JULY 20 THE NOTICE OF CONDEMNATION WAS SENT TO THE ADDRESS OF RECORD FOR THE PROPERTY OWNER. JULY 24, THE SON OF THE OWNER RECEIVE THE NOTICES AND CAME INTO CITY HALL AND LOOK INTO GETTING THE PROPERTY PUT IN HIS NAME TO TRY TO SELL IT. AUGUST 11 WE SENT NOTICE OF CONDEMNATION TO THE PROPERTY OWNER THAT IS INCARCERATED. THE OWNER IS SPINNING A LIFE SENTENCE. THE NOTICE OF PUBLIC HEARING WAS POSTED ON THE STRUCTURE IN NOVEMBER 6 THE NOTICE OF HEARING WAS SENT TO THE PROPERTY OWNER. WE FOUND A WOMAN STAYING IN THE HOUSE AND INSTRUCT HER TO FIND ANOTHER PLACE TO STAY. JULY 21 WE FOUND ELECTRICITY HAD BEEN ILLEGALLY WIRED ON THE HOUSE AND SUPPLYING THE VAGRANT CAMP NEXT-DOOR. UPON DISCOVERING THE HAZARDOUS ELECTRICAL AP WAS CALLED OUT TO DETERMINE THE CONNECTION. JULY 20 THE AFFIDAVIT OF CONDEMNATION WAS SUBMITTED TO CLERK. THE NOTICE OF CONDEMNATION ON 3060 WAS SENT TO THE ADDRESS OF RECORD FOR THE PROPERTY OWNERS. SEPTEMBER 12 A CITY CONTRACTOR SECURED THE HOUSE. OCTOBER 26 WE POSTED A NOTICE OF PUBLIC HEARING ON THE STRUCTURE AND NOVEMBER 6 WE SENT NOTICE OF THE DECEMBER HEARING TO THE PROPERTY OWNER. AFTER THAT WE RECEIVED A PHONE CALL FROM THE PROPERTY OWNER AND HE STATED HE WANTED TO PULL A PERMIT AND REPAIR. OCTOBER 20 WE HADN'T HAD ANY FURTHER CONTACT FROM THE OWNER AND NO PERMIT HAS BEEN APPLIED FOR. OCTOBER 26 THE NOTICE OF PUBLIC HEARING WAS POSTED ON THE STRUCTURE NOVEMBER 6 A NOTICE OF HEARING WAS SENT TO THE PROPERTY OWNER AND NOVEMBER 15 WHEN WE LOOKED AT THE DEED FOR THE PROPERTY WE DISCOVERED IT MORE RESEMBLED A CONTRACT FOR SALE THAN A DEED ALTHOUGH WAS LABELED AS A WARRANTY DEED. BECAUSE OF THAT WE ARE SENDING NOTICES TO THE CURRENT OWNER AND PREVIOUS OWNER. THE RECORD. >> GOOD MORNING MY NAME IS PATRICK BATTEN AND I PURCHASED THREE PROPERTIES ON HOUSTON STREET ROUGHLY 3 YEARS AGO FROM THE COLLEGE FRIEND DAVID KILLIAN WHO INHERITED THE PROPERTIES FROM HIS FATHER WHO IS DECEASED. HIS COMPANY NAME WAS THE G GROUP. OF THOSE THREE PROPERTIES WE COMPLETELY REMODELED ONE OF THEM DOWN THE STREET AND SOLD IT THIS LAST YEAR. ANOTHER PROPERTY HE EVICTED THE TENANT THAT WAS THERE. IT IS A NICE RENTAL DOWN THE STREET SO WE ARE KIND OF CLEANING UP THE NEIGHBORHOOD. THAT BLOCK IS STRAIGHT ACROSS FROM BUNKIE BROTHERS AND HAS BEEN AN EYESORE FOR SOME TIME. THERE ARE SEVERAL PROPERTIES THERE THAT YOU HAVE DEALT WITH AND TAKING CARE OF. THIS PARTICULAR PROPERTY IN QUESTION, THE LADY THAT LIVED THERE WHEN I PURCHASED THE PROPERTY, SHE HAS A DISABLED ELDERLY ADULT CHILD AND SHE IS STRUGGLING. SHE WAS IN A RENT TO OWN AGREEMENT BEFORE I BOUGHT THE PROPERTY FOR $100 PER MONTH AND SHE WAS EIGHT MONTHS BEHIND IN RENT AT THE TIME. I HAD A HARD TIME KICKING HER TO THE STREET SO I TRIED TO HONOR WHAT WAS THERE.

