A YEAR, TWO YEARS AND SOME THREE.

THE PUBLIC HEALTH, THE PROGRAMS THERE AT THE MASTER'S AND DOCTOR LEVEL 693 WILL BE HERE FOR A WHILE.

FOR THEM TO HAVE THE CLOSE ACCESS HOUSING, NOT HAVING TO DRIVE ALL THE WAY ACROSS 695 TOWN, THERE IS A GREAT NEED.

WE HAVE TWO REPRESENTATIVES TODAY FROM THE HEALTH SCIENCE CENTER.

DR. PEARL MERIT AND DR. WALKER WHO CAN TALK ABOUT THAT TOO.

I ENCOURAGE YOU TO APPROVE THIS PROGRAM.

IT'S GOING TO BE ANOTHER GAME CHANGER FOR THE PINE STREET CORRIDOR.

I THINK ALL OF US CAN LOOK AT WHAT HAPPENED WITH PINE STREET OVER MANY YEARS.

THE PURCHASE OF PROPERTIES, THE TEARING DOWN OF A BUNCH OF DESOLATE BUILDINGS THAT 702 HAD NO USE.

THOSE NINE ABANDONED SERVICE STATIONS.

SOME DATING BACK TO THE 1930S AND 1940S.

SO THERE IS GREAT IMPROVEMENT.

STL IS A LOT OF NEW CONSTRUCTION.

THERE IS THE ABLABS, THE HOSPICE CENTER AND THE LIST GOES ON AND ON AND AS YOU 708 KNOW, THIS RUNS FROM PINE STREET TO HICKORY AND 15TH TO 16TH AND IT'S A GREAT 709 OPPORTUNITY FOR THE FUTURE.

I CAN ONLY THINK IF THIS IS SUCCESSFUL, THERE IS MORE SUCCESS TO COME.

MY REQUEST TODAY FOR YOU IS TO APPROVE OF THIS BECAUSE IT WILL MEAN A LOT.

IF YOU DON'T HAVE ANY QUESTIONS OF ME, I WOULD LIKE TO INVITE IF YOU DON'T 713 MIND, LET THE NEXT SPEAKER.

I'LL INTRODUCE HIM AS INTRODUCE JOHNSON.

HIS COMPANY IS CALLED TEXAS STUDENT LIVING.

WE WERE ABLE TO CONNECT WITH HIM AND HE HAS BIG PROJECTS RIGHT NOW.

ONE AT THE UNIVERSITY OF TEXAS AT TYLER AND OTHER PROJECTS AND APARTMENT 718 COMPLEXES ARE HIS GAME.

AND HE HAS BEEN A GOOD FRIEND, PERSON WHO HAS CAUGHT ON TO THIS 720 NEIGHBORHOOD AND THIS CAMPUS.

AND I PREDICT THIS WILL BE A GREAT PROJECT FOR ALL OF US.

DO YOU HAVE ANY QUESTIONS OF ME? 723 LET ME SAY ONE MORE TIME, I CAN'T TELL YOU ENOUGH HOW MUCH I APPRECIATE ALL OF 724 YOU.

IF YOU WOULD, I'D LIKE BRUCE JOHNSON TO COME UP AND SPEAK.

BRUCE?

>> GOOD MORNING, COUNCIL.

[00:50:04]

ANY QUESTIONS YOU MIGHT HAVE ON THIS PROJECT WE'RE PROPOSING? 729 HAVE YOU GUYS SEEN AND REVIEWED ALL THE DIAGRAMS PROVIDED FROM THE 730 DEPARTMENT? 731 YOU'LL HAVE A 7300 SQUARE FOOT AMENITY BUILDING.

A VERY NICE POOL.

I WISH I HAD A POOL LIKE THAT WHEN I WENT TO COLLEGE.

AND TWO THREE-STORY BUILDINGS BEHIND IT FACING TOWARD THE PARKING LOT AND 735 FACING THE TEXAS TECH BUILDINGS.

THOSE BUILDINGS WILL BE COMPRISED OF ONE BEDROOM, TWO BEDROOM AND FOUR 737 BEDROOM UNITS.

AND STATE OF THE ART.

EVERYBODY HAS A WALK-IN BATHROOM, WALK-IN CLOSET.

