[CONSENT AGENDA]

AGENDA CONSISTING OF ITEMS 2 THROUGH ITEM NUMBER TEN.

ALL ITEMS LISTED ON THE AGENDA WILL BE CONSIDERED WITH ONE MOTION AND THERE WILL BE NO SEPARATE DISCUSSION UNLESS -- DOES ANYONE ON THE COUNCIL WISH TO DISCUSS EACH ITEM SEPARATELY? DOES ANY CITIZEN WISH TO HAVE ANY ITEM ON THE CONSENT AGENDA CONSIDERED INDIVIDUALLY. IF SO, PLEASE DIAL STAR 9 ON YOUR PHONE TO LET THE SECRETARY KNOW THE THAT YOU WOULD LIKE TO

[00:05:03]

PULL THAT ITEM.

THERE'S ONE HAND RAISED. >> DAVID SCHWARTZ.

>> AND WHICH NUMBER, DAVID? >> SORRY.

I MUTED HIM. HE SAID ITEM THREE.

>> ITEM THREE. ANY CITIZEN WANT TO PULL AN ITEM

OFF THE CONSENT AGENDA? >> NO.

THAT IS THE ONLY HAND I SEE. >> SO I'LL CLOSE THE PUBLIC HEARING. AND I'LL ASK IS THERE A MOTION AND SECOND FOR ITEMS 2 THROUGH ITEM TEN WITH THE EXCEPTION OF ITEM THREE? IS THERE A MOTION FROM THE COUNCIL?

>> I CAN'T UNMUTE. OH.

MOTION. >> YES.

>> SO MOVED OR SECOND EITHER ONE.

>> SO WE HAVE A MOTION BY COUNCIL WITH THE EXCEPTION ON ITEM NUMBER THREE.

>> I DON'T BELIEVE COUNCILMEMBER CRAVER IS ON HERE.

[3. Resolution: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on Awarding Bid No. 2050 to Siemens Mobility, Inc. for Ridgemont Drive and Rolling Green Drive Traffic Signal Project (Greg McCaffery)]

MOTION CARRIES. >> WE'LL NOW MOVE TO ITEM NUMBER THREE. AND IF YOU MR. SCHWARTZ, ALLOW HIM TO ASK THE QUESTION HE HAS CONCERNING ITEM NUMBER THREE.

>> THANK YOU, COUNCIL. DAVID SCHWARTZ FOR THE RECORD AT THIS TIME JUST WANT TO PRAISE OUR PUBLIC WORKS DIRECTOR GREG MCCALF IF I AND THE STREET MAINTENANCE JOB FOR DOING SUCH A FINE JOB AND THIS WILL BE A GREAT ADDITION OUT IN THE MALL AREA WITH THE NEW TRAFFIC SIGNAL SYSTEM THERE AT ROLLING GREEN AND THE MALL ENTRANCE. IT'S A SHAME IT COULD NOT HAVE BEEN PUT IN WHILE THE MALL WAS STILL SHUTDOWN FOR THE VIRUS SITUATION BUT ACCORDING TO DOCUMENTATION I.T. SAID IT WOULD TAKE ABOUT 40 DAYS TO COMPLETE AND I'M DEFINITELY FOR THIS ITEM. I CAN ALREADY SEE THERE WAS SOME PREWORK DONE OUT THERE WHEN THEY DID THE RECONSTRUCTION ON RIDGEMONT AND I APPRECIATE AGAIN OUR PUBLIC WORKS DIRECTOR AND THE FINE WORK FOR THE STREET MAINTENANCE BOARD.

THANK YOU VERY MUCH, COUNCIL, THIS MORNING.

>> THANK YOU, MR. SCHWARTZ. >> THIS DOES COUNCIL HAVE ANY DECISIONAL QUESTIONS UPON THIS PERTAINING TO ITEM NUMBER THREE? IF NOT, I'LL ACCEPT A MOTION AND A SECOND.

>> SO MOVED BY COUNCILMAN PRICE. >> WE HAVE A MOTION.

>> AND A SECOND BY COUNCILMAN RICK.

FULLY FURTHER DISCUSSION? WE'RE READY TO VOTE.

>>

[11. Resolution: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on approving the Revised Development Corporation of Abilene, Inc.'s Budget for FY 19-20. (Misty Mayo)]

>> MOTION CARRY SGLAEZ WE'LL NOW MOVE TO ITEM NUMBER 11.

I WILL ASK THE CEO TO PRESENT THIS ITEM.

WE'LL NOTATE WHILE SHE'S COMING ON.

IF A CITIZEN WANTS TO SPEAK IN PUBLIC HEARING PLEASE CALL THE NUMBER AND PASS CODE AND WHEN IT'S OPENED UP, WILL YOU HAVE

THIS TAUNT OPPORTUNITY. >> THANK YOU, MAYOR.

COUNCIL MEMBERS, AND CITY MANAGER HANNAH.

WE CERTAINLY APPRECIATE THE OPPORTUNITY TO PRESENT THESE TWO ITEMS ON THE AGENDA. THAT MIGHT NEED RELIEF FROM THE

[00:10:02]

RECESSION FROM THE IMPACTS OF COVID-19.

YOU'LL ALSO NOTE IN THE NEW BUDGET UPDATE THAT WE'RE LOOKING AT ADDING A TREMENDOUS AMOUNT OF SOFTWARE.

THIS HAPPENS TO BE A TERRIFIC TIME.

WE'RE CERTAINLY TAKING ADVANTAGE OF THE OPPORTUNITY FOR FOLKS TO BE IN THE OFFICE AND DO SOME THINGS THAT WE NORMALLY WOULD NOT BE ABLE TO DO WITH A TEAM THAT TRAVELS EXTENSIVELY.

SO WE'RE TAKING ADVANTAGE OF THAT BUT IT DOES REQUIRE A BUDGET UPDATE WHICH WOULD BE A REAL ESTATE SEARCH ENGINE ON OUR WEBSITE AS WELL AS SOME WEBSITE UPGRADES AND A NEW GIF GRAPHIC SOFTWARE AS WELL AS A CUSTOMER MANAGEMENT SYSTEM CALLED SALESFORCE. IT'D ALSO INCLUDES THE SALE OF VINE STREET WHICH YOU ALL APPROVED ABOUT SIX WEEKS AGO AND THAT SALE WAS FINAL AT THE END OF APRIL.

SO YOU WILL SEE SOME OF THAT NOTED AS WELL AS TWO OF OUR THREE BUILDINGS THAT WILL MEET PROJECT THRESHOLD WHICH IS BAVARIAN AND PROJECT ISO. THAT IS A FIRE SUPPRESSION SYSTEM AND SOME OTHER MAINTENANCE REQUIRED IN ORDER TO PREPARE THOSE BUILDINGS FOR SALE.

NOW, THE LAST ITEM THAT YOU'LL NOTE ON THE SLIDE IS ADDITIONAL PROJECTS THAT WE ARE ABLE TO ADD DUE TO STREAM LINING AND EFFECTIVENESS FOR CAPACITY WOULD BE PREPARING THE THIRD BE VACATED. BY CONTRACT THEY'LL VACATE BY SPRING OF NEXT YEAR BUT THEY'RE IN THE PROCESS OF MOVING OUT RIGHT NOW AS WELL AS MAINTENANCE ON SOME OF THE FACILITIES OF THE DCOA OWNS AT THE AIRPORT. THE DCOA RESOLUTION FOR THIS BUDGET AMENDMENT DOES INCLUDE SOME ADDITIONAL CONSIDERATIONS FOR STAFF AND REALIGNMENT. THAT IS NOT SOMETHING I'M ASKING YOU TO CONSIDER TODAY. I'M JUST TELLING YOU THAT THEIR RESOLUTION LOOKS SLIGHTLY DIFFERENT.

WE ARE COMMITTED, THE DCOA BOARD IS COMMITTED ONNING THE 21ST OF MAY FOR THEIR BOARD MEETING TO ADDRESS SOME OF THE NEW BUDGETED ITEMS ANDLY BE PREPARED TO BRING THEM TO COUNCIL FOR ADDITIONAL CONSIDERATION EITHER IN JUNE OR JULY VERY SHORTLY THIS SUMMER.

SO I THINK AT THIS POINT I'VE HIGHLIGHTED THE KEY POINTS THAT ARE UPDATES IN THE BUDGET BUT I'M CERTAINLY OPEN FOR

QUESTIONS. >> THANK YOU SO MUCH, MS. DAVIS.

