SEPTEMBER 9, 2022, THE BUILDING WAS CONDEMNED. OCTOBER 32,022, THE CONDEMNATION NOTICE AND LETTERS WERE SENT TO THE PROPERTY OWNER. OCTOBER 7, 2022, WE RECEIVED A CONDEMNATION APPEAL. BUT OUR CONCERN HERE IS WE NEVER SEEM TO GET TO THE END OF THIS. AND THE LAST TIME YOU HEARD THIS, IN THE MINUTES OF THE MEETING, WHICH WAS A YEAR AGO, SEPTEMBER 6, 2023 , YOU OPENED THIS FOR PUBLIC HEARING AND A REPRESENTATION WAS MADE , I DON'T THINK BY THE OWNER, BUT A REPRESENTATIVE OF THE OWNER, THAT THIS PROPERTY COULD BE -- THEY WERE TRYING TO GET A DEAL CLOSED IN HOUSTON , IF YOU WILL REMEMBER. SO FOR THE LAST THREE MONTHS PLUS, IT, IN EFFECT, HAS BEEN ABNDONED, IF YOU WILL. BECAUSE ACCORDING TO THAT POLICE PRESENCE , ACCORDING TO THAT OFFICER, THEY HAD RECEIVED SOME ANONYMOUS VANDALISM THREATS AGAINST THIS PROPERTY , AND IN KIND OF A VEILED WAY, AND SOME INFORMATION THAT THE WORKERS ON THIS PROPERTY WALKED OFF, BECAUSE THEY CAN'T GET PAID.

WE REACHED OUT TO THE OWNER TO PROVIDE US WITH AN UPDATED PLAN OF ACTION WITH ALL THE NEW CONTRACTOR'S INFORMATION AND YOU COST ESTIMATES. JULY 2ND, 2024, NO NEW PLAN OF ACTION HAVE BEEN SUBMITTED TO US. THE SAME CONTRACTOR CAME INTO CITY HALL TO SUBMIT A PERMANENT APPLICATION. THE APPLICATION LISTED SUBCONTRACTORS THAT WERE NOT LISTED WITH THE CITY. THE SUBCONTRACTORS DID NOT COME INTO GOOD CREDENTIAL. THE OWNER WAS CONTACTED AND EXPLAIN AGAIN WHY THE CONTRACT COULD BE ISSUED. JULY 32,024, THE OWNER WAS IN ATTENDANCE AT THE HEARING. THE OWNER ACKNOWLEDGED DURING THE HEARING THAT NO RULING COULD TAKE PLACE ON THE HOUSE UNTIL THE PERMIT WAS APPROVED. THE OWNER STATED THAT AFTER THE HEARING, THAT SHE WOULD GO TO THE PROPERTY TO ENSURE NO CLEANING WAS TAKING PLACE. LATER THAT SAME DAY, A STOP WORK ORDER HAD TO BE POSTED . AUGUST 14TH, 2024, THE NOTICE WAS SENT TO THE PROPERTY OWNER. AUGUST 16TH, '24, WE SPOKE WITH THE GENERAL CONTRACTOR THAT WAS LEAVING THE WORK. WE EXPLAIN THE PLAN OF ACTION IN THE PERMITTING PROCESS TO HIM. HE ASKED IF HE COULD CLEAN THE INSIDE OF THE STRUCTURE. COMMITTED TO HIM THAT ALL HE COULD DO WAS CLEAN UNTIL THERE WAS AN ACTIVE PERMIT. AUGUST 20TH OF 2024, WE FIND A GENERAL CONTRACTOR, A WORKER WITH INSTALLATION. FEBRUARY 7TH OF DECKING AT 24, RECEIVED MULTIPLE COMPLAINTS FROM ADJACENT PROPERTY ABOUT THE QUALITY OF THIS AFTER THE HOUSE FIRE. THE PROPERTY IS HAZARDOUS AND SHOULD BE CONDEMNED. IT HAS BEEN COMPLETELY GUTTED AND FIRE DEBRIS HAS BEEN PILED UP OUTSIDE OF THE HOUSE. FEBRUARY 8TH OF '24, AFFIDAVIT OF CONDEMNATION WAS FILED WITH THE COUNTY CLERK. FEBRUARY 8TH OF DECKING MY 24, SENT INITIAL NOTICE OF CONDEMNATION AND 3060 LETTERS TO THE PROPERTY OWNER VIA REGULAR AND CERTIFIED MAIL. MARTHA H OF DECKING 24, I SPOKE WITH A