EVERYBODY HAS -- EACH BUILDING HAS 16 CAMERAS FOR SECURITY.

EVERY UNIT HAS A PANIC BUTTON THAT RINGS THE FRONT DESK.

THE SECURITY CAMERAS ARE MONITORED 24/7 AND A 72-HOUR LOOP.

WE THOUGHT WE THOUGHT OF EVERYTHING AND TRIED TO BUILD THESE THE LAST FOUR 744 OR FIVE YEARS.

AND WE TRIED TO BRING IN WIRELESS CONNECTIVITY TO EVERY SINGLE UNIT AS WELL.

I THINK IT WILL BE A NICE ADDITION TO THE HOSPITAL DISTRICT AND PROGRAM.

>> MAYOR WILLIAMS: WE'RE EXCITED ABOUT THE INVESTMENT IN ABILENE.

>> I'M HAPPY TO BE HERE.

GREAT TOWN.

>> MAYOR WILLIAMS: QUESTIONS? 751 THANK YOU VERY MUCH.

>> THANK YOU, SIR.

>> MAYOR WILLIAMS: ANYONE ELSE? 754 GIVE YOUR NAME FOR THE RECORD.

>> THANK YOU.

GOOD MORNING.

MY NAME IS PEARL MERIT.

I'M THE REGIONAL DEAN AT TEXAS TECH SCHOOL OF NURSING.

WE HAVE 200 STUDENTS AND SCHOOL OF PHARMACY HAS OVER 160 AND SCHOOL OF PUBLIC 760 HEALTH HAS MANY.

I DON'T HAVE THAT NUMBER DOWN.

BUT CERTAINLY WITH STUDENTS WE'RE IN A GREAT NEED TO HAVE HOUSING.

THIS IS A DREAM COME TRUE.

WE HAVE EVERY YEAR -- WE HAVE STUDENTS COME ALL ACROSS THE STATE AND COME 765 TO ABILENE AND WE ARE THRILLED ABOUT THAT.

I HAVE TO ADD, WE HAVE 100% PASS RATE.

I CAN'T FORGET THAT.

[15.  Ordinance (Final Reading): Receive a Report, Hold a Discussion and Public Hearing, and Take Action on Amending Chapter 22-2 Intoxicating Beverages Prohibited; Confiscation (Lesli Andrews)
]

IT'S -- WE HAVE OUTSTANDING PROGRAMS.

>> MAYOR WILLIAMS: YOU SHOULD LEAD WITH THAT.

>> 771 BUT WE HAVE NEEDED HOUSING FOR A LONG TIME.

WE KEEP GRADUALLY GROWING EVERY YEAR.

AND WE KEEP HAVING THE PARENTS COME IN AND SAY, WE -- WE NEED MORE HOUSING 774 IN ABILENE.

SO WE DREAMED OF THIS FOR YEARS.

SO I WANT TO SAY I LIKE THE FACT THAT IT'S CERTAINLY SAFE HOUSING.

I THINK NORM MERNGZED THAT.

-- MENTIONED THAT.

WE HAVE STUDENTS IN HOUSING IN OTHER AREAS THAT HAVE NOT BEEN SAFE WHERE I HAD 780 TO TALK TO THE PEOPLE.

THIS WOULD BE SAFE HOUSING.

WE ALSO HAVE OUR STUDENTS -- MANY OF THEM, THEY STUDY AT NIGHT IN THE 783 BUILDING.

THEY CAN WALK ACROSS THE STREET AND I LIKE THE CAMERAS AND SECURITY.

IT JUST IS A DREAM COME TRUE.

SO I'M HOPING YOU ALL WILL APPROVE THAT ALSO.

THANK YOU.

>> MAYOR WILLIAMS: THANK YOU.

>> GOOD MORNING, COUNCIL.

MY NAME IS AVA WALKER.

I ALSO WORK AT THE SCHOOL OF NURSING.

I'D LIKE TO THANK YOU FOR CONSIDERING THIS.

OUR STUDENTS EVERY YEAR, LIKE DR. MERIT SAID, REQUEST HOUSING CLOSER TO 794 CAMPUS.

WE HAVE PARENTS CONCERNED ABOUT THEIR STUDENTS COMING TO A NEW TOWN.