>> DOES DOWN AS A RULE ANY QUESTIONS OR QUESTIONS PRIOR TO THE PUBLIC -- COMMENTS OR QUESTIONS PRIOR TO THE PUBLIC

HEAR SNOWING. >> I HAD ONE I WANTED TO FOLLOW UP ON. 172 HAS THE $4 MILLION FOR JUST POTENTIAL PROJECTS. I KNOW 3 MILLION OF THAT IS FOR WHAT THE BOARD HAS APPROVED BUT THERE'S ANOTHER MILLION DOLLARS THAT COMES ACROSS TO ME AS A BLANK CHECK SO HELP ME UNDERSTAND WHAT THIS MEANS, X MILLION DOLLARS IS FOR.

>> WELL AND COUNCILMEMBER PRICE, I CERTAINLY APPRECIATE THAT QUESTION BECAUSE IT'S IMPORTANT TO CLARIFY TO EVERYONE THAT BY OUR BYLAWS AND OUR STATUTE WITH THE CITY, THE DCOA BOARD, ONCE THEY APPROVE A PROJECT, IF THE PROJECT IS IN EXCESS OF $250,000, IT MUST COME TO CITY COUNCIL FOR CONSIDERATION AND VOTE. SO IN NO WAY IS THAT INTENDED TO BE A BLANK CHECK BECAUSE THE PROCESS OF APPROVAL IS STILL IN

[00:15:01]

PLACE. THAT DOES NOT NEGATE THAT WHATSOEVER. WHAT THAT IS, IS THE ANTICIPATION OF SEVERAL PRODUCTS THAT WE HAVE TEED UP -- PROJECTS THAT WE HAVE TEED UP THAT MAY NEED INCENTIVES.

SO IT'S A WAY TO BUDGET AND FUTURE FORECAST WHAT MIGHT BE NEEDED BETWEEN NOW AND IF END OF SEPTEMBER.

AND I JUST SAY THAT TO REMIND THE PUBLIC THAT WE'RE TALKING ABOUT MONEYS THAT WERE DEDICATED FROM OCTOBER 2019 THROUGH THE END OF SEPTEMBER 2020. SO WE HAVE SOME WAY OF ANTICIPATING PROJECTS THAT MIGHT BE COMING UP BY THE END OF

SEPTEMBER 2020. >> OKAY. BUT WE ARE APPROVING PROJECTS LIKE THIS BUDGET APPROVAL IS A RESOLUTION SO IT'S IN ONE MEETING SO IT CAN BE DONE QUICKLY AND WHEN WE APPROVE PROJECTS, THERE ARE PROJECTS ON HERE THAT WE'RE NOW APPROVING THE FUNDING FOR THAT THE PROJECT WAS ALREADY APPROVED BY THE COUNCIL SO I GUESS I'M STILL NOT CLEAR WHY WE NEED TO APPROVE AN EXTRA MILLION DOLLARS THAT'S NOT EARMARKED FOR ANYTHING EXCEPT

SOME FUTURE POSSIBILITY. >> THERE ARE CASES WHERE THE BOARD IS FUNDING PROJECTS THAT ARE NOT IN EXCESS OF $250,000 AND IN ORDER FOR THEM TO BE ABLE TO DO THAT, THEY HAVE TO HAVE FUNDING THAT'S BUDGETED FOR IT. OTHERWISE, WE'RE COMING BACK TO COUNCIL FOR EVERY 30 OR 40 OR $50 INCREMENTAL AMOUNT.

WHATEVER THAT IS. WE ARE THEN OBLIGATED TO COME BACK TO THE COUNCIL FOR THOSE INDIVIDUAL APPROVALS SO IF WE HAVE A PROJECT THAT THE DCOA BOARD CAN CONSIDER AND LET'S SAY IT'S $60,000, IT'S NOT IN THE BUDGET THEN WE'RE GOING TO HAVE TO COME BACK TO COUNCIL FOR IT TO BE IN THE BUDGET.

SO THAT IN ESSENCE IS SAYING THAT THE DCOA BOARD DOESN'T HAVED AN AUTHORITY UP TO $250,000.

THEY WOULD THEN HAVE TO COME BACK FOR EVERY INDIVIDUAL PROJECT. SO IT REALLY IS A WAY AND NOW REMEMBER I WANT TO REMIND EVERYONE THAT WE'RE TALKING SPECIFICALLY ABOUT THE ABILITY TO ATTRACT AND ENSENT -- INCENTIVIZE COMPANY EXPANSION SO WE'RE NOT TALKING ABOUT PROJECTS AS IN ROADWAYS OR OTHER THINGS THAT THE DCOA HAS INCLUDED IN THE BUDGET. THIS PARTICULAR ITEM IS PROJECTS AND INCENTIVES RELATED TO COMPANY EXPANSION.

>> BUT THAT'S NOT BEEN THE CASE IN THE PAST.

WHEN THE BOARD HAS APPROVED EXPENDITURES, THAT'S BEEN PRESENTED DURING THE SEMIANNUAL REPORT DURING THE BUDGET APPROVAL PROCESS, I GUESS I'M -- I'M JUST TRYING TO UNDERSTAND WHY THIS CHANGE IS TAKING PLACE WHERE WE'RE HAVING TO APPROVE SOMETHING WITHOUT ANYTHING TIED TO IT WHEN IN THE PAST IT'S ALWAYS BEEN THE BOARD IS APPROVED ALL THE OF THESE DIFFERENT PROJECTS LIKE NEXT UNIVERSITY AND THE ALL KINDS OF THINGS THAT ARE LISTED IN THERE THAT AFTER THE FACT SINCE THEY WERE BELOW THE 250 WE JUST APPROVED A REVISED BUDGET THAT WE KNEW THIS WENT TO THAT AND THIS WENT TO THAT PROJECT AND WE

HAD ALL THE DETAILS. >> SO SOME OF THAT REALLY IS -- IT'S -- IT REALLY IS THE SAME EXACT THING WITH THE EXCEPTION THAT IT'S A MATTER OF THE WAY IN WHICH WE'RE DOING BUSINESS SAYING UP FRONT TO YOU THAT WE ANTICIPATE WE HAVE PROJECTS THAT NEED TO BE FUNDED VERSUS FUNDING THE PROJECTS AND COMING BACK TO YOU AND TELLING YOU THAT WE FUNDED THEM.

SO WE'RE JUST ASKING FOR THE UP FRONT ABILITY TO DO THAT.

IT'S A MATTER OF THE WAY THAT WE ARE DOING BUSINESS UNDER MY LEADERSHIP VERSUS THE FORMER LEADERSHIP.

I UNDERSTAND YOUR POINT THAT IT APPEARS THAT WE'RE DOING BUSINESS WITHOUT THE APPROVAL OF THE COUNCIL BUT WE'RE RECEIVING APPROVAL OF THE COUNCIL BASED ON THE BYLAWS AND BASED ON THE

TEXAS LEGISLATIVE CODE. >> OKAY. THANK YOU.

>> YOU'RE WELCOME.

>> THANK YOU, COUNCILMAN PRICE. ANY OTHER QUESTIONS OF THE COUNCIL PRIOR TO THE PUBLIC HEARING? AT THIS TIME, I'LL OPEN UP THE PUBLIC HEARING.

IS THERE ANYONE WHO WOULD LIKE TO SPEAK EITHER FOR OR AGAINST THIS ITEM? IF SO, PLEASE DIAL STAR 9 ON YOUR PHONE TO LET US KNOW YOU WOULD LIKE TO SPEAK AND WILL YOU BE UNMUTED.

WHEN YOU HEAR YOU'VE BEEN UNMUTED PLEASE STATE YOUR FULL NAME CLEARLY FOR THE RECORD.

[00:20:03]

>> IS ANYONE ON THE LINE? >> YES, SIR.

>> CAN YOU HEAR ME? DAVID SCHWARTZ.

>> YES, I CAN. >> THANK YOU.

I'M WITH COUNCILMAN PRICE ON THIS.

I DON'T LIKE THE IDEA -- SOUNDS LIKE WHAT THEY'RE TRYING TO DO IS RAT HOLE A MILLION DOLLARS BECAUSE THEY KNOW THEIR BUDGET IS FIXING TO TAKE A BIG HIT BECAUSE IF YOU'VE BEEN OUT ANY TIME AT ALL IN THE LAST MONTH AND A HALF TO TWO MONTHS, YOU WERE SAYING -- YOU HAVE SEEN THE MALL IS SHUT DOWN.

