THE FIRST CASE IS CASE NUMBER 22-003296 AT 302 NORTH MOCKINGBIRD. COUNTY RECORDS WARRANTY WITH THE WARRANTY LIEN. ABILENE PARTS.

SECRETARY OF STATE REGISTERED AGENT TO WHICH NOTICES HAVE BEEN SENT. TAX RECORDS OF THE MUNICIPALITIES ARE NOT APPLICABLE.

UTILITY RECORDS OF THE MUNICIPALITY INACTIVE SINCE NOVEMBER 7, 2022. THE SEARCH REVEALS ABILENE APARTMENTS LCC TO BE THE OWNER. THIS IS THE PUBLIC NOTICE POSTED ON THE FRONT DOOR OF THE PRIOR OFFICE.

THE CODE VIOLATIONS ARE INADEQUATE SANITATION, STRUCTURAL HAZARD, NUISANCE, HAZARDOUS ELECTRICAL WIRING, HAZARDOUS PLUMBING, HAZARDOUS MECHANICAL EQUIPMENT AND FAULTY WEATHER PROTECTION. INADEQUATE SECUREMENT.

THIS FENCE HAS SEVERAL OPEN SPOTS THROUGHOUT THE WHOLE AREA.

THERE IS A FENCE AROUND THE WHOLE PROPERTY, BUT THE MAJORITY OF THE FENCE IS WHAT YOU SEE HERE.

WHERE THE SECUREMENT HAS BEEN CUT, AND THE PANELS ARE ABLE TO PUSH OPEN. THE PICTURE ON THE RIGHT, THAT GATE IS OPEN ALL THE TIME NOW. AND THE GATE YOU ARE SEEING HERE. THE PICTURE ON THE LEFT.

THERE ARE ACTUALLY TWO PANELS STOLEN HERE AND THE WHOLE FENCING IS JUST MISSING. IT CAN'T EVEN BE SECURED.

NONE OF THE DOORS ARE SHUT AND LOCKED.

THE ASBESTOS ABATEMENT. SO BASICALLY INSIDE ALL THESE UNITS IT IS JUST DOWN TO THE STUDS OF THE BUILDING.

AND NONE OF THE DOORS WILL LOCK AND SHUT.

MOST OF THE WINDOWS ARE NOT BOARDED UP.

IT IS JUST COMPLETELY OPEN AT THIS POINT.

THIS IS DEBRIS LEFT BEHIND FROM THE ASBESTOS ABATEMENT THAT IS JUST IN THE CENTER COURTYARD OF THE COMPLEX.

WE HAVE -- INSIDE ONE OF THE NORTHWEST UNITS, THERE ARE THREE DIFFERENT AREAS WE HAVE NOTICED WHERE THEY WERE BURNING THINGS INSIDE. THE VAGRANTS GOTTEN IN THERE AND THREE DIFFERENT BURN PILES INSIDE ONE OF THOSE UNITS.

THE LADDER YOU SEE ON THE LEFT THAT HAS BEEN USED TO GET UP AND PRETTY MUCH EVERY SINGLE AIR CONDITIONING UNIT IN THE COMPLEX HAS BEEN STOLEN, VANDALIZED AND THEY WERE USING THAT LADDER TO GET UP TO THE ROOF OF THE UNITS TO GET TO THOSE STRUCTURAL HAZARDS. ALL THE BALCONY AND WALKWAYS UP TOP ARE VERY DANGEROUS. I DON'T TRUST WALKING ON THEM.

WE TRY TO AVOID GOING UP ON THOSE AT THIS POINT.

YOU CAN SEE WHERE THE WOOD IS ROTTED OUT AND THE HOLES.

DILAPIDATION. SO THIS IS THE INTERIOR OF EVERY UNIT. YOU CAN SEE PARTS FROM THE AIR CONDITIONING UNITS THAT HAVE BEEN DAMAGED, DESTROYED, STOLEN.

THERE THROUGHOUT THE COMPLEX AS WELL.