AND THEY WANT THEM TO BE SAFE.

AS DO WE.

SO WE ARE SO THRILLED THAT THIS PROPOSAL HAS COME FORTH.

AND WE DO THANK YOU FOR YOUR CONSIDERATION.

>> MAYOR WILLIAMS: THANK YOU.

ANYONE ELSE?

>> DAVID TODD.

I WAS HOPING I GOT UP HERE BEFORE I EMBARRASSED MYSELF FOLLOWING MR. ARCHIBALD'S 804 TESTIMONY BUT IT DIDN'T HAPPEN THAT WAY.

WE AGREE TO THE FOUR ITEMS THAT MIKE MENTIONED FOR ABANDONING THE 806 THOROUGHFARES AND ALLEYS AND DIDN'T WANT TO LOSE LIGHT OF THAT.

>> MAYOR WILLIAMS: ANYONE ELSE FOR OR AGAINST THIS ITEM?

>> GOOD MORNING, COUNCIL.

MY NAME IS BOB THOMAS.

I HAVE SOME MIXED EMOTIONS ABOUT THIS RIGHT HERE HAVING GROWN UP IN THAT 811 NEIGHBORHOOD OUT THERE.

CHANGE IS INEVITABLE.

I HOPE CHANGE IS JUST AS KIND TO YOU WHEN YOU HAVE TO FACE IT.

ONE OF THE THINGS THAT MR. ARCHIBALD MENTIONED WAS THE FACT THAT THERE WERE 25 815 ABANDONED VEHICLES OUT HERE.

[00:55:01]

SEVERAL -- I GUESS SUBSTANDARD IF WE CALLED THEM DILAPIDATED RESIDENCES 817 AND BUILDINGS THERE.

MY QUESTION IS, WHO WAS ULTIMATELY RESPONSIBLE FOR THAT? 819 YOU KNOW, NEGLECT IS A TERRIBLE DISEASE.

WHEN YOU TREAT THE SYMPTOM, THE DISEASE MERELY GOES ALONG.

THANK YOU.

>> MAYOR WILLIAMS: THANK YOU FOR YOUR TESTIMONY.

ANYONE ELSE THAT WOULD LIKE TO SPEAK FOR OR AGAINST THIS ITEM? 824 SEEING NO ONE, I'LL CLOSE THE PUBLIC HEARING.

IS THERE IS A MOTION OR SECOND?

>> SO MOVED.

>> MAYOR WILLIAMS: WE HAVE -- WE HAVE A MOTION BY COUNCILMAN ALBUS AND A 828 SECOND BY COUNCILMAN RENTZ.

ANY FURTHER DISCUSSION? 830 WE'RE READY TO VOTE.

>> MR. MCALISTER: YES.

>> DEPUTY SAVAGE IS ABSENT.

>> MR. PRICE: YES.

>> MR. RENTZ: YES.

>> MR. HURT: YES.

>> MAYOR WILLIAMS: YES.

>> MOTION CARRIES.

>>> ITEM 26.

I'LL ASK MIKE TO PRESENT THIS ITEM ONCE AGAIN.

>> THANK YOU AGAIN.

THIS ITEM DOES CALL FOR A PUBLIC HEARING SO AT THIS TIME I'LL OPEN UP THE 876 PUBLIC HEARING.

IS THERE ANYONE WHO WOULD LIKE TO SPEAK FOR OR AGAINST? 878 GIVE YOUR NAME FOR THE RECORD IF SO.

>> HELLO.

MY NAME IS SAM.

I'M HERE TO SPEAK IN FAVOR OF IT.

WHEN I READ THIS -- OVER THE AGENDA, ONE OF THE THINGS THAT I WAS REALLY EXCITED 883 ABOUT IS THAT SOMETHING THAT I'VE TALKED ABOUT QUITE A BIT THE LAST FEW 884 YEARS IS AFFORDABLE HOUSING.

AND HAVING AN OPPORTUNITY TO HAVE MORE OPPORTUNITIES FOR OUR CITIZENS BE IT 886 STUDENTS, WHOEVER THEY ARE, WE NEED THAT.

THAT'S GOOD CLEAN, YOU KNOW, WHAT PLACES FOR PEOPLE TO LIVE AND ALSO THE 888 DEVELOPMENT WITHIN THE CITY.