THE SHOPS OF ABILENE SHUT DOWN. THAT'S THAT HALF CENT SALES TAX AND EVEN THOUGH WE'RE STILL GOT ABOUT TWO QUARTERS OR SO MAYBE TWO AND A HALF QUARTERS LEFT AND THIS YEARS SALES TAX THEIR BUDGET IS GOING TO TAKE A BIG HIT AND I'M WITH COUNCILMAN PRICE ON THAT ABOUT I DON'T LIKE THE IDEA OF SAYING WELL JUST GIVE US A MILLION DOLLARS OKAY AND WE'LL SPENDS IT THE WAY WE WANT TO. IT'S THE TAXPAYER'S MONEY AND THAT SALES TAX IS GOING TO BE PRETTY HARD TO COME BY AND WE DON'T KNOW WHICH THIS COVID-19 SITUATION WILL ENDS.

I INITIALLY SAID TO SOME FRIENDS MAYBE JULY 3RD WE'LL GET THE COUNTRY BACK GOING AGAIN BUT I'M BEGINNING TO WONDER IF WE'RE GOING TO EVEN GET IT GOING BEFORE THE END OF THIS FISCAL YEAR WHICH IS AT THE END OF SEPTEMBER BUT I WOULD DEFINITELY VOICE MY OPPOSITION OF JUST HAVING WE'LL NEED A MILLION EXTRA DOLLAR TO JUST HAVE IT AVAILABLE WITHOUT ANY SPECIFIC EARMARKING FOR IT. SO THANK YOU, COUNCILMAN PRICE, FOR BRINGING THAT SUBJECT UP. I'LL TURN IT BACK TO YOU, COUNCILMAN AND MAYOR WILLIAMS. THANK YOU.

>> THANK YOU. ANYONE ELSE ON THE LINE?

>> NO, SIR, THERE'S NOBODY ELSE. >> I WILL CLOSE THE PUBLIC HEARING AT THIS TIME. I'LL INVITE MISTY MAYO BACK TO ADDRESS A DIFFERENT ISSUE FOR CLARITY IN REGARDS TO THE BYLAWS. ANY AMOUNT THAT IS SPENT BY THE DCOA EXCEEDING $250,000 IS BROUGHT BACK FOR THE COUNCIL FOR APPROVAL. THE A LOTMENT OF THE MILLION DOLLARS AS A SET ASIDE FOR OTHER INCENTIVES STILL HAS TO GO THROUGH THE BOARD OF THE DCOA. MY UNDERSTANDING FROM THE PAST IS THAT THOSE THINGS ARE -- THOSE DECISIONS FOR THOSE INCREMENTS THAT ARE LESS THAN 250 HAVE BEEN APPROVED BY THE BOARD AND THEN MONEY BEING ALLOCATED AND THIS REGARD -- IN THIS MODEL A SPECIFIC AMOUNT WE IDENTIFIED AND WILL BE ISSUED OUT IF THERE ARE INDEED OPPORTUNITIES TO ADVICE THE

PRIVATE SECTOR SET THAT CORRECT? >> YOU ARE -- SECTOR.

IS THAT CORRECT? >> YOU ARE EXACTLY RIGHT.

ESSENTIALLY WHAT WE'RE DOING IS FLIPPING THE MODEL.

INSTEAD OF SPENDING THE MONEY FIRST AND ASKING FOR BUDGET APPROVAL, WE'RE MATCHING THE STATE LEGISLATIVE CODE THAT REQUIRES WE GET BUDGET APPROVAL BEFORE WE SPEND THE MONEY.

AND THAT IS WHAT WE'RE DOING. WE'RE FLIPPING THAT MODEL TO ENSURE WE'RE SAYING TO YOU THAT THESE MONEYS ARE EARMARKED -- THIS MILLION DOLLARS IS EARMARKED FOR COMPANY EXPANSION ONLY. SO LET'S BE CLEAR.

THIS IS NOT MONEY THAT WE CAN FOLD NOR DO WE EVER HOLD MONEY NOR CAN WE SPEND THIS MONEY ON OTHER ITEMS. IT IS ONLY APPROVED FOR CONTRACTUAL RELATIONSHIPS THAT WE WOULD ENTER INTO WITH COMPANIES FOR THEIR EXPANSION EFFORTS. IT COULD BE RETENTION EFFORTS AS WELL WHICH IS WHAT WE DO WITH EXISTING COMPANIES.

SO WE WANT TO BE VERY CLEAR THAT THAT'S WHAT IT IS.

IT'S CONSIDERED BY THE BOARD. THE BOARD THEN VOTES ON IT.

AND THEN AT CERTAIN LEVELS, IT IS THEN REQUIRED TO GO TO CITY COUNCIL FOR THE COUNCIL TO VOTE ON THE PARTICULAR INCENTIVE DEAL. ZE ACCOUNTED FOR SALES TAX REDUCTIONS. YOU WILL NOTICE THAT IN THE BUDGET. THE CITY HAS FORECASTING EXPERTS AS WELL AS SOFTWARE. WE HAVE ALSO HIRED ACT OUTSIDE COMPANY TO FORECAST SO YOU'LL NOTE THAT WE HAVE ANTICIPATED THAT AND WE UNDERSTAND THAT THERE WILL BE IMPACTS OF THE COVID-19 CLOSURES.

[00:25:01]

>> AND JUST FOR CLARITY, ONE THING THAT YOU HAVE TALKED ABOUT WAS HAVING A HIGHER DEGREE OF TRANSPARENCY.

AND REALLY IDENTIFYING WHO THOSE AMOUNTS COULD BE RATHER THAN HAVING A MODEL WHERE THEY COULD BE ANYTHING JUST BASED ON THE CLIENT. ADDITIONALLY, IF THERE ARE, APPROVALS NEED TO TAKE PLACE IN INCREMENTS LESS THAN $250,000 TO INCENTIVIZE THE PRIVATE SECTOR, THE PUBLIC WILL BE ALLOWED TO SEE WHAT THAT LOOKS LIKE ONCE APPROVED.

SO ANY MONEY SPENT WITH REGARD TO IF MONEY SET ASIDE, THE PUBLIC WILL INDUSTRIAL OPPORTUNITY TO BE ABLE TO SEE HOW THAT MONEY IS BEING SPENT. ADDITIONALLY, WE TALKED ABOUT THE REDUCTION THAT IS HIGHLY PROBABLE AND YOU'VE ACCOUNTED FOR WHAT THAT MAY LOOK LIKE. IS THAT CORRECT?

>> IT IS CORRECT, MAYOR. THANK YOU.

>> DOES COUNCIL HAVE ANY ADDITIONAL QUESTIONS OR

COMMENTS? >> I HAVE ONE MORE FOLLOW UP.

IN THE PRESENTATION YOU MENTIONED THAT THE NEXT ITEM ON THERE, THE $985,000 PURCHASE IS IN THE BUDGET.

WHERE IS THAT EXACTLY? I WASN'T SEEING THAT.

>> I'M FLIPPING THROUGH THE SPREADSHEET TO BE TUBAL TELL YOU THAT. AND I APOLOGIZE COUNCILMAN PRICE. IT'S GOING TO TAKE ME JUST A MOMENT TO FIND IT.

>> THAT'S ALL RIGHT. I DIDN'T ASK YOU EARLIER BECAUSE I DIDN'T THINK IT WAS IN THERE UNTIL YOU MADE THAT COMMENT DURING YOUR PRESENTATION. I HAD LOOKED FOR THAT.

AND I DIDN'T SEE IT.

I DIDN'T SEE ANYTHING WITH THAT AMOUNT THAT WAS CHANGED.

A VARIANCE.

>> AND I HAVE DOWN THAT IT'S IN THERE AND AS I LOOK THROUGH IT I WANT TO CONFIRM THAT I MAY NOT HAVE PUT NIT THERE BECAUSE I WANTED YOU ALL TO APPROVE IT FIRST.

I APOLOGIZE. IT'S JUST GOING TO TAKE ME A MINUTE TO TRY TO FIND IT.

YOU HAVE 161 YOU'LL SEE IT ON YOUR -- OFFICE BUILDING AND

GARAGE PROPERTY. >> SO THAT'S THE PURCHASE.