ALL THE UNITS LOOK LIKE THIS WHERE IT IS STRIPPED DOWN TO THE STUDS. YOU CAN SEE WHERE ELECTRICAL HAS BEEN STOLEN AND DAMAGED AND UNUSABLE.

THIS IS THE SECOND TIME IT HAS BEEN HERE SO JUST TO KIND OF UPDATE. THE -- I HAVE SPOKEN WITH THE PROPERTY OWNERS SEVERAL TIMES. BACK IN AUGUST, THE CONTRACTOR APPLIED FOR PLUMBING PERMIT TO INSTALL NEW FIXTURES IN 44 UNITS. THE PERMIT WAS NEVER PAID FOR.

NOVEMBER '22, WATER DEPARTMENT POSTED NOTICE AROUND THE COMPLEX DUE TO NONPAYMENT FOR WATER, SERVICES WILL BE TERMINATED.

NOVEMBER 7, 2022. NOVEMBER 3 WHILE PERFORMING INSPECTION, SMASHING WALLS AND STEALING COPPER.

FOUND MANY BUILDINGS THAT WERE UNSECURED.

POSTED CONDEMNATION WARNING SIGNS.

NOVEMBER 9, AFFIDAVIT OF CONDEMNATION RECORDED AT THE COUNTY CLERK. MARCH, THE BOARD ORDERED A 4006.

ALTERCATION PERMIT WAS APPLIED FOR.

JUNE 24, ISSUED THE PERMIT. JULY 2023, WE WERE TOLD BY THE CONTRACTOR AND I WITNESSED THAT THE ASBESTOS ABATEMENT WAS FINALLY COMPLETED. THAT PROJECT WAS STARTED IN MARCH OF 2023. THEY WORKED ON SEVERAL UNITS OVER THERE AND LEFT FOR NONPAYMENT -- THE CONTRACTORS DOING THE ASBESTOS LEFT FOR TWO MONTHS WITH THE PROJECT JUST SITTING THERE AND FINALLY GOT PAID AND CAME BACK AND FINISHED IN JULY OF THIS YEAR. SO THAT ASBESTOS SIDE OF IT IS COMPLETELY DONE. SEPTEMBER 7, 2023, NO WORK HAS OPINION DONE ON THIS COMPLEX SINCE THE ASBESTOS ABATEMENT.

THE COMPANY STARTED IN MARCH AND LEFT FOR NONPAYMENT IN APRIL AND DIDN'T RETURN UNTIL JULY TO FINISH.

SEPTEMBER 28, 2023, TWO PHONE CALLS FROM NEARBY RESIDENTS COMPLAINING OF RATS COMING FROM APARTMENT COMPLEXES MAKING THEIR WAY INTO THE HOME ACROSS THE ALLEY ON THE WEST SIDE OF THE COMPLEX. SEPTEMBER 13, WE CONTACTED STATE ASBESTOS INVESTIGATOR -- OR INSPECTOR AND SURVEY ABATEMENT WAS COMPLETED ON ALL BUILDINGS. AND DID NOT HEAR BACK FROM HIM UNTIL TWO DAYS AGO. I SPOKE WITH HIM AND HE SAID, YES, THE ASBESTOS HAS BEEN SIGNED OFF AS FAR AS THE ABATEMENT BEING COMPLETED. THAT PORTION OF IT IS DONE.

SEPTEMBER 13, ADDITIONAL CITIZEN COMPLAINTS RECEIVED FOR THIS PROPERTY ADVISED THEM TO ATTEND THE BOARD MEETING.

STAFF RECOMMENDATION ON THIS IS PROPERTY IS A PUBLIC NUISANCE AND IT IS A HAZARD TO PUBLIC HEALTH, SAFETY AND WELFARE AND REPAIR OF THE STRUCTURE WILL BE UNREASONABLE.

ORDER -- THE OWNER IS ORDERED TO DEMOLISH OR APPEAL THE ORDER WITHIN 30 DAYS OR THE CITY MAY DEMOLISH.