SHE CAUGHT UP AND EVENTUALLY PAID THE LITTLE BIT OF RENT SHE OWED. AT THAT POINT I SAID I WOULD LIKE TO FIX THE PROPERTY.

I AM A CONTRACTOR AND I BEEN FIXING HOUSES IN THETOWN FOR 20 YEARS INCLUDING A CONDEMNED HOUSE ON NORTH THIRD THAT WAS ON THE CONDEMNED LIST FOR 30 YEARS. I GOT THAT ONE OUT AS WELL AS 15 OTHER HOUSES FOR THE LAST 20 YEARS AS FAR BACK WITH MR. PRINCE. I FINALLY GOT HER OUT OF THE PROPERTY AND WE HAD TO GO TO COURT. SHE APPEALED IT. IT WAS A LONG PROCESS AND THE JUDGE ACTUALLY WENT BACK AND DID THE PAPERWORK AND RULED THAT I WAS THE OWNER AND NOT HER. SHE QUIT PAYING RENT AND SAID SHE OWNED THE PROPERTY. IT HAS BEEN A NASTY ISSUE. SHE WAS A HOARDER AS YOU CAN SEE THROUGH SOME OF THE PICTURES.

SHE CLEANED SOME OF IT UP BUT IT WAS JUST A MESS. SINCE THAT TIME SHE MOVED OUT ONCE THE JUDGE TOLD HER TO BECAUSE SHE WAS BEING SO UGLY AND APPEALING IT AND WENT THROUGH THE EVICTION PROCESS AND I HAVE DONE THAT. I HAVE A CONSTRUCTION CREW SO I WORK WITH THE CONSTABLES PRETTY FREQUENTLY WHEN THEY HAVE SOME OF MY OTHER FRIENDS WHO OWN

PROPERTY AND THEY NEED A CREW TO COME IN AND REMOVE ALL THE ITEMS AND WE HAVE ONE HOUR TO DO IT. I HAVE DONE THAT A LOT.

THE NORMAL CONSTABLE WAS NOT AVAILABLE THAT DAY AND WE HAD A NEW FEMALE THAT WAS THERE. NO MATTER WHAT I DID I COULD NOT PLEASE HER. SHE SAID I HAD SO MUCH TIME AND I HAD NO PROBLEM.

I HAD SIX GUYS THERE WHO ARE BAD CONSTRUCTION GUYS WHO GO TO WORK AND SHE SAID YOU NEED MORE. OKAY SO I CALLED MORE.

I ENDED UP HAVING 10 TO 12 GUYS THERE AND WE ARGUED AN HOUR BEFORE SHE LET ME DO MY JOB. SHE GOT MAD AT ME. ELECTRICAL AND HOARDING CONDITIONS. AUGUST 25 WE HAD THE FIRST CONTACT WITH THE OWNER TO INQUIRE WHAT HIS PLANS WERE FOR THE PROPERTY AND OCCUPANTS. HE SAID HE WAS COMING TO TOWN TO LOOK AT THE PROPERTY AND EVICT THE TENANTS.