>> THAT IS THE PURCHASE AND YOU'LL SEE SUBSEQUENT 162 AND 163 WILL SHOW YOU SOME ANTICIPATION OF EXPENSES MAY NOT SHOW 163 BECAUSE THAT'S -- THOSE ESTIMATES HAVEN'T BEEN PUT IN PLACE FOR NEXT YEAR'S BUDGET FOR ANTI ANTICIPATED REMODELING AND/OR EXPENSES RELATED.

SO YOU SHOULD JUST BE ABLE TO SEE 161 FOR THIS YEAR'S BUDGET.

1.1 MILLION WHICH IS A $75,000 INCREASE IN WHAT WE ANTICIPATED.

>> IT SAYS 958 ON THE ITEM EVEN CLOSING FEES INCLUDED IN THE

BUDGET OF THE ITEM? >> THAT'S WHAT IT IS.

CLOSING FEES AS WELL AS SOME REMEDIATION OF THE GARAGE JUST CLEAN UP. I SHOULD NOT USE THE WORD REMEDIATION. IT'S ACTUALLY JUST CLEAN UP.

AND SOME IMMEDIATE NEEDS OF THE FACILITY.

>> THANK YOU, MAYOR. >> YOU'RE WELCOME.

>> COUNCILMAN PRICE, ANY OTHER QUESTIONS FROM THE COUNCIL --

>> I HAVE ONE. >> HAVE YOU HAD ANY REQUESTS FOR SUPPORT OUT OF THE $3 MILLION KITTY THAT WE SET ASIDE YET?

>> WE HAVE COUNCILMAN. THE BOARD OF DIRECTORS MEETS ON

[00:30:01]

WHAT I'M HOPING WILL BE TWO OR THREE AWARDS.

WE'VE HAD ABOUT FIVE REQUESTS. IT'S A GREAT REALIZATION THAT WE HAVE COMPANY NAYS OUR COMMUNITIES DOING BUSINESS THAT ARE SAYING THEY WOULD RATHER GO TO COMPANIESNA ARE EXPERIENCING A GREATER IMPACT. AND THEY'RE KIND OF STEPPING BACK AND MOVING ASIDE FOR THOSE COMPANIES THAT HAVE BEEN IMPACTED AT A GREATER LEVEL. SO YOU WILL HEAR AFTER THE 21ST YOU WILL HEAR THE ANNOUNCEMENT OF THE COMPANIES THAT WE'VE BEEN ABLE TO FUND AND WHAT -- HOW WE'RE MOVING THAT GRANT FUND ALONG. THANK YOU FOR ASKING ABOUT THAT.

>> OKAY. AND ON THE MILLION DOLLARS DCOA DOESN'T HAVE A HISTORY OF MANY LESS THAN 250,000 DO THEY?

>> NO, SIR. OUR MISSION IS ABOUT CREATING QUALITY PRIMARY JOBS AND IT'S ABOUT HELPING TO PARTNER WITH COMPANIES AS THEY INFUSE CAPITAL AND INVESTMENT INTO THE COMMUNITY AS WELL. AND THAT TYPICALLY IS SIZABLE INVESTMENTS WHICH MEANS THAT WE'RE PARTNERING WITH THEM IN A WAY THAT ALIGNS WHERE WHAT THEIR INVESTMENT IS.

LIKE THE HEARTMAN'S DEAL YOU ALL JUST APPROVED.

THAT'S $12.5 MILLION AND THE DCOA IS PARTICIPATING AT 7.5% AT $9,000. SO YOU ARE CORRECT.

>> THANK YOU.

>> ANY ADDITIONAL QUESTIONS? >> QUICK FOLLOW UP.

I DIDN'T REALIZE THAT HAD STARTED.

I HAD NOT SEEN A PRESS RELEASE ON THAT EVEN I'VE HAD SOME PEOPLE ASK ME ABOUT THE DCOA ASSISTANCE RELATED TO THE COVID-19. HAS THERE BEEN A PRESS RELEASE OR A STORY OR POSTING OR SOMETHING WHERE PEOPLE CAN FIND OUT HOW TO FOLLOW UP ON THAT?

>> YES. THERE HAS BEEN.

AND I WOULD DIRECT PEOPLE TO OUR WEBSITE.

DEVELOPABILENE.COM. WE HAVE ALL THE INFORMATION POSTED AS WELL AS WE'VE IMPLEMENTED SPECIFIC STRATEGIES TO REACH OUT DIRECTLY TO QUALIFIED COMPANIES AS WELL AS HAVING ONE-ON-ONE VIDEO CONFERENCE INTERVIEWS WITH THESE COMPANIES TO WALK THEM THROUGH THE PROCESS.

>> THREES FOR THE INDUSTRIAL SECTOR OF OUR COMMUNITY.

I APPRECIATE YOU DIRECTING THOSE ENTITIES THAT DON'T GO UNDER THAT UMBRELLA AND OTHER SOURCES OF ASSISTING THEM.

WE'RE JUST ON ITEM 11 RIGHT NOW? >> CORRECT.

>> WE HAVE A MOTION. IS THERE A SECOND?

>> WE HAVE A SECOND.

IS THERE ANY FURTHER DISCUSSION? WE'RE READY TO VOTE.

>> ROLL CALL VOTE.

[12. Resolution: Receive a Report, Hold a Discussion and Public Hearing, and Take Action on approving the Development Corporation of Abilene, Inc.'s purchase of property in Central Abilene (Misty Mayo)]

[00:35:39]

>>> SET DCOA FEELS VERY STRONGLY THAT THIS OPPORTUNITY THAT WAS GIVEN TO US BY THE COMPANY THAT THIS IS ONE THAT WILL HELP NOT ONLY ENHANCE DOWNTOWN ABILENE BUT ENSURE THAT THROUGH THE OWNERSHIP OF THE DCOA THAT WE CAN BE A LONG STANDING CON TRIBUTING OFFICE PARTNER IN DOWNTOWN ABILENE SUPPORTING NOT ONLY DOWNTOWN BUT ALSO SUPPORTING THE COMMUNITY IN A WAY THAT HELPS US. ENSURING THAT WE HAVE THE OPPORTUNITY TO HAVE FOLKS WORKING DOWNTOWN IS AN ADDED BENEFIT.

THIS IS ALSO A PERMANENT COST EFFECTIVE HOME IN ORDER FOR THE DEVELOPMENT CORPORATION OF ABILENE AS WELL AS OUR PARTNERS IN THE DEVELOP ABILENE MISSION FOR US TO CONTINUE THAT MISSION.

I HAVE A POINT THAT THE $985,000 IS THE APPRAISED VALUE.

THAT IS AN AMAZING THAT WE RECEIVED FROM PARAMOUNT PROPERTIES. WE ACTUALLY CONDUCTED OUR OWN APPRAISAL. ORIGINALLY THE ASKING PRICE FAR EXCEEDED WHAT WE WERE ABLE TO AGREE UPON AT THE PRICE LISTED.

I UNDERSTAND THAT THERE WERE A FEW QUESTIONS ABOUT THE TAX APPRAISED SE VALUE. I BELIEVE THERE WAS A MISREPRESENTATION OF THE TAX APPRAISED VALUE.

I WANT TO ADD CLARITY THAT THE TAX APPRAISED VALUE MUST BE CONSIDERED FOR THE PARKING GARAGE AS WELL.

THAT IS A STRUCTURE THAT'S INCLUDED IN THE DEAL.

SO THE TOTEM TAX APPRAISAL FOR BOTH THE PARKING STRUCTURE AND THE BUILDING IS $632,728,000. WHILE THE APPRAISED VALUE WAS $985,000.

WE HAVE REGISTERED WITH A NUMBER OF EXECUTIVES AS WELL AS RUNNING COMPS ON A NUMBER OF AVAILABLE OFFICES.

DOWNTOWN AND UNDERSTANDING THAT FROM THE COMMERCIAL REAL ESTATE PERSPECTIVE AS WELL AS OUR BOARD AND CONSIDERING THE COMPS, WE BELIEVE THIS IS A VERY GOOD VALUE AND MORE IMPORTANTLY WE BELIEVE THAT IT WOULD COST US EXPONENTIALLY HIGHER A LARGER AMOUNT MONEY IF WE WERE FACED WITH THE PROPOSITION OF HAVING TO MOVE FROM THIS FACILITY.