THIS IS A WIN WIN WIN FOR EVERYBODY.

AND I 100% SUPPORT THIS AND I HOPE THAT EVERYBODY GETS EXCITED ABOUT, YOU KNOW, 891 WHEN YOU LOOK AT WHAT USED TO BE AN OLDER NEIGHBORHOOD THERE, IT MAKES YOU SAD IN 892 ONE ASPECT BUT IN ANOTHER IT MAKES YOU EXCITED TO THINK THAT, OKAY, WE'RE 893 STARTING TO DO SOMETHING ABOUT THESE LOTS AND STARTING TO DO THAT.

AND I KNEW THE PLAN WAS ALWAYS THERE BUT IT'S EXCITING TO SEE THAT IT'S 895 HAPPENING.

SO I CONGRATULATE EVERYBODY INVOLVED IN THIS AND HOPE THAT THERE IS NOTHING BUT

[01:00:03]

GOOD THAT COMES OUT OF THIS.

>> MAYOR WILLIAMS: THANK YOU.

IS THERE ANYONE ELSE THAT WOULD LIKE TO SPEAK FOR OR AGAINST THE ITEM? 900 SEEING NO ONE, I'LL CLOSE THE PUBLIC HEARING.

>> MOVE FOR APPROVAL.

>> MAYOR WILLIAMS: MOTION BY COUNCILMAN PRICE AND SECOND BY COUNCIL WOMAN ALBUS.

>> I'M EXCITED ABOUT THIS.

THAT AREA OF TOWN WITH THE GROWTH, WE HAVE THE PT SCHOOL.

AND RIGHT THERE AULTS AND -- AND THERE IS A DEFINITE NEED FOR THIS.

I'M EXCITED.

VERY EXCITED THAT'S PART OF THE TOWN WE'RE WANTING TO GROW.

>> MAYOR WILLIAMS: SHOULD BE GREAT DEVELOPMENT.

>> IN THE 1990S, I CAN'T TELL YOU HOW MANY HOURS WE SPENT TRYING TO CLEAN UP 910 PINE STREET UP AND DOWN ENCOURAGING THE OWNERS OF THE BUSINESSES TO CLEAN UP 911 AS WELL AS ENGAGE IN THE CITY IN THAT PROCESS.

THIS IS -- IT MAKES ME SMILE EVERY TIME I DRIVE DOWN PINE NOW.

>> MR. HURT: YES.

>>> NOW WE'LL MOVE TO THE PUBLIC COMMENT PERIOD.

THERE WILL BE NO VOTES OR FORMAL ACTIONS TAKEN DURING PUBLIC COMMENT.

THE PUBLIC COMMENT PERIOD ONLY WILL ALLOW HIMBERS OF -- MEMBERS OF THE PUBLIC 994 TO PRESENT IDEAS AND INFORMATION TO CITY OFFICIALS AND STAFF.

THERE WILL BE A THREE-MINUTE TIME LIMIT.

>> GOOD MORNING.

DAVID HERE.

WELL, I HAVE AN OBSERVATION AND COMPLAINT.

THIS MONTH'S WATER BILL WHEN I OPENED IT, THERE WAS -- 3,000 GALLONS.

SO I IMMEDIATELY HIT THE ROOF.

I WOULDN'T HAVE TO CALL CHIEF FLORES TO GET LADDER 1 TO GET ME DOWN BUT I DID 1002 MY RESEARCH AND WENT OUT TO THE METER.

AND CHECKED IT.

AND THERE WAS NO WAY THAT METER COULD EVER BE READ.

I HAVE PHOTOGRAPHIC EVIDENCE.

I HAVE THE EVIDENCE BEFORE AND AFTER I GOT CLEANING THROUGH THE METER.

I REMEMBER LAST YEAR RODNEY TAYLOR, THE WATER UTILITY DIRECTOR SAID WE'D BE 1008 IMPLEMENTING DIGITAL METERS.

AND I DON'T KNOW WHEN THAT IS ON THE HORIZON.

I BELIEVE IT'S SOMETIME POSSIBLY IN THE 2019 OR 2020.

BUT I WOULD SUGGEST YOU COME TO TOWN WEST OR OLD TOWN WEST AND PUT OURS IN FIRST.