AUGUST 29 WE FILE THE AFFIDAVIT OF CONDEMNATION WITH COUNTY CLERK. DECEMBER 1 WE CONTACTED THE OWNER TO ASK ABOUT THE PLANS FOR THE OCCUPANTS. HE SAID HE WAS STILL WORKING ON IT AND THE OWNER WAS SENT THE CONDEMNATION NOTICE. SEPTEMBER 21 WE TALKED TO THE OWNER ABOUT RELOCATING OCCUPANTS AGAIN AND HE SAID HE WASN'T SURE HOW TO GO ABOUT THE EVICTION. HE SAID HE WOULD BE IN TOWN THE FOLLOWING WEEK TO MEET WITH US AND INFORM THE PLAN TO WHICH THE OWNER CANCELED THE MEETING.

OCTOBER 3. WE INSPECT THE PROPERTY AND FOUND AN INDIVIDUAL SLEEPING INSIDE OF A CARPORT. THE PROPERTY STILL HAS TWO OCCUPANTS AND THE OCCUPANTS TOLD US THE OWNER GAVE PERMISSION TO STAY AND THEY SHOULD REPAIR THE LEAK OBTAIN A REPAIR NOTICE FOR THE HOUSE. NOVEMBER 9 WE SENT NOTICE TO FOR VIOLATION OF OCCUPANCY OF THE CONTEMPT STRUCTURE. OCTOBER 11 WE SENT NOTICE OF NOVEMBER BOARD HEARING TO THE PROPERTY OWNER. NOVEMBER 1 WE TABLED THE CASE TO PROVIDE TIME FOR THE OWNER TO RECEIVE INSURANCE FUNDS.

IT INDICATES TO REPLACE THE WIRE TO THE MAIN AND METER RELEASE. MARCH 25 THE PROPERTY PAST THE ELECTRICAL INSPECTION AND THE METER WAS RELEASED. IT IS UNKNOWN IF THE OWNER MADE THE FIRE DAMAGE KNOWN TO THE

SEPTEMBER 6 OF 2023 THE OWNER OF THE STRUCTURE MADE IT KNOWN TO THE CODE OFFICER THAT THE HOUSE HAS HAZARDOUS ELECTRICAL WIRING IN THE STRUCTURE IS VACANT. THE UTILITIES WERE ALL ACTIVE AND PEOPLE ARE FREQUENTLY FOUND ON THE PROPERTY. OCTOBER 17 OF 2023 DUE TO THE OWNER NOT WANTING TO LET US INSIDE TO INSPECT AN ADMINISTRATIVE SEARCH WARRANT WAS SERVED. DURING THE INSPECTION MISSY MARSHALL DISCOVERED A SMALL BAG OF NARCOTICS IN THE TOILET. THE CITY MARSHALL CONFIRMED THAT THE STRUCTURE OCCUPANT OF THE SUBSTANCE WAS METHAMPHETAMINE.

THE HOUSE IS EXTREMELY UNSANITARY, INFESTED WITH INSECTS AND HAS STRAY CATS INSIDE. THERE WAS HAZARDOUS ELECTRICAL FOUND THROUGHOUT IN THE HOUSE HAS BEEN PROVIDING ELECTRICITY TO A SHED IN THE REAR THAT APPEARS TO BE LIVING QUARTERS. OCTOBER 19 2023 AFTER WE CONFIRMED MULTIPLE TIMES THE PROPERTY OWNER THE HOUSE WAS NOT LIVED IN THE PROPERTY WAS CONDEMNED AND THIS WAS RECORDED WITH COUNTY CLERK.