[00:40:21]

AND HAD TO REHABIT AND THE AMOUNT OF NOT ONLY FINANCIAL COMMITMENT THAT WAS PUT INTO THAT PROJECT, THAT BUDGET FAR EXCEEDED WHAT THE DCOA IS LOOKING TO SPEND FOR THIS FACILITY. THAT AUGMENTS OUR MONTHLY RENT.

THIS CERTAINLY WAS THE BEST VALUE FROM A FINANCIAL

STANDPOINT. >> ANY ADDITIONAL QUESTIONS OF COUNCIL PRIOR TO THE PUBLIC HEAR SNOWING.

>> I'VE GOT A FEW. YOU JUST MADE A COMMENT ABOUT STAYING ADJACENT TO OR NEARBY YOUR EXISTING PARTNER WITH AIF WHICH IS PART OF THE CHAMBER. SO ARE YOU EXPECTING THE CHAMBER

TO STAY THERE LONG TERM? >> I WANT TO ADDRESS TWO THINGS.

>> ONE IS THAT THE ABILENE INDUSTRIAL FOUNDATION ACTUALLY MIGHT BE MANAGED BY THE CHAMBER BUT IT'S ACTUALLY A PUBLIC PRIVATE PARTNERSHIP OF WHICH BOTH THE DCOA AND THE CHAMBER ARE PARTNERS. SO THE CHAMBER IS THE MANAGING PARTNER BUT TO SAY THAT THAT BELONGS TO ONE AGENCY OR ANOTHER I WANT TO OFFER CLARIFICATION TO THE PUBLIC THAT THAT'S A PUBLIC PRIVATE PARTNERSHIP ORGANIZATION.

SO BEYOND GUARANTEEING TO THE COUNCIL THAT WE CONTINUE TO WORK TO MAINTAIN THEM TO THE FULLEST EXTENTS OF WHAT WE'RE ABLE TO DO. SO WHAT I'M HEARING IS THAT THE AIF WOULD HAVE A SEPARATE LEASE OR DOES HAVE A SEPARATE LEASE OR ARE THEY UNDER YOUR LEASE OR UNDER THE CHAMBER'S LEASE.

>> GREAT QUESTION. BECAUSE THEY ARE MANAGED BY THE CHAMBER, AND CONSIDERED PART OF THE AFFILIATE -- SO IF THE CLAIM BETTER DECIDED TO MOVE SOMEWHERE WELLS BECAUSE THEY WERE RUNNING OUT OF SPACE WOULD THE AIF GO WITH THEM OR STAY WITH YOU OR

MAKE THEIR OWN DECISION? >> ONE THING I'M BRINGING BACK TO YOU AND THE COUNCIL AND WE ANTICIPATE IN JUNE BUT I'VE SAID JUNE OR JULY IS A REALIGNMENT IN THE WAY THE DCOA AND THE AIF AND THE CHAMBER ARE CONDUCTING OUR BUSINESS OF ECONOMIC DEVELOPMENT. IT'S GOING TO CONTRIBUTE TO THE STRATEGIC PLAN AND OUR ABILITY TO BE AS EFFECTIVE AS POSSIBLE.

ONE OF THOSE CONSIDERATIONS IS WHERE WOULD THE AIF BE HOW

[00:48:44]

HASSED. >> PRIOR TO THE PUBLIC HEARING.

>> I HAVE COMMENT. YOU KNOW, I HAVE TO REMIND MYSELF THAT THIS IS AN ASSET. IT'S NOT AN EXPENSE AND WE'LL ALWAYS OWN IT AND IN DUE TIME IT'S NOT THE RIGHT THING TO OWN WE CAN SELL IT AND I SUSPECTED IF WE DON'T BUY IT, PARAMOUNT PROPERTIES WILL MARKET IT NATIONWIDE AND SOME OUT OF STATE INVESTOR MAY THINK THIS IS A HOT DEAL AND IT COULD WORK OUT GREAT OR MIGHT NOT WORK GREAT SO WE HAVE SOME CONTROL OVER OUR DESTINY AND I THINK THE DCOA NEEDS TO BE IN A PRESENTABLE BUILDING. I'M NOT OPPOSED TO IT.

ADDITION TEA COMMENTS FROM COUNCIL PRIOR TO THE PUBLIC HEARING? AT THIS TIME, I WILL OPEN UP THE PUBLIC HEARING. IS THERE ANYONE WHO WOULD LIKE TO SPEAK EITHER FOR OR AGAINST THIS ITEM? PLEASE DIAL STAR 9 ON YOUR PHONE TO LET THE SECRETARY KNOW YOU

WOULD LIKE TO SPEAK. >>> STATE YOUR NAME FOR THE

[00:51:01]

RECORD.

>> I UNMUTED TWO AND HE SPOKE ON BOTH OF THEM.

>> IS ANYONE ELSE ON THE LINE THAT WANTS TO SPEAK?

>> THAT'S THE ONLY HAND THAT WAS RAISED.

>> MR. SCHWARTZ ARE YOU THERE? RIGHT 2340U MY I CON SAYS YOUR PHONE IS MUTED.

>> OKAY. I GUESS WE'RE HAVING INTERNET CONNECTION PROBLEMS. I'M UNDERSTANDING THAT THE CALLER IS NOT IN FAVOR AND SPOKE AGAINST THIS ITEM. COUNSELOR SMITH, STANLEY.

>> YES. >> SO SHOULD I ABORT THIS CALL

OR -- >> THE ONLY THING WE'RE REQUIRED TO DO IS PROVIDE PUBLIC ACCESS TO THE MEETING.

IF HE'S HAVING ISSUES CALLING IN THAT'S NOT ANYTHING THAT WE CAN DO ANYTHING ABOUT. I THINK HE GAVE HIS MACHINE ON

IT. >>> THERE'S ONE MORE PERSON THAT

JUST RAISED THEIR HAND. >> OKAY.

>> CALLER, YOU'RE ON. PHONE NUMBER ENDING IN 230.

>> CALLER, YOU'RE ON.

>> CALLER ENDING IN 230, YOU'RE ON.

[00:55:13]

YOU'RE ON, CALLER. WHAT'S YOUR NAME, CALLER? FOR THE RECORD?

>> I BELIEVE IT MIGHT BE STAR 6 TO UNMUTE YOURSELF.

>> CALLER, YOU'RE ON.

>> I BELIEVE HE SAID HIS NAME WAS EDWARD WALKER.

>> EDWARD WALKER, YOU'RE ON.

ARE THROUGH, MR. WALKER?

>> IS THERE ANYONE ELSE?

>> I'LL ACCEPT A MOTION AND A SECOND.

>> SO MOVED. >> SECOND.

>> AND A SECOND.

EH NEXT SLIDE, PLEASE. PHOTOGRAPHS OF THAT AREA SHOWING THE GENERAL INDUSTRIAL RETAIL NATURE OF THAT AREA.

AND A NOTIFICATION MAP SHOWING ONE IN FAVOR ZERO IN OPPOSITION.

CONSISTENT WITH THE LAND USE AND ZONING CHARACTER OF THAT IMMEDIATE AREA. STAFF RECOMMENDS APPROVAL.

THE PLANNING STONEING COMMISSION THAT -- ZONING COMMISSION AND THEY'RE RECOMMENDING APPROVAL TO COUNCIL.

>> THANK YOU. DOES COUNCIL HAVE ANY QUESTIONS OF STAFF PRIOR TO THE 3UB LICK HEARING -- PUBLIC HEARING? AT THIS TIME, I WILL OPEN UP THE PUBLIC HEARING.

IS THERE ANYONE WHO WOULD LIKE TO SPEAK EITHER FOR OR AGAINST THIS ITEM? PLEASE DIAL STAR 9 ON YOUR PHONE TO LET THE SECRETARY KNOW IF YOU WOULD LIKE TO SPEAK AND YOU WILL BE UNMUTED. WHEN YOU HEAR THAT YOU'VE BEEN UNMUTED, PLEASE STATE YOUR FULL NAME CLEARLY FOR THE RECORD.

DO WE HAVE ANYONE?

>> NO, SIR, I'M NOT SEEING ANY HANDS.

[01:05:03]

>> UNDERSTANDING WE HAVE NO CITIZENS WAITING, I WILL CLOSE THE PUBLIC HEARING. DOES COUNCIL HAVE ANY QUESTIONS OF STAFF PRIOR TO THE VOTE?

>> I'LL ACCEPT A MOTION AND A SECOND.

>> SO MOVED. >> SECOND.