ALONG WITH THAT THIS COMPLEX -- I ALSO DID RECEIVE AN E-MAIL FROM THE -- ONE OF THE OWNERS OF THE ABILENE APARTMENTS LLC GROUP THIS MORNING THAT STATES THEY STILL PLAN ON MOVING AHEAD WITH FIXING THIS COMPLEX UP. HE STATES THAT THEY ANTICIPATE STARTING WORK NOVEMBER 21. I HAVE BEEN IN CONTACT WITH THIS GENTLEMAN THROUGHOUT THE PROCESS WITH THIS COMPLEX, AND THE DATE SEEMS TO MOVE A MONTH AT TIME EVERY TIME AND NOTHING GETS DONE. NOVEMBER 21 IS WHAT THEY ARE SAYING NOW. THERE IS A REPRESENTATIVE FROM LAMAR NATIONAL BANK WHO IS THE LIEN HOLDER ON THIS PROPERTY AND LAMAR IS PLANNING TO MOVE FORWARD WITH FORECLOSURE ON THIS

BUT I OWN A BUSINESS AT 401 NORTH WILLIS JUST A FEW BLOCKS AND I JUST MOVED A FEW YEARS AGO FROM WESTVIEW JUST AROUND THE CORNER FROM THIS APARTMENT COMPLEX SO I KNOW IT VERY WELL.

I OWNED THE BUSINESS AROUND THE CORNER OVER 20 YEARS.

THIS HAS BEEN A PROBLEM WHEN PEOPLE WERE LIVING THERE.

THIS IS THE FIRST TIME I HAVE GOTTEN TO SEE PICTURES ON THE INSIDE. I HAVE LIVED AND DRIVEN BY THAT THING HUNDREDS OF TIMES. I HAVE RESCUED FAMILIES WHO WERE THROWN OUT OF THIS DUMP IN ITS RAIN.

A MOM WITH HER BABY WITH THEIR STUFF SITTING OUTSIDE IN THE RAIN WITH NOWHERE TO GO. LITERALLY LOADED UP THE STUFF IN MY TRUCK. GRABBED THE MOM AND THE BABY.

SHE WAS ABOUT SIX YEARS OLD. SO I THOUGHT, THIS IS HORRIBLE.

HOW DO YOU -- HOW DO YOU KICK SOMEONE OUT WITH ALL THEIR STUFF IN THE RAIN. OVER TIME -- THIS WAS PROBABLY ABOUT EIGHT YEARS AGO. OVER TIME, IT JUST GOT WORSE AND WORSE AND WORSE. I DROVE BY THERE A COUPLE OF DAYS AGO. MAYBE YESTERDAY -- NO, IT WAS THE DAY BEFORE. THAT GATE IS OPEN.

PEOPLE IN AND OUT. I -- THIS -- THIS GENTLEMAN RIGHT HERE HAS DONE AN AMAZING JOB OF SYNCHRONIZING.

YOU ARE DOING A GOOD JOB. I APPRECIATE.

YET ON OUR CORNER ON MOCKING BYRD AND NORTH 3RD WHERE I USED TO LIVE ON WESTVIEW. 401 WESTVIEW A FEW YEARS AGO, THIS IS WHAT WE HAVE AND A LOT MORE PHONE CALLS.

HE PROBABLY CAN'T LOG IN ALL THE PHONES CALLS BECAUSE I KNOW I HAVE MADE THEM. THERE IS NO REASON YOU SHOULD CONTINUE TO GET DRAGGED ON THIS WAY.

I AM AFRAID THAT OUR CHILDREN ARE IN DANGER.

HOMELESS PEOPLE ARE TAKING OVER THE PLACE.

TEN, 12 I CAN'T REMEMBER THE EXACT NUMBER, BUT THIS IS PRETTY MUCH EVERY SINGLE UNIT IN THERE IS IN THE SAME CONDITION. THE PICTURE YOU SEE ON THE RIGHT THERE, THEY ACTUALLY -- VAGRANTS HAVE BUSTED THROUGH THE OUTSIDE WALL SINCE WE HAVE SECURED THIS PROPERTY.

ALL THE DOORS AND WINDOWS ACCESSIBLE WERE SECURED.