OCTOBER 19 WE RECEIVED A PHONE CALL FROM PROPERTY OWNERS AND SHE WAS INFORMED OF THE CONDEMNATION AND INFORMED THAT NO ONE HAD LIVED IN THE HOUSE OR SHED AND UTILITIES WOULD BE CUT OFF BY THE CITY. SHE HAS TOLD CODE ENFORCEMENT IN THE PAST THAT NO ONE RESIDES IN THE HOUSE AND HER SON ONLY GOES TO THE HOUSE TO MAKE SURE NO ONE IS STEALING ANYTHING FROM THE PROPERTY. OCTOBER 20 A NOTICE OF CONDEMNATION WAS SENT TO THE PROPERTY OWNER. THERE HAVE BEEN 26 CODE ENFORCEMENT CASES PHERE GOING BACK TO 2018 AND CURRENTLY 10 ACTIVE CODE ENFORCEMENT CASES. OCTOBER 24 WE RECEIVED A COPY OF THE FINAL REPORT OF THE PHOTO SHOWING THE RESULTS OF THE FIRE THAT OCCURRED IN MARCH 2022. THE PHOTO SHOWED FIRE DAMAGE, ELECTRICAL AND FIRE HAZARDS THROUGHOUT THE HOUSE. OCTOBER 26 WE POSTED THE CONDEMNATION SIGN AND PUBLIC NOTICE OF THE DECEMBER BOARD HEARING ON THE STRUCTURE. WE SPOKE TO THE PROPERTY OWNER BY PHONE AND EXPLAIN THE ACTION OF THE PROCESS AND BOARD HEARING. NOVEMBER 15 WE MET WITH THE PROPERTY OWNER AT CITY HALL TO EXPLAIN CONDEMNATION. SHE ASKED ABOUT THE APPEAL PROCESS AND DID HANDWRITTEN APPEAL AT CITY HALL WHICH I INCLUDED A COPY OF. THE STAFF RECOMMENDATION IS TO FIND A PORTION OF THE BUILDING SUBSTANDARD AND DILAPIDATED AND UNFIT FOR HUMAN OCCUPANCY AND THEREFORE CONDEMNS DUE TO THE FOLLOWING CONDITIONS THAT EXIST A HAZARD TO THE PUBLIC HEALTH SAFETY AND WELFARE, FAULTY WEATHER PROTECTION, HAZARDOUS ELECTRICAL WIRING, INADEQUATE SANITATION, STRUCTURAL HAZARDS AND NUISANCE CONDITIONS. ALL HAZMAT MATERIAL, CLEANED IT UP, MADE THEM MOVE THE CARS. AND BY THE END OF THE NIGHT ALL THAT STUFF IS RIGHT BACK THERE ON THE STREET. THE LAW DOES NOT APPLY TO THEM. WE HAVE THEIR GREAT-NEPHEW WHO ACTUALLY WANTS THE PROPERTY AND THE POSSIBILITIES OF DEVELOPING IT IN THE FUTURE. BUT WHAT WE ARE BASICALLY ASKING IS THERE IS NO QUESTION ABOUT THE CONDITION OF THE PROPERTY AND IT SHOULD BE CONDEMNED AND ABOLISHED. FIRST OFF WE HAD 56 NEW CONDEMNATION CASES OF TWO FROM LAST YEAR. 235 DILAPIDATED STRUCTURE CASES WITH THE 441 LAST YEAR AND WE EXPECTED THAT WITH THE NEW PROGRAM THAT WE HAVE ONLINE FOR THAT TO GO DOWN BECAUSE THOSE DILAPIDATED STRUCTURES TURNED INTO CONDEMNED PROPERTIES OR WE HAD INSPECTIONS OTHER INSPECTIONS ON THEM. WE HAD 56 CASES COMPLETED WITH 18 MORE THAN LAST YEAR. 55 BEFORE THE BUILDING STANDARDS. THAT'S FOUR MORE THAN LAST YEAR. 22 RESOLVED WITHOUT GOING TO THE BOARD OF BUILDING STANDARDS AND THAT IS A GOOD NUMBER BECAUSE WE RESOLVE THOSE ISSUES BEFORE YOU HAD TO HEAR THEM HERE. 14 CITY FUNDED DEMOLITIONS AND 14 CBDG THAT'S FEDERALLY FUNDED WITH THREE OWNER CONSENT TO DEMOLISH. THE AVERAGE COST IS ABOUT 68, 63, 78, 63 PER PROPERTY AND THAT'S THE SAME AS LAST YEAR. A LITTLE HIGHER BUT THE SAME. THE BIG ONE IS WE HAD 10 OWNERS REPAIR THE STRUCTURE AND NINE DEMOLITIONS BY THE OWNER DOUBLE OF WHAT THEY HAD LAST YEAR.