>> WE HAVE A MOTION AND A SECOND.

ANY FURTHER DISCUSSION? WE'RE READY TO VOTE.

>>] ROLL CALL VOTE] --

>> MOTION CARRIES. >> WE'LL NOW MOVE TO ITEM 15.

[Items 15 & 16]

MAYOR PRO-TEM HURT WILL PRESIDE OVER THIS ITEM.

I'M CONFLICTED BECAUSE OF THE PROXIMITY OF THE AREA AND MY EMPLOYER ABILENE CHRISTIAN UNIVERSITY.

>> IF YOU COULD LET EVERYONE KNOW THE CALL IN PROCESS FOR THE PUBLIC HEARING BEFORE WE START?

>> YEAH IS THE SO IF YOU WANT TO SPEAK ON THIS ITEM, NOW IS THE TIME TO CALL IN. {877}853-5257.

ONCE THE MAYOR PRO-TEM OPENS THE PUBLIC HEARING, DIAL STAR NINE.

>> THANK YOU VERY MUCH. THIS IS AN APPEAL ON THE REZONING CASE THAT WAS HEARD AT THE PLANNING COMMISSION LAST MONTH. THIS IS Z 202001.

THE APPLICANT IS NICK COATS. THE REQUEST IS TO APPEAL A DECISION MADE BY THE PLANNING AND ZONING COMMISSION.

REGARDING A PROPOSED AMENDMENT TO A PLANNED DEVELOPMENT STACKED. IT'S DISTRICT 144.

THAT IS THE ONE THAT IS CURRENTLY IN PLACE.

NOTIFICATION AS REQUIRED WE RECEIVED ZERO IN FAVOR AND FOUR IN OPPOSITION. PLANNING AND ZONING COMMISSION MET ON APRIL 7TH. THERE WAS A MOTION TO APPROVE THE REQUEST BUT THAT MOTION FAILED BY A VOTE WHICH RESULTS IN A DENIAL. NEXT SLIDE, PLEASE.

>> I THINK EVERYONE IS FAMILIAR WITH THIS CASE.

IT DOES HAVE SOME HISTORY THIS THE IS A LOCATION MAP SHOWING THAT'S GAR FIELD AVENUE IS THE LOCAL STREET TO THE SOUTH.

I-20 OUT TO THE NORTH. NEXT SLIDE.

ZONING IN THAT GENERAL AREA AGAIN THIS IS A PLANNED DEVELOPMENT. THIS IS A 14-ACRE TRACT.

THE REQUEST -- THE CURRENT PD SPE SPECIFIES -- TOE THE PLANNING AND ZONING COMMISSION.

THE PD ZONING BASICALLY IS A SPECIFIC USE TYPE ZONING.

I CAN'T COME IN AND SUBMIT A SITE PLAN AND THEN GO OUT THERE AND DO SOMETHING ENTIRELY DIFFERENT.

SO HE WILL BE BOUND TO THIS SITE PLAN.

[01:10:03]

NOTIFICATION MAP AND THE RESULTS IF YOU'RE IN FAVOR AND YOU CAN SEE THE FOUR IN OPPOSITION DOWN ON THE SOUTHERN PART THE LOT.

WE DID REVIEW THIS CASE PURSUANT FOR CONSISTENCY WITH THE CITY'S COMPREHENSIVE PLAN AND FUTURE LANDING PLANT MAP.

WE FOUND THAT IT IS GENERAL CONSISTENT WITH BOTH OF THOSE.

APPEAL THAT DECISION TO COUNCIL WHICH IS BEFORE YOU TODAY.

STAFF RECOMMENDS APPROVING REQUESTED AMOUNTS TO PD 144 SUBJECT TO THREE OVERRIDING CONDITIONS.

POTENTIALLY POSSIBLY THE SECOND CONDITION COULD BE WOULD BE THAT THE FUTURE SUBDIVISION OR REPLANNING OF THE SUBJECT PROPERTY WOULD COMPLY.

>> I HEAR THAT WE'RE NOT GOING TO ALLOW IT WITH THIS.

I JUST WANT TO MAKE SURE THAT -- >> THE PROVISIONS OF THIS PLANNED DEVELOPMENT AMENDMENT WOULD PRECLUDE THAT FROM HAPPENING NOW. THAT'S TO PROHIBIT OR SAY THAT IN THE FUTURE SOME APPLICANT COMES IN, THE PROPOSAL TO DO THAT WOULD BE ANOTHER REZONING ACTION THAT WOULD COME AGAIN BEFORE THE PLANNING AND ZONING COMMISSION AND TO CITY COUNCIL FOR CONSIDERATION.

-- IS THERE ANYONE ELSE? >> YES.

THIS IS COUNCILMAN ALVEZ. TOTALLY POPULATED WITH CARS IN THE STREET. NO MORE THAN MY STREET.

AND SO I KEPT WONDERING WHAT THE REAL CONCERN WAS.

OF COURSE, NOBODY WANTS THEIR AREA CHANGED.

[01:15:08]

IT LOOKS LIKE A NORMAL REQUEST TO ME.

THANK YOU. ANYONE ELSE?

>> I'VE GOT A FEW THINGS. I HAD ASKED STAFF TO LOOK AT A FEASIBILITY OF A NORTHERN ENTRANCE.

THERE IS NOT ENOUGH RIGHT OF WAY AT THIS TIME TO PUT A STREET TO THE NORTH. THE OWNER THAT WOULD -- THAT OWNS THE ADDITIONAL LAND THAT WOULD BE NEEDED FOR THAT IS REALLY NOT -- IS UNWILLING TO SELL.

THERE'S ALSO A LARGE BILLBOARD THERE NOW.

I DROVE BY AND LOOKED AT IT. I WOULD NEVER SEE US AS THE CITY SEES A PROPERTY FOR A PRIVATE DEVELOPMENT.

SO I JUST ADOPT THINK THERE IS FEASIBILITY FOR A NORTHERN ENTRANCE. I WANT TO REPEAT THAT THIS DOES NOT PROVIDE ACCESS FROM CAMPUS COURT TO THE I-20 ACCESS AND IT WILL ABANDON CAMPUS COURT. IF YOU LOOKED AT THE WAY IT'S DEVELOPED NOW OR APPROVED NOW THAT THE LOWER PORTION ALREADY FEEDS TO THE SOUTH. AND WITH THE ADDITIONAL CONDITIONS, WE CAN STIPULATE NO MORE THAN 36 WATTS AND NO MORE THAN ONE STRUCTURE OR ONE DMREKS TO TWO UNITS.

PER LOT. AND WE CAN PUT THAT IN

ADDITIONAL CONDITIONS. >> IS THE MAJORITY OF THE OPPOSITION WHEN THEY EXPRESSED THEIR OPPOSITION, WHAT WAS THEIR MAIN ARGUMENT IN REGARDS TO WHAT MR. COATS WAS TRYING TO DO? WAS IT ANSWERED IN THE PRESENTATION ALREADY?

>> I THINK IT WAS, COUNCILMAN CRAIGER.

ADOOREDING TO MY -- ACCORDING TO MY EMAILS, THE BIGGEST CONCERN WAS ACCESS INTO THAT NEIGHBORHOOD FROM STANFORD

STREET, THE I-20 ACCESS ROAD. >> RIGHT.

>> NO ONE WANTS AN ACCESS TO 120.

MANY OF THEM DIDN'T COMMENT ON THE HOUSING DEVELOPMENT.

IT WAS JUST ABOUT ACCESS TO I-20 FROM CAMPUS COURTS.

SOME DID OF COURSE WANT THE HOUSING DEVELOPMENT AND SOME THOUGHT IT WOULD BE A GOOD ADDITION TO HAVE A DIFFERENT VARIETY OF NEWER HOUSING FOR OLDER PEOPLE SO A COUPLE OF PEOPLE WELCOME IT TO THE NEIGHBORHOOD.

>> ANYONE ELSE? ALL RIGHT.

I'M GOING TO OPEN UP THE PUBLIC HEARING AND BEFORE YOU DO THAT, I'M GOING TO ASK JUST LIKE IN REGULAR MEETINGS THAT YOU WOULD KEEP YOUR COMMENTS TO THREE MEETINGS OR LESS AND YOU'LL HAVE ONE OPPORTUNITY TO CALL IN. PLEASE BE RESPECTFUL OF EVERYONE ELSE THAT WANTS TO SPEAK AND WE ASK THAT YOU ONLY HAVE YOUR COMMENTS ONE TIME, LIMIT TO THREE MINUTES.

