IN MONEL VERSUS THE DEPARTMENT OF SOCIAL SERVICES, THE U.S. RULED THAT CITIES CAN BE HELD LIABLE UNDER 1983 WHEN THEIR POLICIES OR INACTION LEAD TO CONSTITUTIONAL VIOLATIONS. THAT'S EXACTLY, OR EXCUSE ME, AND IN BARR VERSUS CITY OF SENTEN, THE TEXAS SUPREME COURT RULED THEY CANNOT SHOW RELIGIOUS PROGRAMS WHEN PARTICIPATION IS NOT VOLUNTARY. SO AT THAT POINT IN TIME, THE LEASES HAD NOT BEEN FULLY EXECUTED ON ALL EIGHT BUILDINGS. SO THE TAX ABATEMENT THAT YOU ALL APPROVED OF IN FEBRUARY WAS ANTICIPATING THAT THOSE INDIVIDUAL BUILDINGS WOULD HAVE INDIVIDUAL LEASES WITHIN THEM, SO WE WOULD COME FORWARD AT A LATER DATE TO HAVE AMENDED TAX ABATEMENT AGREEMENTS THAT WOULD FOLLOW ONE AGREEMENT PER BUILDING. WE DO HAVE THOSE, LEASES EXECUTED, AND IT IS PART OF THEIR AGREEMENT FOR THE LESSEE TO HAVE THE BENEFIT OF THIS FINANCIAL INCENTIVE. TO REMIND YOU, THIS IS NOT CHANGED FROM WHAT WAS AGREED PRIOR. THE TAX ABATEMENT IS 85% OF THE TAX IMPROVEMENTS CONSTRUCTED ON THE LEASE PARCEL, REPAIRS TO THE FACILITY, OWNED BY THE LESSEE FOR A PERIOD OF 10 CONSECUTIVE YEARS. THERE IS A SECOND 10 CONSECUTIVE YEARS FOLLOWING, AND AGAIN, THIS WAS WHAT WAS APPROVED BY COUNCIL BACK IN FEBRUARY. SO THERE ARE TWO TEN YEAR ABATEMENTS ON EACH OF THESE TRACKS. THE AGREEMENTS MIRROR THE ORIGINAL AGREEMENT. THERE ARE A FEW CLARIFICATIONS. THERE ARE NOT SUBSTANTIVE CHANGES, BUT WE WANT TO MAKE SURE YOU FULLY ARE AWARE OF THOSE CHANGES. ONE IS THE EMPLOYEE ALLOCATION. WE HAVE ALLOWED NEW LANGUAGE THAT WOULD ARTICULATE FULL TIME EMPLOYEES THAT ACTUAL SPLIT TIME BETWEEN BUILDINGS TO BE ABLE TO COUNT THAT TIME AS A FRACTIONAL TIME FOR EACH BUILDING, IN THE REINVESTMENT ZONE. IT'S STILL A FULL TIME EMPLOYEE FOR 2,800 HOURS ANNUALLY. THERE'S NO REDUCTION IN THE NUMBER OF EMPLOYEES. SO FOR BUILDING 1-2, THAT'S 57 EMPLOYEES. THE COMMENCEMENT DATES FOR ALL OF THE BUILDINGS HAVE ALSO BEEN ADDED, WHICH IS HELPFUL TO THE CITY SO WE KNOW WHEN THOSE BUILDINGS SHOULD BEGIN CONSTRUCTION AND THE IDEAL DATE AT WHICH THEY WILL BE COMPLETED. THERE'S ALSO A DEFAULT IS IT CLARIFIES THAT THE TENANT, OR ASSIGNEE WOULD NOT BE PENALIZED BY THE DEFALTER OR THE LESSEE. THIS DOES NOT CHANGE THE COMMITMENT TO THE CITY, IT JUST CLARIFIES WHO IS OR IS NOT RESPONSIBLE. THEN LEGALIZED LEGAL DESCRIPTIONS FOR BUILDINGS THREE THROUGH EIGHT HAVE REPLACED PREVIOUS PROXIMATATIONS. IT FULLY ARTICULATES THE LEGAL DESCRIPTION OF EACH OF THOSE BUILDINGS.