BUT I WOULD SAY THE -- THE CITY WOULD HAVE TO HIRE NEW INSPECTORS TO GO WITH THE 1013 CONTRACTOR -- I WOULD SUGGEST DOCUMENTATION OF -- WHEN YOU PULL THE OLD 1014 METER, EITHER VIDEO OR I -- I CAN GIVE YOU AN EXAMPLE OF OPENING UP THE 1015 WATER AND SAYING OH, 10,000 GALLONS.

WE WERE ON VACATION FOR THREE WEEKS.

SO HE RUNS OUT TO CHECK THE METER.

WELL, YOU PULLED THE OLD METER SO HE HAS NO RECOURSE TO DISPUTE THIS.

AND -- I DID AFTER THREE DAYS COME AND RECHECK MY METER.

BUT THERE IS NO WAY YOU CAN MISTAKE 428 -- THE DIGITS 428 FOR 431.

THERE IS NO WAY YOU CAN DO THAT.

THERE IS ONLY TWO WAYS THAT THEY'RE ESTIMATING IT THROUGH SOFTWARE DOWNTOWN 1023 OR THE METER GUYS MIGHT HAVE JUST BEEN IN A HURRY THAT DAY AND ESTIMATED THE 1024 NUMBERS.

BUT -- LIKE I SAID, I HAVE VIDEO EVIDENCE OF WHAT THE METER LOOKED LIKE BEFORE A 1026 THOROUGH CLEANING AND THERE WAS NO WAY ANY HUMAN COULD READ THAT.

BUT I'M JUST EXCITED ABOUT THE OPPORTUNITY THAT WE'RE GOING TO A DIGITAL SYSTEM 1028 WHERE WE'LL TAKE THE GUESS WORK OUT OF WHAT THE METERS WILL POSSIBLY READ.

THE LAST SUGGESTION I HAVE IS THE NEW POLICE STATION.

I DON'T KNOW IF YOU HAVE A NAME PICKED OUT OR YOU'RE GOING TO -- I WOULD SUGGEST 1031 THAT CHIEF CLINTON POLICE CENTER OR MAYBE SOMETHING ALONG THAT LINE IS TO HONOR 1032 THE FIRST COMBINATION FIRE CHIEF AND POLICE CHIEF.

THAT'S REALLY ALL I HAVE AND HAPPY ST. VALENTINE DAY FOR EVERYBODY OUT THERE.

>> MAYOR WILLIAMS: IS THERE ANYONE ELSE?

>> ROSA, WAS THERE A CARD -- THE CITIZEN BROUGHT FORWARD TO SPEAK?

>> GOOD MORNING, COUNCIL.

GOOD MORNING, MR. MAYOR.

MR. HANNA, STANLEY.

I'M HERE THIS MORNING TO CLARIFY THE RECORD OF THE MEETING OF THE 24TH.

I HAD TWO INDIVIDUALS THAT PERSONALLY MENTIONED ME IN THEIR LITTLE SPEECH THAT 1041 THEY GAVE TO THE COUNCIL.

AND I HAVE TO TELL YOU THAT I'M A BOARD MEMBER AND TRUSTEE FOR THE ABILENE 1043 SCHOOL DISTRICT AND IT WAS BROUGHT UP THAT I SHOULD HAVE BEEN AT THAT MEETING 1044 INSTEAD OF THIS MEETING.

[01:10:01]

I THINK DUSTY NEEDED TO GET HIS INFORMATION CORRECT.

WE HAD AN EVALUATION THAT DAY BUT WE MOVED THE MEETING IN ORDER TO 1047 ACCOMMODATE THAT I COULD COME TO CITY COUNCIL MEETING.

SO, YOU KNOW, THIS IS A DIFFICULT DEAL FOR ME.

I WOKE UP THIS MORNING TRYING TO FIGURE OUT, WHAT AM I GOING TO SAY HERE THAT 1050 DOESN'T SOUND BAD BECAUSE I'M NOT COMING HERE TO SAY BAD THINGS.

BUT I DON'T APPRECIATE PEOPLE SAYING THINGS ABOUT ME THAT ARE NOT TRUE.

IF IT'S TRUE, I CAN TAKE IT.