>> CALLER ENDING IN 355, CAN YOU HEAR? ONCE AGAIN, THEY NEED TO PRESS STAR 9 ON THEIR END.

>> YES. THEY DO.

I THINK IT'S STAR 6 TO UNMUTE YOURSELF.

>> CALLER ENDING IN 355.

[01:20:12]

>> SHE SAID HER NAME WAS DONNA WILLIAMS. DONNA WILLIAMS. CAN YOU HEAR US?

>> I'M SORRY. ARE SOME OF YOU HEARING SOMEBODY

TALKING? >> I HEARD HER SAY HER NAME WAS DONNA WILLIAMS.

>> QUA HEAR ME? THIS IS DONNA WILLIAMS.

>> GO AHEAD. >> YEAH.

I AM -- >> MS. WILLIAMS.

>> YES. CAN YOU HEAR ME?

>> CAN YOU HEAR? >> YES, I CAN HEAR YOU.

CAN YOU HEAR ME? >> YES.

GO AHEAD, MS. WILLIAMS.

>> MS. WILLIAMS GOB AHEAD.

>> I'M NOT SURE HOW TO PROCEED.

>> STANLEY. DO YOU HAVE INPUT?

>> WELL, THE -- IN ORDER TO HAVE A VIRTUAL HEARING, WE HAVE TO ALLOW THE PUBLIC TO COMMENT. IF THERE'S A TECHNICAL ISSUE THAT'S CAUSING A PROBLEM, WE NEED TO GET THAT FIGURED OUT IN IF ORDER TO BE ABLE TO PROCEED. ESPECIALLY ON THESE ORDINANCE HEARINGS THAT REQUIRE A PUBLIC HEARING.

THIS IS MORE THAN JUST PUBLIC COMMENT.

SO WE'RE NOT ABLE TO GET THIS RESOLVED IN THIS EXACT MOMENT BY ADVICE WOULD BE TO RECESS THIS MEETING AND RECALL THE MEETING FOR A LATER TIME THIS AFTERNOON TO SEE IF WE CAN GET THESE TECHNICAL ISSUES IRONED OUT. IT MAY WITH JUST BE AN ISSUE OF DELAY IN THE TRANSFER OF COMMUNICATION.

I DON'T KNOW. WE'RE NOT HEARING THE PERSON CALLING IN UNTIL A LATER TIME AT THIS TIME JUST DON'T KNOW.

>> LET ME ASK THIS QUESTION. IF WE POSTED THESE ITEMS, THESE THREE OR FOUR ZONING ORDINANCE ITEMS THAT VICE PRESIDENT PASSED YET, IF WE POSTED THOSE FOR THE NEXT MEETING IN MAY, IS THERE ENOUGH TIME FROM A NOTICE STANDPOINT TO BE ABLE TO MEET THAT REQUIREMENT TO HAVE THEM HEARD AGAIN?

>> WELL, YEAH, THE OTHER OPTION WOULD BE IF THE COUNCIL WANTS TO MAKE A MOTION TO TABLE THE REMAINDER OF THESE ITEMS FOR THE NEXT MEETING, WE COULD DO THAT AS WELL BECAUSE I'M ASSUMING THAT THE PUBLIC IS ABLE TO WATCH THIS AND HEAR IT AND SO THAT WOULD SATISFY THE NOTICE REQUIREMENTS TO TABLE ALL OF

THESE UNTIL THE NEXT MEETING. >> WHERE I'M GOING WITH THAT --

>> A COUPLE OF OTHER PEOPLE DPSH.

>> WE CAN DO WHAT COUNCIL WANTS TO DO.

MY POINT ON THIS IS THE FOLLOWING: I'VE HAD MY BELLY FULL OF THESE VIRTUAL MEETINGS BECAUSE I THINK THEY'RE AWKWARD FOR THE PUBLIC AND THE COUNCIL AND I WOULD LIKE FOR US TO MEET IN PERSON AGAIN IF THAT'S THE PLEASURE OF THE COUNCIL AND WE COULD DO THAT TODAY AND HAVE THESE PUBLIC HEARINGS IN A FASHION THAT IS MORE -- SCOMBLI SAY AMEN TO THAT.

>> HALLELUJAH. >> I GUESS I MEAN THIS IS AN IMPORTANT ISSUE AND WE KNOW THAT WE HAVE CITIZENS THAT WANT TO

TALK ON THIS. >> AND SINCE WE'RE NOT ABLE TO WORK OUT OUR TECHNICAL PROBLEMS, I KNOW THAT I CAN'T MEET THIS AFTERNOON. I'M GOING TO ASK THE COUNCIL THAT WE GO BY THE RECOMMENDATION FROM STAFF TO TABLE THE REST OF THE AGENDA ITEMS UNTIL THE NEXT MEETING.

[01:25:08]

THAT WOULD BE ITEMS 15 AND 16. 15 THAT WE'RE CURRENTLY ON AND

AND 16. >> I'LL MAKE THAT MOTION.

>> I'LL SECOND IT. I THINK IT'S A MUST.

>> IS THERE ANY FURTHER DISCUSSION?

>> WE'RE READY FOR THE VOTE. CAN THE THREE ABSTAINING VOTE ON THESE THREE OR ON THIS TABLING? ?

>> NOT ON 15. >> OKAY. SO DO I STILL NEED TO ASK FOR THEIR VOTE? DO 15 AND 16 SEPARATELY SO THEY CAN VOTE SEPARATELY. SO FOR ITEM 15 MAJOR PRO-TEM] ROLL CALL VOTE]

MOTION CARRIES. >> AND THEN ITEM 16.) ROLL CALL VOTE] FOR

. >> MOTION CARRIES.

>> MOTION CARRIES. BACK TO YOU, MAYOR.

[PUBLIC COMMENTS]

>> WE'LL NOW MOVE TO THE PUBLIC COMMENT PERIOD.

IF THERE IS ANY NEWING TO DISSIPATE IN THE PUBLIC COMMENT PERIOD, AGAIN, THAT NUMBER IS ON YOUR SCREEN.

877853 -- >> I THINK IT'S GOING TO WITH

THE SAME ISSUE THOUGH. >> I THINK MAYOR PROBABLY THE

SAME ISSUE. >> OKAY. SO DO WE WANT TO ELIMINATE PUBLIC COMMENT PERIOD FOR TODAY ALSO?

>> IT'S STAFF'S RECOMMENDATION THAT RECESS THE MEETING AND WE BEGIN AGAIN AT THE NEXT COUNCIL MEETING WITH AN IN PERSON FORMAT WITH THE PUBLIC ATTENDING COUNCIL CHAMBERS.

>> FOR ANYONE THAT'S LISTENING, CAN YOU ADDRESS HOW WE'RE GOING TO HANDLE TOMORROW'S MEETING? WILL THAT BE STILL VIRTUAL OR WILL WE MEET UP THERE AT COUNCIL CHAMBERS?

>> THAT'S A GREAT QUESTION. BECAUSE OF THE LANGUAGE AND HOW IT'S POSTED, THE MEETING TOMORROW NEEDS TO BE VIRTUAL BECAUSE WE'VE GOT THIS POSTED AND I BELIEVE STANLEY CONCURS.

IT'S A LEGAL QUESTION. >> LEGALLY, AGAIN IF THE TECHNOLOGY DOES NOT ALLOW US TO HAVE A VIRTUAL MEETING TOMORROW AND BECAUSE OF FACT THAT OUR DECLARATION OF DISASTER ENDS TOMORROW, MY ADVICE WOULD BE THAT WE CALL AN EMERGENCY MEETING TO BE HELD PUBLICLY IF POSSIBLE TOMORROW AT SOME POINT IF WE CAN'T HAVE A VIRTUAL MEETING, WE NEED TO HAVE A MEETING TOMORROW TO EXTEND OUR DECLARATION AND WE CAN GIVE ONE HOUR NOTICE OF THAT BECAUSE IT WOULD BE AN EMERGENCY.

>> AND IT MIGHT BE A ZOOM ISSUE. I DON'T KNOW IF IT WOULD WORK WITH ANOTHER MEETING TOMORROW. SO DO WE NEED TO GET ASSISTANCE FROM I.T. AND APPRAISAL OF ZOOM AND THEN ALLOW US TO PIVOT AND HAVE A PHYSICAL MEETING TOMORROW?