THEY ACTUALLY BUSTED THROUGH THE WALL IN THE BOTTOM AND ON THE UPSTAIRS FLOOR. AND CAN CRAWL IN THROUGH THE WALL FROM THE OUTSIDE. MOST WINDOWS ON THE COMPLEX ARE BUSTED. I DON'T HAVE A CURRENT PICTURE. THE FAR WEST SIDE OF THE UNIT, I WENT BY AND THAT WINDOW WHICH WAS A VERY LARGE, GLASS WINDOW HAS BEEN BUSTED UP. NOW I HAVE GOT TO GO HAVE SOMEONE SECURE THAT WINDOW NOW SINCE THAT UNIT IS ACCESSIBLE THROUGH THAT FRONT WINDOW. BACK IN FEBRUARY 2021 IS WHEN THE FIRE OCCURRED AND WENT DOWN TO THE ONE UNIT.

JULY 2022, THE FIRST NOTICE TO THE PROPERTY OWNER FOR THE DILAPIDATED STRUCTURE. AUGUST 12, A NUMBER OF HEALTH RESOURCES TO THE OCCUPANT AND THE OWNER OF THE PROPERTY.

AUGUST 30, WE ISSUED A CITATION FOR FAILURE TO MAKE A REPAIR PLAN WITH US OR COMPLETE ANY REPAIRS.

MARCH 8, 2023, WE PERFORMED AN EXTERIOR INSPECTION OF THE PROPERTY. FOUND VERY HAZARDOUS CONDITIONS.

CHILDREN'S TOYS AROUND THE EXTERIOR.

WE MET THE OCCUPANT OF THE HOUSE AND DIDN'T FEEL THAT IT WAS LIVABLE AND DIDN'T MEET THE MINIMUM STANDARDS OF HEALTH AND SAFETY AND SHOULD NOT ALLOW CHILDREN TO BE AT THE PROPERTY UNTIL HOUSE IS REPAIRED. APRIL 2023, CONTACTED THE PROPERTY OWNER AND EXPRESSED OUR CONCERN FOR THE OCCUPANTS THAT REQUESTED THAT THE CITY PERFORM A INTERIOR INSPECTION OF THE PROPERTY. APRIL 2023, A COMPLETE INTERIOR AND EXTERIOR INSPECTIONS. ADDITIONAL HAZARDS WAS FOUND.

A MINOR WAS AT THE PROPERTY. AT THE END, WE TOLD HER WHAT WE FOUND. WE LET HER KNOW CONCERNED OF THE HEALTH AND SAFETY. AND THE OWNER SAID THEY COULD STAY WITH HER. JULY 10, POSTED A NOTICE OF THE BOARD HEARING ON BOTH CONDEMNED STRUCTURES. JULY 12, SENT NOTICE TO THE PROPERTY OWNER AND THE PROPERTY OWNER'S CARETAKER OF THE HEARING. JULY 26, A PHONE CALL WITH MR. PITTMAN. HE UNDERSTANDS THE BURNED AND RESIDENTIAL STRUCTURE WAS DEMOLISHED BUT NOT WANTING THE METAL. AND TRYING TO GET SPLIT WITH 2858 WOULD BE ON SEPARATE. PHONE CALL WHERE MR. MR. PITTMAN THAT HE WANTS TO USE THE METAL BUILDING SOLELY FOR STORAGE.

PER THE CITY OF WATER DEPARTMENT SUPERVISOR NO TRASH SERVICE SINCE JULY 2015. PER THE REQUEST OF THE CITY, THE LEADER OF THE ABILENE BAPTIST ASSOCIATION MET WITH THE PROPERTY OWNER TO ASSESS HER NEEDS.

ASKED THE HOMEOWNER TO ASK FOR A GOOD TIME FOR A VOLUNTEER PLUMBER WOULD COME INSIDE TO SEE WHAT REPAIR WORK WAS NEEDED.

SEPTEMBER 28 OF 2020, REACHED OUT TO SEE IF THE HOME SOWNER WOULD QUALIFY FOR FLOOD ASSISTANCE.