BUT WHEN THIS GUY GETS UP HERE AND GRAND STANDS AND HE THINKS HE IS IN THE 1054 COURTROOM, I'VE SEEN "LAW AND ORDER" TOO.

I DON'T APPRECIATE THAT DESCRIPTION.

I DON'T APPRECIATE THE FACT THAT HE SAYS MY CONSTITUENCY IS NOT SEARS 1057 PARK.

WHEN I CLEARLY QUALIFIED THAT -- THAT THESE WERE THE PEOPLE I WAS REPRESENTING.

HE SAYS THE WHOLE CITY IS MY CONSTITUENCY.

IT IS WITH THE SCHOOL BOARD BUT ANYTHING OTHER THAN A SPECIFIC PROBLEM IN A 1061 SPECIFIC AREA.

SO UNLESS DUSTY HAS MOVED IN TO MY NEIGHBORHOOD OR UNLESS HE IS HISPANIC, IN 1063 THIS CASE, HE IS NOT MY CONSTITUENT.

AS A MATTER OF FACT, I DON'T EVEN KNOW THIS GUY.

I ONLY SEE HIM WHEN THERE IS A CONFLICT AND HE BRINGS HIS VIEWS AND NEVER A 1066 COMPROMISING VIEW.

ALWAYS A SET VIEW.

AND I DON'T APPRECIATE THAT EITHER.

LAN BEARD -- I THINK HE WORKED FOR THE POLICE DEPARTMENT DETECTIVE.

TALKED ABOUT MAKING RACIST STATEMENTS.

I LOOKED UP MILITIA AND EVERY START IN THE -- STATE IN THE UNION HAS A MILITIA 1072 AND IT'S CALLED A NATIONAL GUARD.

SO I'M TRYING TO FIGURE OUT IF -- I DIDN'T MAKE THAT STATEMENT, BUT IF I CALLED 1074 IT A WHITE MILITIA, 85% OF THE POLICE FORCE IS WHITE.

IS THAT A BAD NAME? 1076 TO CALL SOMETHING A WHITE MILITIA? 1077 I DON'T KNOW BUT I DIDN'T MAKE THAT STATEMENT.

WE HAD A STATEMENT ON COURAGEOUS CONVERSATIONS AND WE WERE ALL THERE.

20 OF US THERE.

NO ONE WAS SPEAKING SO SHARON OWENS ASKED EVERYONE TO TAKE A PLEDGE THAT 1081 WHATEVER WAS SAID AT THE MEETING, TO KEEP IT CONFIDENTIAL.

THIS WAS 10 AND A HALF YEARS AGO.

I GUESS SINCE HE LEFT THE POLICE DEPARTMENT, CONFIDENTIAL DOESN'T MEAN 1084 ANYTHING.

I TALKED TO HIM AND HE IS A GOOD GUY.

WHY HE THROWS ME UNDER THE BUS, I DON'T UNDERSTAND.

MY ONLY PURPOSE IS TO HELP PEOPLE.

IF SOMEONE WANTS TO LOOK UP THE RECORD, THAT'S WHAT I TRIED TO DO.

I DON'T HAVE AN AGENDA.

THE ONLY AGENDA I HAVE IS THE SAME ONE THAT GARY HAD.

ABILENE'S CHILDREN FOR TODAY AND THE GREAT AMERICA CITY WHICH IS ABILENE.

I HAVE SOME ISSUES, CONCERNS.

PRIMARILY THIS OCTOBER WILL BE THE 50TH YEAR THAT THE WALK OUT -- THE MOMENT.

FAST FORWARD TO 2019, WE'RE STILL HAVING THE SAME PROBLEMS WE HAD SFWIFT 1095 YEARS AGO -- 50 YEARS AGO.

SO ARE WE THE GREAT AMERICAN CITY? 1097 THANK YOU FOR YOUR TIME.

>> AGAIN, MY NAME IS SAMUEL GARCIA.

I'M HERE TO SPEAK TO CLARIFY -- I'M GOING TO BE A LOT MORE DIRECT THAN MY 1100 FELLOW BOARD MEMBER.

THE MEETING OF JANUARY 24, WE WERE CALLED A LYNCH MOB.