GENTLEMAN WHO WAS IN THE PROCESS OF PURCHASING THIS PROPERTY. THE CLOSING DATE FOR THIS SALE WAS SCHEDULED FOR APRIL 5TH OF DECKING 24. APRIL 4TH OF DECKING 24, SPOKE WITH A MEMBER OF THIS RESIDENCE WHO ADVISED ME THE SALE IS NOT GOING TO HAPPEN. I SPOKE WITH THE INDIVIDUAL WHO WAS GOING TO BUY THE PROPERTY, AND HE SAID THE OWNER BACKED OUT OF THE DEAL. APRIL 5TH OF '24, I WAS ABLE TO LOCATE ONE OF THE SONS OF THE OWNER WHO GAVE HIS FATHER'S PHONE NUMBER. I SPOKE WITH DANIEL ESPARZA AND ASKED WHAT HIS INTENTIONS WERE FOR THIS PROPERTY. HE TOLD ME HE WANTS TO RENOVATE IT. I EXPLAINED THAT HE WOULD HAVE TO SUBMIT PERMITS AND COST

ESTIMATES BEFORE ANY WORK COULD BEGIN. I TOLD HIM HE NEEDED TO CLEAN THE PROPERTY IMMEDIATELY AND MAINTAIN THE PROPERTY AT ALL TIMES. HE TOLD ME HE WOULD WORK ON GETTING THE PROPERTY CLEANED UP, BUT IT WOULD TAKE A WEEK OR SO. APRIL TACKETT 22ND OF DECKING MY 24, I SENT IT OUT TO CONTRACTORS FOR BID FOR THE CLEANUP ABATEMENT. MAY 20TH OF 2024, THE ABATEMENT DIDN'T BEGIN UNTIL THAT DAY. FINISHED ON MAY 23RD 2024, $895 FOR THE CLEANUP. JUNE 24 2024, BOCA JORGE LUIS, WHO IS ATTEMPTING TO PURCHASE THIS PROPERTY. HE SAID HE IS HAVING A HARD TIME GETTING THE HOMEOWNERS TO COMPLETE THE NECESSARY PAPERWORK TO COMPLETE THE SALE. IN AUGUST, THE OWNER OF THE PROPERTY BACKED OUT OF THE SALE AS WELL, AND I STILL HAD NOT HAD ANY CONTACT FROM THE OWNERS. AUGUST 13TH OF DECKING MY 24, POSTED NOTICE OF SEPTEMBER HEARING ON THE STRUCTURE. ON AUGUST 19TH, I WENT TO CHECK ON THIS HOUSE, SINCE I FOUND A DOG CHAINED UP ON THE BACK PATIO THE WEEK BEFORE. I WAS FOLLOWING UP TO SEE IF THE DOG WAS STILL THERE.I OBSERVED A MALE SUBJECT INSIDE THE HOUSE. HE IDENTIFIED HIMSELF AS DANIEL GARCIA JR., ONE OF THE OWNERS. THE MINOR OWNER OF THE PROPERTY. HE TOLD ME THAT IT WAS HIS DOG AND HE CURRENTLY HAD NOWHERE TO KEEP HIM. HE RECEIVED A NOTICE FROM ANIMAL OUTREACH REGARDING THE DOG BEING CHAINED UP ON THE BACK PATIO, SO REMOVE THE DOG INTO THE BACK BEDROOM OF THE HOUSE. THERE WAS A VEHICLE THAT WAS PARKED IN THE FRONT OF THE HOUSE AND HE TOLD ME THAT WAS HIS FATHER IN THE VEHICLE.
DANIEL GARCIA IS HIS FATHER, AND THE OTHER LISTED OWNER OF THE PROPERTY. HE TOLD ME THEY WERE STILL TRYING TO SELL THE PROPERTY AND THEY HAD A POTENTIAL BUYER. I ASKED WHY THEY BACKED OUT OF THE OTHER TWO DEALS OF THE LAST MOMENT, AND HE SAID THEY WEREN'T GETTING PAID ENOUGH FOR THE PROPERTY. HE STATED HE TURNS 18 IN A FEW MONTHS AND THEY WOULD BE ABLE TO COMPLETE THE SALE AT THAT TIME. THE STAFF RECOMMENDATION IS TO FUND THE PROPERTY AS A PUBLIC NUISANCE AND THAT IS A HAZARD TO THE REPAIR OF THE STRUCTURE WOULD BE UNREASONABLE. THE OWNER'S ORDER TO DEMOLISH OR APPEAL WITHIN 30 DAYS OR THE CITY MAY DEMOLISH.