>> I'M ALL ABOUT A PHYSICAL MEETING TOMORROW.

WE'RE REQUIRED TO HAVE A TOLD FREE CALL IN NUMBER WHICH IS WHY WE'RE USING ZOOM. I DON'T BELIEVE WE HAVE THE ABILITY DO THAT WITH GOOGLE HANGOUTS OR MEET OR OTHER TOOLS.

THIS IS BASED OFF INFORMATION RECEIVED FROM THE I.T.

DEPARTMENT. SO THIS IS WHY WE'RE USING ZOOM.

THEY'RE AWKWARD AND DIFFICULT TO DO.

THEY'RE A PATIENCE TRIER FOR EVERYBODY INCLUDING THE PUBLIC AND I THINKNA IF COUNCIL WANTS TO HAVE AN IN PERSON MEETING BASED ON WHAT THE CITY ATTORNEY HAS JUST SAID WE CAN DO THAT.

WE JUST NEED TO REPOST PROBABLY AFTER THIS MEETING DECLARING AN EMERGENCY MEETING AND MAKING THAT HAPPEN.

AMENDING THE AGENDA AND POSTING AN IN PERSON MEETING.

THAT'S YOUR CALL, COUNCIL. >> I GOT AN EMAIL FROM A JANAIING THEY CAN HEAR EACH OTHER AND WE CAPTAIN HEAR THEM.

SOUNDS LIKE A ZOOM ISSUE. THEY CAN HEAR EACH OTHER AND FOLKS LISTENING CAN HEAR EACH OTHER BUT WE CAN'T HEAR THEM SO

MAYBE THERE'S JUST A ZOOM ISSUE. >> CAN THEY HEAR US?

>> I THINK THEY CAN. WE CAN HEAR -- IT SAYS WE CAN

[01:30:02]

HEAR EACH OTHER ON THE ZOOM CALL BUT YOU ALL CANNOT HEAR US SO THEY CAN HEAR US BUT WE CAN'T HEAR THEM.

>> SO SOME PEOPLE ARE GETTING FRUSTRATED.

I THINK THAT WE SHOULD WITH APPROPRIATE SOCIAL DISTANCING AS MUCH AS POSSIBLE TRY TO HAVE A PHYSICAL MEETING TOMORROW I THINK WE SHOULD POST THAT IMMEDIATELY.

WE'LL HAVE AN OPPORTUNITY IN TWO WEEKS WITH THE REMAIN SILENT AH

REST OF THOSE ISSUES. >> THE ITEMS THAT WE DID NOT DO TODAY WILL NOT BE DISCUSSED TOMORROW.

>> YEAH. IT WILL BE AT THE NEXT CITY COUNCIL MEETING. THAT WAS ITEM 15 AND 16.

I'LL ASK STAFF TO PREPARE A PHYSICAL MEETING WITH AS MUCH AS POSSIBLE SOCIAL DISTANCING TOMORROW AT 8:30 A.M. AND POST IT OPENLY AND ALSO PROVIDE AN OPPORTUNITY FOR A PUBLIC COMMENT PERIOD SINCE WE'RE UNABLE TO DO SO THIS MORNING.

WILL WILL ALSO BE AN OPPORTUNITY TOMORROW FOR THE PUBLIC COMMENT THAT IF PEOPLE DON'T FEEL GOOD COMING TO PHYSICAL CITY HALL THAT THEY CAN CALL IN FOR PUBLIC HEARING OR STANLEY IF WE HAVE A PHYSICAL MEETING IN ORDER TO PARTICIPATE THEY HAVE TO BE AT THE PHYSICAL MEETING. HOW DOES THAT WORK? THIS IS UNCHARTED WATER FOR ALL OF US.

>> THE LAW ALLOWS THE CITY COUNCIL TO HAVE A VIRTUAL MEETING AND ALLOWS -- AS AN AL STERN AT THIS TO HAVING A PUBLIC 3450E9ING. IT IS YOU TO THE COUNCIL WHETHER THEY WANT BOTH A PUBLIC MEETING AND A CALL IN.

THAT'S UNCHARTED BUT THERE'S NO LAW TO THAT SO I WOULD SAY THE IF THERE'S A PUBLIC MEETING THE PUBLIC NEEDS TO BE HERE

>> OKAY. THAT'S FINE. >> JUST FROM MY PERSPECTIVE AS A CITY MANAGER, I WOULD HATE TO BE TO HAVE TO HAVE MULTIPLE VENUES THAT WE'RE TRYING TO BALANCE AND GET INFORMATION FROM.

LAST TIME WE HAD A CALL IN UNDER THAT PARTICULAR SCENARIO IT WAS LESS THAN STELLAR. AND THE TECHNOLOGY IS NOT WORKING FOR US. FOR WHATEVER REASON.

AND MY PREFERENCE AND MY HOPE IS THAT WE CAN RETURN TO A NORMAL

ORDER. >> OKAY. AND THAT'S FINE.

I JUST TOSSED THAT OUT THERE IF SOMEONE ASKED THAT QUESTION SO IF WE'RE HAVING A MEETING TOMORROW AT CITY HALL AT 8:30 AND SOMEONE WANTS TO PARTICIPATE, BE AT CITY HALL AT

8:30 IN THE MORNING. >> YES, SIR.

>> THANK YOU. >> AND I ALSO WANT TO SDWRIEZ THE PUCK FE PUBLIC. STAFF WILL TRY TO PROVIDE APPROPRIATE SOCIAL DISTANCING. WE'LL POST THAT APPROPRIATELY.

WE NEED TOMORROW -- AND AGAIN APOLOGIES AND APPRECIATED YOUR PATIENCE -- APPRECIATE YOUR PATIENCE WITH US AS WE PROCEED.

IS THE COUNCIL IN AGREEMENT WITH THAT? ANY OTHER COMMENTS OR QUESTIONS FROM COUNCIL OR STAFF?

>> I WANT TO CLARIFY ITEM 15 AND 16 WILL BE ON THE NEXT REGULAR

MEETING; IS THAT RIGHT?? >> YEAH.

LET ME SAY THAT AGAIN. ITEM 15 AND 16 ON TODAY'S AGENDA WILL BE INCLUDED IN NEXT REGULATION CITY COUNCIL MEETING WHICH WILL BE ON THE FOURTH THURSDAY OF THE MONTH.

WHICH IS MAY 28TH. IT WILL BE AN EVENING CITY COUNCIL MEETING. AND THE PUBLIC PORTION OF THAT WILL BEGIN AT 5:30 P.M. ANY ADDITIONAL CLARITY NEEDED AT THIS TIME FROM COUNCIL AND OUR STAFF?

>> WHAT ABOUT THE EXECUTIVE MEETING FOLLOWING THIS ONE?

>> WE'RE GOING TO EXECUTIVE MEETING JUST A BIT.

>> ALL RIGHT. IT IS NOW 10:04 A.M.

WE WILL RECESS INTO EXECUTIVE SESSION PURSUANT TO SECTION

[01:35:01]

551.071.

THANK YOU. YOU HAVE A NICE --

>> MAYOR IF I MUST SAY THIS BEFORE WE BREAK INTO EXECUTIVE SESSION. I DON'T HAVE ANYTHING THAT I NEED TO REPORT TO COUNCIL THAT'S A BURNING ISSUE THAT COULD NOT KEEP BECAUSE WE DO HAVE TO COME BACK OUT OF EXECUTIVE SESSION AND CLOSE THE MEETING. MY QUESTION IS DO WE NEED TO GO INTO EXECUTIVE SESSION. AM I MISSING SOMETHING ON THE

AGENDA HERE THAT I'M NOT SEEING? >> STANLEY, DO YOU HAVE ANY ISSUES WE NEED TO DISCUSS WITH COUNCIL IN EXECUTIVE SESSION?

>> THERE'S SOMETHING TO PONDSING UNLESS THE COUNCIL HAD

QUESTIONS. >> SO IS THERE ANY NEED FOR US TO RECESS IN EXECUTIVE SESSION FROM COUNCIL OR STAFF?

>> NOT FOR ME. >> NOT FOR ME.

NO. >> WELL, LET ME DO A PIVOT THEN.

IT IS 10:06 A.M. THIS MEETING OF YOUR ABILENE CITY COUNCIL IS OFFICIALLY ADJOURNED.

SEE YOU TOMORROW IN THE FLESH AT 8:30 A.M.