WE WERE ATTACKED IN THE PRAYER BEFORE THE MEETING EVEN STARTED.

I HAD NO IDEA BILLY WAS GOING TO BE HERE TODAY.

NONE.

THIS IS A PICTURE OF 50 YEARS AGO.

THE MARCH WHERE THESE KIDS HAD THEIR LANGUAGE CALLED THE MONKEY LANGUAGE.

THE MONKEY LAJ WJ.

WHEN -- LANGUAGE.

WHEN WE HEAR KYLE OR READ KYLE WONDERING WHETHER OR NOT IF HE HAS A JOKE -- AS 1110 SOME OF Y'ALL CALL IT, WHETHER THE PEOPLE THAT WORK IN THE MEXICAN 1111 RESTAURANT ARE GOING TO SPIT IN HIS FOOD BECAUSE OF THE SHIRT HE HAS ON, SOME 1112 OF THE PEOPLE IN THIS ROOM, PICTURE, WERE THERE THAT NIGHT.

[01:15:02]

THEY WERE OUT THERE.

WHAT SOME OF Y'ALL CALL A LYNCH MOB WAS PEOPLE STANDING UP FOR THEIR 1115 RIGHTS.

PEOPLE STANDING UP FOR RIGHT AND WRONG.

KYLE ASKED -- PLEASE CENSOR ME AND THIS COUNCIL DIDN'T EVEN HAVE THE COURAGE TO DO 1118 THAT.

THESE PEOPLE HAD COURAGE.

THE PEOPLE OUTSIDE, INSIDE THIS ROOM HAD HAD COURAGE.

I'M HERE TO CLARIFY ALSO MY NAME WAS BROUGHT UP.

I DIDN'T HEAR IT.

I WAS TOLD, HE IS NOT EVEN AT THE BOARD MEETING.

YOU WANT TO KNOW WHY I DIDN'T HEAR IT? 1125 I WAS AT THE BOARD MEETING.

THE SCHOOL BOARD MEETING THAT I WAS BEING CRITICIZED FOR NOT BEING AT, I WAS 1127 THERE SO I DIDN'T GET TO HEAR THE CRITICISM.

I HAD TO WATCH IT.

YES, I WAS AT THE MEETING A COUPLE YEARS AGO WHERE WE ALL MADE THE AGREEMENT TO 1130 TALK ABOUT ISSUES HARD TO TALK ABOUT.

WE ALL MADE THIS PLEDGE THAT WHATEVER WAS SAID IN THE ROOM WAS IN CONFIDENCE AND 1132 CONFIDENTIAL.

THAT WE WERE GOING TO BE ABLE TO TRADE IDEAS.

THEN A POLICE OFFICER WHO WE TRUSTED RETIRES AND DECIDES THAT YOU KNOW THAT PLEDGE 1135 HE MADE? 1136 I GUESS HE ONLY DID IT BECAUSE HE WAS A POLICE OFFICER.

I MADE THE PLEDGE AND HAD NO LEGAL RESPONSIBILITY TO KEEP IT, BUT I KEPT IT.

I WAS TOTALLY MISQUOTED.

THAT WASN'T WHAT HAPPENED.

WHAT WAS SAID ABOUT THE MEETING AND ME WAS WRONG.

IT WAS AN ABSOLUTE LIE.

IT'S FUNNY ABOUT A FEW MONTHS LATER, THE SAME POLICE OFFICER GREETED ME 1143 AND SAID THANK YOU FOR ALWAYS SUPPORTING ABILENE PD.

I'M HERE BECAUSE TODAY, I'M HERE TO -- TO FIRST OF ALL -- MOM ALWAYS SAID YOU 1145 STAND UP FOR YOUR RIGHTS, AND THAT'S WHAT I'M GOING TO DO -- GOING TO DO.

IF YOU GET A CHANCE, GO READ, LEARN A LITTLE HISTORY ABOUT WHAT THE 1147 HISPANICS IN ABILENE HAVE GONE THROUGH.

THANK YOU.

>> MAYOR WILLIAMS: ANYONE ELSE THAT WOULD LIKE TO PARTICIPATE IN PUBLIC 1150 COMMENT THIS MORNING? 1151 SEEING NO ONE, I'LL CLOSE THE PUBLIC COMMENT PERIOD.