SEPTEMBER 10 OF 2020, GOT WITH THE WATER SUPERVISOR TO SEE WHAT IT WOULD TAKE FOR THE WATER SERVICES TO BE RESUPPORTED AND PRO SIDE FROMMED THAT INFORMATION ON MISS CHAMPION AND DO PAYMENT PLAN WITH THE WATER DEPARTMENT BECAUSE OF POOR PAYMENT HISTORY WATER WAS SWITCHED ON SO THE VOLUNTEER PLUMBER COULD FIND ISSUES. NOVEMBER 30, FOUND THE DAMAGE, DETERMINED THE JOB WAS TOO BIG FOR HIM.

AND BLACK PLUMBING PROVIDED AN ESTIMATE OF OVER $7,000.

THEY OFFERED TO MAKE REPAIRS WITH THE COST OF THE LABOR AND REPAIRS. BUT THEY WERE UNCLEAR WITHOUT DIGGING. DECEMBER 10 OF 2020, NO CHANGE TO THE PROPERTY AND ISSUED A CITATION WITH THE HOPE OF RESOLUTION DURING THE COURT AMERICA.

JANUARY 12 OF 2021. SPOKE TO THE PROPERTY OWNER WHO

AND SECOND CITATION ISSUED AT THAT TIME. AUGUST 10 OF '21, DETERMINED THROUGH THE WATER DEPARTMENT THAT WATER SERVICE HAD BEEN ACTIVATED. NOVEMBER 19 OF 2021, THE WATER SERVICE WAS TERMINATED. NOVEMBER 29, 2021, ANOTHER NOTICE OF VIOLATION WAS SENT TO THE PROPERTY OWNER.

SAME ON DECEMBER 8. DECEMBER 9, CASE WAS DELAYED DUE TO MISS CHAMPION'S DECLINING HEALTH.

A PLAN OF ACTION BY JANUARY 10 FOR WATER AND EXTERIOR REPAIRS.

JANUARY 27 OF 2022, RECEIVED SOME TEXT MESSAGES FROM THE PROPERTY OWNER BUT STILL NO LEGITIMATE PLAN OF ACTION WAS GIVEN TO US. MARCH 1, THE PROPERTY FOR TAX OPTION AND REMOVED FROM THE OPTIONS PRIOR TO THE SALE.

MAY 6, NO CONTACT FROM THE PROPERTY OWNER.

WATER STILL SWITCHED OFF AT THE TIME AND ISSUED A THIRD CITATION. AUGUST 11, NEW SIDING WAS PLACED ON THE FRONT OF THE HOUSE. APRIL 17 OF 2023, WE STILL HAVE NO ACTIVE WATER SERVICE THERE. THE WATER JUGS ARE BEING USED TO COLLECT WATER FROM A NEIGHBOR IN ORDER TO FLUSH THE TOILET.

STILL AN OPEN PLUMBING DITCH IN THE BACK YARD AT THE TIME.

JULY 12, 2023, WE INSPECTED THE PROPERTY AND LARGE OPENINGS IN THE EXTERIOR. JULY 20, THE PROPERTY OWNER WAS ALLOWED BY MUNICIPAL COURT TO POSTPONE A COURT DATE FOR CITATION ON MAY 5, 2022. A JURY TRIAL SCHEDULED FOR THIS DAY JULY 20. THE OWN OFFICER NOT SHOW UP FOR THE TRIAL OR CALL AHEAD FOR A NEW DATE.

TO DATE, A NEW TRIAL HAS NOT BEEN SET AND NO ACTION TAKEN BY THE COURT FOR FAILURE TO APPEAR. AUGUST 17, AN ADMINISTRATIVE SEARCH WARRANT TO INSPECT THE EXTERIOR OF THE HOME.

AUGUST 30, MET WITH MISS CHAMPION AND PROVIDED HER WITH A COPY OF THE CONDEMNATION 30-60 AND A PLAN OF ACTION AND COPY OF THE CONSENT TO SEARCH SHE HAD SIGNED.

I EXPLAINED TO HER THE NOTICES AND OPTIONS TO ASK HER HOW SHE HEAT HER HOUSE AT THAT TIME AND SHE SAYS SHE HAS A PROPANE HEATER.
